CIRCULAR
ON AVIATION SECURITY TRAINING
Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006;
Pursuant to the Law of Vocational education dated November 29, 2006;
Pursuant to the Law of Education dated June 14, 2005 and the Law on amendments to certain articles of the Law of Education dated December 04, 2009;
Pursuant to the Government’s Decree No. 81/2010/ND-CP dated July 14, 2010 on civil aviation security;
Pursuant to the Government’s Decree No. 107/2012/ND-CP dated December 20, 2012 on the functions, missions, authority and organizational structure of the Ministry of Transport;
At the request of the Head of the Department of Personnel and Organization and the Head of the Civil Aviation Authority of Vietnam,
Minister of Transport promulgates the Circular on aviation security training.
Chapter I
GENERAL PROVISIONS
Article 1. Scope
This Circular stipulates the training in civil aviation security.
Article 2. Regulated entities
This Circular applies to the organizations and individuals concerning the training in civil aviation security.
Chapter II
AVIATION SECURITY TRAINING PROGRAMS
Part 1. BASIC TRAINING
Article 3. Education in security screening
1. Objective: Equip learners with the occupational knowledge, skills and manners to conduct the examination, security screening and observation of passengers, baggage, cargo, postal parcels and articles conveyed aboard an aircraft.
2. Entry requirements:
a) Vietnamese citizen from 18 years of age;
b) Possess a high school diploma or equivalent;
c) Be physically fit as per regulations;
d) Possess political and ethical credentials, have an explicit personal history;
dd) Carry no prior conviction or administrative penalty, undergo no ongoing criminal investigation, use no narcotics or stimulants prohibited according to the laws.
3. Program duration: 332 hours.

Article 4. Education in security control
1. Objective: Equip learners with the occupational knowledge, skills and manners to stand guard over restricted areas, to examine and supervise the security of terminals, public areas and airfield.
2. Entry requirements:
a) Vietnamese citizen from 18 years of age;
b) Possess a high school diploma or equivalent;
c) Be physical fit as per regulations;
d) Possess political and ethical credentials, have an explicit personal history;
dd) Carry no prior conviction or administrative penalty, undergo no ongoing criminal investigation, use no narcotics or stimulants prohibited according to the laws.
3. Program duration: 330 hours.

Article 5. Education in mobile security
1. Objective: Equip learners with the occupational knowledge, skills and manners for patrol, guarding, escorting, crowd control, aircraft and vehicle examination and search.
2. Entry requirements:
a) Vietnamese citizen from 18 years of age;
b) Possess a high school diploma or equivalent;
c) Be physical fit as per regulations;
d) Possess political and ethical credentials, have an explicit personal history;
dd) Carry no prior conviction or administrative penalty, undergo no ongoing criminal investigation, use no narcotics or stimulants prohibited according to the laws.
3. Duration: 415 hours.

Article 6. Education in in-flight security
1. Objective: Equip learners with the occupational knowledge, skills and manners to provide protection, maintain order, control the crowd aboard a flying aircraft, use weapons and ancillary equipment to restrain and apprehend violators on a flight, and respond promptly to illegal interference.
2. The program is open to flight marshals.
3. Duration: 270 hours.

3. Duration: 40 hours.

2. The course is open to pilots and flight attendants.

a) Training of pilots and flight attendants in aviation security, except the person defined in Point b, Section 3 of this Article: 32 hours;
b) Training of chief pursers in aviation security: 40 hours.

Article 43. Recurrent training of security guards of air service providers in aviation security
1. Objective: Review and obtain update on the essential knowledge of aviation security to handle mission-related aviation security issues.
2. The course is open to specialized security guards of the providers of air cargo services, flight catering services and aviation fuel; aircraft repair and maintenance companies.
3. Duration: 08 hours.

Article 44. Recurrent training of relevant individuals in aviation security

a) Non-aviation service providers’ personnel working in restricted areas of an airport;
b) Personnel of technical aviation service providers or aviation equipment repair and maintenance companies operating in restricted areas of an airport;
c) Environmental hygiene service providers’ personnel working in restricted areas of an airport
3. Duration: 05 hours.

