CIRCULAR
LIST OF CERTIFICATES AND DOCUMENTS OF VIETNAM’S SHIPS, PUBLIC SERVICE SHIPS, SUBMARINES, SUBMERSIBLES, FLOATING DOCKS, FLOATING STORAGE UNITS AND MOBILE OFFSHORE DRILLING UNITS
Pursuant to the Vietnam Maritime Code dated November 25, 2015;
Pursuant to the Government’s Decree No. 12/2017/ND-CP dated February 10, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Transport;
At the request of Director General of Department of Legal Affairs, Director General of Vietnam Maritime Administration and Director General of Vietnam Register;
The Minister of Transport hereby promulgate a Circular on the list of certificates and documents of Vietnam’s ships, public service ships, submarines, submersibles, floating docks, floating storage units and mobile offshore drilling units.
Article 1. Scope
This Circular provides for the list of certificates and documents required to be carried on board Vietnam’s ships, public service ships, submarines, submersibles, floating docks, floating storage units and mobile offshore drilling units during their domestic and international voyages.
Article 2. Regulated entities
This Circular applies to Vietnamese and foreign organizations and individuals related to certificates and documents required to be carried on board Vietnam’s ships, public service ships, submarines, submersibles, floating docks, floating storage units and mobile offshore drilling units during their domestic and international voyages.
Article 3. List of certificates and documents
1. The list of certificates and documents of Vietnam’s ships and public service ships is provided in the Annex I hereof.
2. The list of certificates and documents of Vietnam’s submarines and submersibles is provided in the Annex II hereof.
3. The list of certificates and documents of Vietnam’s floating storage units and mobile offshore drilling units is provided in the Annex III hereof.
4. The list of certificates and documents of Vietnam’s floating docks is provided in the Annex IV hereof.
Article 4. Implementation clause
1. This Circular comes into force from March 01, 2020.
2. The Circular No. 41/2016/TT-BGTVT dated December 16, 2016 of the Minister of Transport is annulled.
3. In the cases where any of the legislative documents referred to in this Circular is amended or replaced, the newest one shall apply.
4. Chief of the Ministry Office, Chief Inspector of the Ministry, Directors General, Director General of the Vietnam Maritime Administration, Director General of Vietnam Register, heads of relevant organizations and individuals are responsible for the implementation of this Circular./.

[1] A certificate issued to a ship engaged on an international voyage may be also used if it is not engaged on the international voyage.
[2] Large ship is a ship which must be registered in the national register of ships of Vietnam as prescribed in Article 19 of the Vietnam Maritime Code, including motor ship with a main engine power of 75 kilowatt (kW) or non-motor ship with a gross tonnage of 50GT or more or a dead weight of 100 tonnes or more or a design waterline length of 20 meters or more.
[3] Small ship is not a large ship.
1 A certificate issued to a ship engaged on an international voyage may be also used if it is not engaged on the international voyage.
2 Large ship is a ship which must be registered in the national register of ships of Vietnam as prescribed in Article 19 of the Vietnam Maritime Code, including motor ship with a main engine power of 75 kilowatt (kW) or non-motor ship with a gross tonnage of 50GT or more or a dead weight of 100 tonnes or more or a design waterline length of 20 meters or more.
3 Small ship is not a large ship.
