DECISION
PROMULGATING THE LIST OF SUPPLIES AND EQUIPMENT IN SERVICE OF PETROLEUM ACTIVITIES, WHICH CAN BE PRODUCED AT HOME
THE MINISTER OF PLANNING AND INVESTMENT
Pursuant to the Governments Decree No. 75/CP of November 1, 1995 defining the functions and tasks of the Ministry of Planning and Investment;
Pursuant to the Governments Decree No. 48/2000/ND-CP of September 12, 2000 guiding the implementation of the amended Petroleum Law;
After reaching agreement with the concerned ministries and branches,
DECIDES:
Article 1.- To promulgate together with this Decision the list of supplies in service of petroleum activities, which can be produced at home, to serve as basis for the determination of supplies which cannot be produced at home yet and are exempt from import tax and value added tax according to the provisions in Articles 54 and 55 of the Governments Decree No. 48/2000/ND-CP of September 12, 2000.
Article 2.- The import of equipment for petroleum activities shall comply with the list of equipment and special-use transport means, which can be produced at home, issued together with Decision No. 214/1999/QD-BKH of April 26, 1999, which serves as basis for determination of equipment which cannot be produced at home yet and are exempt from value added tax according to Article 55 of Decree No. 48/2000/ND-CP.
Article 3.- In this Decision, the "petroleum activities" are defined like in Article 2 of Decree No. 48/2000/ND-CP meaning activities of prospecting, exploring and developing oil and gas fields, exploiting, processing, storing, gathering and transporting oil and gas from the exploitation areas to places of delivery, as well as activities in service of oil and gas prospection and exploration. Other activities in the petroleum domain shall comply with Decisions No. 214/1999/QD-BKH No. 230/2000/QD-BKH and No. 462/2000/QD-BKH.
Article 4.- Vietnam Oil and Gas Corporation and its authorized member units shall have to send official dispatches to the General Department of Customs and local tax offices, certifying that the quantities of supplies and equipment are imported in service of petroleum activities defined in Article 3 of this Decision. In cases where the local customs offices and the importing enterprises fail to reach agreement, Vietnam Oil and Gas Corporation shall propose the Ministry of Planning and Investment to consider and decide the cases. Pending the Planning and Investment Ministrys decisions, the local customs offices shall carry out procedures for customs clearance for the import goods to ensure that petroleum activities shall not be interrupted.
Article 5.- The list of supplies and equipment in service of petroleum activities, which can be produced at home, issued together with this Decision, shall be considered, supplemented and updated annually to suit the practical situation, on the basis of the proposals of domestic production units and specialized State management bodies.
Article 6.- This Decision takes effect 15 days after its signing and also applies to declarations of import goods in service of petroleum activities as from the effective date of the 2000 Petroleum Law (amended) to before the effective date of this Decision.