Article 45. Recurrent training interval
1. The individuals specified in Article 24, 25, 26, 27 and 32 of this Circular shall undergo recurrent training once a year.
2. The individuals specified in Article 28, 29, 30 and 31 of this Circular shall undergo recurrent training once every 02 years.
3. The individuals specified in Article 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43 and 44 of this Circular shall undergo recurrent training once every 03 years.
4. A security screener omitting dangerous articles during his mission or an aviation security employee having not carried out any mission in line with his certificate for at least 06 consecutive months shall be subjected to relevant recurrent training before resuming work.
Chapter III
TEXTBOOK, WRITTEN MATERIAL, CERTIFICATE AND AVIATION SECURITY INSTRUCTOR'S STANDARDS
Part 1. TEXTBOOK AND EDUCATIONAL MATERIALS
Article 46. Requirements for courses, textbooks and written materials
1. The aviation training courses defined in Article 3, 4, 5, 6, 7, 8, 9, 10, 24, 25, 26, 27, 28, 29, 30 and 31 of this Circular shall be subject to the approval of Civil Aviation Administration of Vietnam.
2. The aviation training courses defined in Article 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43 and 44 of this Circular shall be promulgated by Civil Aviation Administration of Vietnam.
3. Textbooks for the aviation security training courses defined in this Circular shall abide by the laws of Vietnam and the International Civil Aviation Organization’s aviation security courses, regulations, standards and recommended practices;
4. Educational materials for the aviation security training courses defined in this Circular shall adhere to the textbooks and actual circumstances.
Article 47. Compilation, verification and publishing of textbooks and written materials
1. Aviation security training institutions shall compile, verify and publish textbooks and written materials for the aviation security training courses according to the laws.
2. Airports companies, airlines and organizations that have no aviation security training center shall compile and present textbooks and written materials to the Civil Aviation Administration of Vietnam for approval upon organizing internally the aviation training courses defined in Article 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43 and 44 of this Circular. The application for approval of textbook and written material includes:
a) The form of application defined in Appendix 1 to this Circular;
b) The textbooks and written materials.
3. Civil Aviation Administration of Vietnam shall assess and approve the documents in writing in 10 working days upon receiving the full application as regulated. If the documents do not suffice or the textbook and written material fail the regulations, the Civil Aviation Administration of Vietnam shall, in 05 working days upon receiving the application, issue an explained request to the applicant for the latter’s supplementation of relevant details.
Part 2. TESTING AND CERTIFICATION
Article 48. Testing and certification of education in aviation security
1. Learners of the aviation security programs defined in Article 3, 4, 5 and 6 of this Circular shall take examination after finishing each subject. Upon finishing the program, learners shall take theory and practical examinations as the program’s evaluation of achievement.
2. The theory examination shall include only or combine multiple-choice questions, essay and interview. The practical examination shall be conducted with existing equipment or simulation software.
3. The theory and practical examinations shall be graded on the 0 to 100 scale. The minimum passing grade for the theory examination and the practical examination shall be 75.
4. The certificat awarded by aviation security training institutions to learners completing the program shall adopt the sample defined in the Circular No. 61/2011/TT-BGTVT dated December 21, 2011 by the Minister of Transport on aviation staff, training institution, professional training and English assessment.
Article 49. Testing and certification of supplemental training in aviation security
1. Learners shall take a theory examination upon finishing a course on supplemental training in aviation security. Learners participating in the courses on supplemental training in aviation security instructorship or supervision as defined in this Circular shall, in addition, take a practical examination.
2. The theory examination shall include only or combine multiple-choice questions, essay and interview. The practical examination shall be conducted with existing equipment.
3. The theory and practical examinations shall be graded on the 0 to 100 scale. The minimum passing grade for the theory examination and the practical examination shall be 75.
4. The certificate in supplemental training in aviation security as awarded by aviation security training institutions to learners completing the course shall adopt the sample defined in Appendix 2 to this Circular.
Article 50. Testing and certification of aviation security awareness
