CIRCULAR

PROMULGATING THE LIST OF MEDICAL EQUIPMENT AND SUPPLIES OF WHICH INCURRED COSTS SHALL BE COVERED BY THE HEALTH INSURANCE FUND

Pursuant to Clause 2 Article 21 of the Law on Health Insurance dated November 14, 2008;

Pursuant to the Government's Decree No. 62/2009/ND-CP dated July 27, 2009 on specifying and guiding the implementation of a number of articles of the Law on Health Insurance;

Pursuant to the Government's Decree No. 63/2012/ND-CP dated August 31, 2012 defining the functions, tasks, powers and organizational structure of the Ministry of Health;

Pursuant to Clause 3 Article 7 of the Joint Circular No. 09/2009/TTLT-BYT-BTC of the alliance between the Ministry of Health and the Ministry of Finance on providing guidance on health insurance;

The Minister of Health hereby promulgates the List of medical equipment and supplies of which incurred costs shall be covered by the health insurance fund,

Article 1. List of medical equipment and supplies

1. Issued together with this Circular is the List of medical equipment and supplies of which incurred costs shall be covered by the health insurance fund, including common and man-made consumable items, dedicated devices or appliances (hereinafter referred to as medical equipment) used for diagnosis, treatment and life support in order to meet statutory requirements for professional practice and rigorous standards in health care services.

2. The List of medical equipment issued together with this Circular shall serve as the basis for the payment of the Health Insurance Fund for costs of medical equipment used in health care services provided to patients who hold health insurance cards at relevant healthcare establishments.

Article 2. Compilation of the List of medical equipment of which incurred costs shall be covered by the health insurance fund for each healthcare establishment

1. Legal grounds for the compilation of the list of medical equipment of which incurred costs shall be covered by the Health Insurance Fund for each healthcare establishment shall include the followings:

a) List of medical equipment stipulated in Clause 1 Article 1 hereof;

b) The network within which a healthcare establishment offers its medical treatment and the scope of practice where a healthcare establishment operates shall be approved by the competent authority in accordance with the Ministry of Health’s regulations on determination of healthcare networks in terms of their technical capability.

2. Compilation of the list of medical equipment used at healthcare establishments must stick to the principle that it shall meet the statutory standards of healthcare expertise and quality, and must pay attention to offering the reasonable cost and price.

3. Given specific items that have been purchased, healthcare establishments are required to compile the list of medical equipment items used at these ones (according to the Appendix hereof) and submit it to the Social Security Office which serves as the basis for payments.

4. Within a period of 15 working days as from the receipt of the list of medical equipment from healthcare establishments, the Social Security Office shall be responsible for conducting examination and giving a response in writing; in case of refusal, clear reasons must be clearly stated.

5. Where any change or supplement to the List of medical equipment items after obtaining the approval from the Social Security Office occurs, healthcare establishments in connection with the Social Security Office shall take responsibility for mutually agreeing about the supplemented List as stipulated by Clause 3 and 4 of this Article.

Article 3. Application principles and payment methods

1. General principles:

a) Costs of medical equipment shall be covered by the health insurance fund according to the actual quantity of medical equipment items used for healthcare services provided for patients, and the quantity of medical equipment items used for healthcare services provided for patients shall be calculated by accounting for the unit price of each item as specified in the List of medical equipment enclosed herewith;

b) Price at which the Social Security Office shall be applied to pay for costs incurred by the use of medical equipment for insured patients:

- State-run healthcare establishments: the price shall be calculated according to the buying price determined by each of them in accordance with the law on medical equipment procurement;

- Private healthcare establishments: the price shall be calculated by the buying price determined by each of them but shall not be allowed to be higher than the lowest buying price determined by a state-run healthcare establishment located in the same centrally-affiliated city and province (hereinafter referred to as province) in accordance with the law on medical equipment procurement. In case state-run healthcare establishments located in a province do not use a medical equipment item specified in the list, the Social Security Office shall apply the lowest price at which the Health Insurance fund pays for a state-run healthcare establishment in order to make payment on such medical equipment;

c) Costs incurred by the use of medical equipment items that have been already structured and recorded in the accounting report on the healthcare service charge, day-based price per a treatment bed or lump-sum price for each visit in accordance with legal regulations on healthcare service price shall not be separately paid by the Health Insurance Fund;

d) With regard to costs incurred from medical equipment items that have not been structured and recorded in the accounting report on the healthcare service charge, day-based price per a treatment bed or lump-sum price for each visit, the Health Insurance Fund shall make separate payment on each of them in conformity with the principle laid down at Point a Clause 1 of this Article; the amount of payments for medical equipment costs per each enrolled patient shall be restricted to the amount of benefits stipulated in the Law on Health Insurance and guiding documents on the rights vested in and amounts of benefits paid to each group of policy-holders;

dd) Where medical equipment items of various types owned by a medical department are kept under the control of other medical departments, costs incurred therefrom shall be covered by the Health Insurance Fund;

e) The Health Insurance Fund shall not cover the costs incurred by the use of medical equipment specified in the list of medical equipment in the following cases: such costs have been funded by other financial sources; these items have been used for providing technology-based healthcare services that have not been agreed upon in the contractual rights of the insured to make a claim on health insurance policies as stipulated in the Law on Health Insurance and guiding documents on implementation of the Law on Health Insurance.

