CIRCULAR

INTRODUCTION OF NATIONAL TECHNICAL REGULATION ON ENVIRONMENT

Pursuant to the Law on Technical regulations and standards dated June 29, 2006;

Pursuant to the Law on Environment protection dated June 23, 2014;

Pursuant to the Government's Decree No. 127/2007/ND-CP dated August 01, 2007 detailing the implementation of a number of articles of the Law on Technical regulations and standards;

Pursuant to the Government’s Decree No.21/2013/ND-CP dated March 04, 2013 defining functions, responsibilities, entitlements and organizational structure of the Ministry of Natural Resources and Environment;

At request of the Director General of the Vietnam Environment Administration, Directors of Departments of Science and Technology and Department of Legal Affairs;

The Minister of Natural Resources and Environment hereby issues this Circular stipulating National Technical Regulation (QCVN) on Environment.

Article 1. This Circular is issued together with QCVN 10-MT: 2015/BTNMT – marine water quality.

Article 2. This Circular enters into force from March 01, 2016.

Article 3. General Director of Vietnam Environment Administration, Heads of Affiliates of the Ministry of Natural Resources and Environment, Directors of Departments of Natural Resources and Environment of provinces and centrally-affiliated cities, and relevant entities shall be responsible for the implementation of this Circular./.

NATIONAL TECHNICAL REGULATION ON MARINE WATER QUALITY

Foreword

QCVN 10-MT:2015/BTNMT is compiled by the editorial board for the national technical regulation on marine water quality, proposed by Vietnam Environment Administration, Departments of Science and Technology, and Department of Legal Affairs and issued together with the Circular No.67/2015/TT-BTNMT dated December 21, 2015 by the Minister of Natural Resources and Environment.

 

NATIONAL TECHNICAL REGULATION ON MARINE WATER QUALITY

 

1. GENERAL PROVISIONS

Scope

1.1.1. This Regulation stipulates the concentration limits of constituents of marine water.

1.1.2. This Regulation applies to evaluate and control the marine water quality of territorial waters and other waters zones for water sports, water recreation, aquaculture, marine conservation and other purposes.

1.2. Interpretation

For the purpose of this Regulation, terms herein shall be construed as follows:

1.2.1. Coastal waters include bays, harbors and waters landward within 03 nautical miles (approx. 5.5 km) from the coastline.

1.2.2. Inshore waters are bands of waters extending from the outer edge of the coastal waters to up to 24 nautical miles (approx. 44 km).

1.2.3. Offshore waters are band of waters extending from the outer edge of the inshore waters to up to the outer edge of the continental shelf of Vietnam.

2. TECHNICAL PROVISIONS

3. METHODS OF DETERMINATION OF CONSTITUENT CONCENTRATION

3.1. The following methods for marine water sampling and constituent concentration determination shall be applied:

3.2. The application of other national standards and international standards that provide the similar or more precise methods of determination of such aforesaid parameters is acceptable.

4. IMPLEMENTATION ORGANZIATIONS

4.1. This Regulation replaces QCVN 10:2008/BTNMT – National technical regulation on coastal water issued together with the Decision No.16/2008/QD-BTNMT dated December 31, 2008 by the Minister of Natural Resources and Environment.

4.1. QCVN 10:2008/BTNMT – National technical regulation on offshore water issued together with the Decision No.10/2012/TT-BTNMT dated October 12, 2012 by the Minister of Natural Resources and Environment shall be annulled from the effective date of this Regulation.

4.3. Environmental State regulatory authorities shall be responsible for providing directives, conducting inspection and supervision of the implementation of this Regulation.

4.4. In case of amendments or adjustments to analysis methods referred to this Regulation, the new one shall prevail.