1. Examination for non-recurrent and recurrent aviation security training courses
a) Learners shall take a theory examination upon finishing an aviation security training course defined in Article 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22 and 23 of this Circular;
b) Learners shall take theory and practical examinations upon finishing a recurrent aviation security training course defined in Article 24, 25, 26 and 27 of this Circular;
c) Learners shall take a theory examination upon finishing a recurrent aviation security training course defined in Article 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43 and 44 of this Circular;
d) The theory examination shall include only or combine multiple-choice questions, essay and interview. The practical examination shall be conducted with existing equipment or simulation software. The theory and practical examinations shall be graded on the 0 to 100 scale.
2. Certification of completion of non-recurrent and recurrent training in aviation security
a) The minimum passing grade for the theory examination shall be 75 for a non-recurrent or recurrent aviation security training course defined in Article 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43 and 44 of this Circular. The certificate awarded by aviation security training institutions, airports companies, airlines and relevant organizations to learners completing the course shall resemble the specimen defined in Appendix 3 to this Circular;
b) The minimum passing grade of the theory examination and the practical examination shall be 75 for a recurrent aviation security training course defined in Article 24, 25, 26 and 27 of this Circular. The certificate awarded by aviation security training institutions to learners completing the course shall resemble the specimen defined in Appendix 4 to this Circular;
c) The minimum passing grade for the theory examination shall be 75 for a recurrent aviation security training course defined in Article 28, 29, 30 and 31 of this Circular. The certificate awarded by aviation security training institutions to learners completing the course shall adopt the sample defined in Appendix 4 to this Circular.
Article 51. Aviation security training in foreign countries and by foreign organizations and individuals in Vietnam
1. Civil Aviation Administration of Vietnam accredits the aviation security certificates awarded by training institutions under the International Civil Aviation Organization, International Air Transport Association and foreign aviation security training institutions recognized by the Civil Aviation Administration of Vietnam.
2. Foreign organizations and individuals shall obtain permission of the Civil Aviation Administration of Vietnam before organizing the training in aviation security in Vietnam according to this Circular.
3. The foreign organization or individual shall submit one (01) application by hand, by post or by other methods to the Civil Aviation Administration of Vietnam. The application includes:
a) The form of application for permission as defined in Appendix 5 to this Circular;
b) The curriculum of the program;
c) The list of instructors.
4. Civil Aviation Administration of Vietnam shall assess and approve the documents in writing in 10 working days upon receiving the full application as regulated. If the application is inadequate or the conditions are not met, the Civil Aviation Administration of Vietnam shall, in 05 working days upon receiving the application, issue an explained rejection or request to the applicant for the latter’s supplementation of relevant details.
Part 3. AVIATION SECURITY INSTRUCTOR
Article 52. Standards of an aviation security instructor
1. Aviation security instructors teach academic programs and training courses in aviation security as defined in this Circular.
2. Aviation security trainers teach non-recurrent and recurrent aviation security training course defined in Article 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43 and 44 of this Circular.
3. Standards of an aviation security instructor
a) Fine virtue and attitude;
b) Adhere to the regulated health criteria;
c) Clear personal history;
d) Have not carried any conviction or administrative penalty, have not undergone no ongoing criminal investigation, have not used narcotics or stimulants prohibited according to the laws;
dd) Possess certificate(s) of expertise in aviation security or have worked for 05 years in the sector of aviation security in connection with the subjects being taught;
e) Possess a certificate of supplemental training in teaching.
4. Standards of an aviation security trainer
a) Meet the standards defined in Point a, b, c d and e, Section 3 of this Article;
b) Possess a certificate from the course defined in Point b, Section 4, Article 9 of this Circular and have worked for 05 years in the aviation industry.
Article 53. Verification of the list of aviation security instructors and trainers
1. Civil Aviation Administration of Vietnam shall verify the list of aviation security instructors and trainers.
2. The relevant organization shall submit 01 application for verification by hand, by post or by other appropriate methods to the Civil Aviation Administration of Vietnam. The application includes:
a) The form of application defined in Appendix 6 to this Circular;
b) The police certificates of the individuals nominated;
c) The resumes of the individuals nominated, which bear the seal of the head of the supervisory organization;
d) The copy, certified or uncertified with the original, of the certificate of supplemental training in teaching.
dd) The copies, certified or uncertified with the originals, of the certificates regarding the expertise of the individuals nominated in aviation security;
e) The health certificate issued by a competent medical facility as per regulations.
3. Civil Aviation Administration of Vietnam shall assess and approve the documents in writing in 10 working days upon receiving the full application as regulated. If the application is inadequate or the conditions are not met, the Civil Aviation Administration of Vietnam shall, in 05 working days upon receiving the application, issue an explained rejection or request to the applicant for the latter’s supplementation of relevant details.
Chapter IV
RESPONSIBILITIES OF AGENCIES, ORGANIZATIONS AND INDIVIDUALS FOR AVIATION SECURITY TRAINING
Article 54. Responsibilities of Civil Aviation Administration of Vietnam
1. Guide, inspect and supervise aviation security training institutions, relevant organizations and individuals in regard to their implementation of this Circular.
2. Assess and accredit aviation security training institutions, programs and courses according to the Circular No. 61/2011/TT-BGTVT dated December 21, 2011 by the Minister of Transport on aviation staff, training institution, professional training and English assessment.
3. Verify the list of aviation security instructors and trainers, programs and courses defined in Article 3, 4, 5, 6, 7, 8, 9, 10, 24, 25, 26, 27, 28, 29, 30 and 31 of this Circular. Verify aviation security textbooks and training materials of the airports companies, airlines and organizations that do not have any aviation security training centers.
4. Inspect and evaluate the training institutions’ quality of aviation security training once every 02 years.
5. Act as the contact of international cooperation in aviation security training.
Article 55. Responsibilities of aviation security training institutions
1. Organize aviation security programs and courses according to this Circular.
2. Cooperate with other organizations and individuals in organizing aviation security courses. If cooperating with foreign organizations and individuals in organizing aviation security courses in Vietnam, the aviation security training institutions shall follow the formalities defined in Article 51 of this Circular.
3. List aviation security instructors and trainers and formulate aviation security programs and courses defined in Article 3, 4, 5, 6, 7, 8, 9, 10, 24, 25, 26, 27, 28, 29, 30 and 31 of this Circular, then present such information to the Civil Aviation Administration of Vietnam for approval.
4. Compile and assess textbooks and written materials for the aviation security programs and courses approved and enforced by the Civil Aviation Administration of Vietnam.
5. Evaluate the quality of training and summarize the result of aviation security training activities on annual basis, report thereof to the Civil Aviation Administration of Vietnam by the 15th of December.
6. Retain the aviation security training records of the learners having participated in the courses during their employment. Such records shall be managed according to regulations on restricted aviation security documents.
7. The aviation security training record includes:
a) The learner's resume;
b) The academic transcript;
c) The copy of the course completion certificate.
Article 56. Responsibilities of airports companies, airlines and relevant organizations
1. Companies and relevant organizations shall send the individuals specified in this Circular to aviation security training as per regulations and incur all expenses for such training.
2. Airports companies, airlines and organizations that do not have any aviation security training centers shall organize internally the non-recurrent and recurrent aviation security training courses defined in Article 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43 and 44 of this Circular.
3. Report to the Civil Aviation Administration of Vietnam about the result of aviation security training by the 15th of December each year.
4. Retain aviation security training records according to Section 6 and Section 7, Article 55 of this Circular.
Chapter V
IMPLEMENTATION
Article 57. Effect
This Circular takes effect as of September 20, 2014. It replaces the Circular No. 25/2009/TT-BGTVT dated October 16, 2009 by the Minister of Transport on aviation security training.
Article 58. Implementation
Chief of Office of the Ministry, Chief inspector of the Ministry, Head of the Civil Aviation Administration of Vietnam, heads of organizations and individuals concerned shall be responsible for implementing this Circular./.