2. Several specific cases in which the List shall be applicable and costs incurred from medical equipment mentioned therein shall be covered by the health insurance fund as follows:

a) With regard to medical equipment items that are difficult to be quantitatively measured when being used, and of which the regulated limit on use has not been defined yet: Healthcare establishments shall manage to establish and agree with the Social Security Office about the limit on use of technology-based healthcare services with these items, which must adhere to the principle that the number of these items is sufficient to provide such services, appropriate for storage, retention as well as convenient for payment;

b) With regard to medical equipment items of which measurement unit is "set" and of which attached components or parts are required, costs incurred from all of these attached items shall be covered by the health insurance fund. If prices of such attached parts or components are separately calculated, the payment of costs incurred shall be based on the price per each; if the price is calculated according to a full “set”, calculation of the separate price of each attached part or component for further payment shall not be needed.

In case parts of the above-mentioned "set" are used, payment for the cost of parts used by insured patients shall be made according to each of their specified prices. If used parts do not have prices of each used part, depending on the shopping price and specification of each part, healthcare establishments shall consult and agree with the Social Security Office to determine the amount of payment on such parts;

c) Payment for costs incurred by using medical equipment items for hi-tech and costly healthcare services specified in the List of hi-tech and costly healthcare services stipulated by the Ministry of Health:

- In case costs incurred by using medical equipment items have been included in the price of technology-based healthcare services, payment made by the health insurance fund shall be based on the price of each item according to the principle stipulated at Point c Clause 1 of this Article;

- In case costs incurred by using medical equipment items have not been included in the price of technology-based healthcare services, payment made by the health insurance fund shall be based on the price of each item according to the principle stipulated at Point d Clause 1 of this Article, but shall not be allowed to exceed the regulated amount of benefits paid to insured patients who are provided with hi-tech and costly healthcare services;

d) In respect of different multi-use medical equipment:

- In respect of reusable medical equipment which operates according to the Ministry of Health’s instructions on the process for reusing medical equipment and how many times a medical equipment item is reused, the payment made by the health insurance fund shall conform to instructions provided by the Ministry of Health;

- In respect of reusable medical equipment which operates without instructions provided by the Ministry of Health or manufacturers on the process for reusing medical equipment and how many times a medical equipment item is reused, the hospital Director shall, after conferring with the Social Security Office to come to a mutual agreement, decide on how many times a medical equipment item is reused with reference to the professional demand, actual use, request of the Medicine and Therapy Council. Payment on reusable medical equipment used in different times shall be the same and determined by adding the value of medical equipment to disinfection costs accrued from each time of use, which shall be then divided by total times of use;

dd) With regard to medical equipment items that have different types, prices and wide price range such as artificial joints, joint structures, intervertebral discs, vertebrae, bones, pacemakers with or without implantable cardioverter defibrillator, and artificial intraocular lens:

The hospital Director shall, after considering the request of the Medicine and Therapy Council and conferring with the Social Security Office to come to a mutual agreement, decide on appropriate medical equipment that can meet demands for professional healthcare practice as well as payment capability of the Health Insurance Fund;

e) With regard to man-made toric intraocular lens, these shall only be used in crystalline lens replacement and astigmatic surgeries.

Article 4. Implementation

1. Healthcare establishments shall be responsible for:

a) Compiling and conferring with the Social Security Office to enter into a mutual agreement on the List of medical equipment for use at healthcare establishments. In case such agreement is failed, the superior management agency must be directly notified for the purpose of finding solutions;

b) Providing medical equipment items specified in the approved List in the adequate and timely manner, which is required to meet the insured patients' demands, and avoid the situation in which insured patients have to pay costs incurred by using these items at their own expense;

c) When determining the price of healthcare services, these establishments are required to make a detailed list of medical equipment necessary for technology-based healthcare services and clearly specify any medical equipment items that have not been included in the price of technology-based healthcare services in order to have the cost incurred therefrom paid on the separate basis in accordance with regulations laid down in this Circular;

d) Monitoring the compliance with instructions on proper and cost-efficient use of medical equipment; making timely payment on the basis of right type, quantity and price;

dd) Compiling the accurate statistical report on medical equipment items used for insured patient's treatment, which shall serve as an evidence for calculation of payments for health insurance benefits according to the forms promulgated by the Ministry of Health.

2. The Service of Health located in centrally-affiliated cities and provinces shall be responsible for:

a) Carrying out control, direction, examination and inspection of implementation of regulations enshrined in this Circular and other legislative documents relating to the compilation of the List of medical equipment, procurement and supply of medical equipment, payment for costs incurred by using medical equipment items at healthcare establishments within the area of their accountability;

b) Promulgating the List of medical equipment used for insured patients’ treatment at the healthcare center of a commune, ward or town within their delegated authority.

3. The Social Security Office shall be responsible for:

a) Examining and sending written response concerning the List of medical equipment incurring costs covered by the Health Insurance Fund in a sufficient and timely manner at healthcare establishments;

b) Making payment in accordance with regulations on this Circular and other relevant legislative documents;

c) Cooperating with relevant entities in handling any difficulty that may arise in the course of implementation.

4. The purchase of medical equipment shall conform to regulations laid down in the Ministry of Finance’s Circular No. 68/2012/TT-BTC dated April 26, 2012 on providing provisions on bidding for assets with the intention of maintaining regular operations of regulatory agencies, political organizations, socio-political organizations, socio-professional political organizations, social organizations, socio-professional organizations and people’s armed forces.

Article 5. Transitional provisions and reference terms

1. Where health insurance cardholders who were hospitalized before the effective date of this Circular but are still in treatment at medical establishments, this List of medical equipment and regulations enshrined in this Circular shall prevail.

2. With regard to medical equipment items specified in the List of medical equipment issued together with the Decision No. 6282/2003/QD-BYT dated December 8, 2003 adopted by the Minister of Health on promulgating the List of medical consumables incurring costs covered by the Social Security (Health Insurance) Fund, and the Decision No. 21/2008/QD-BYT dated June 9, 2008 granted by the Minister of Health on promulgating the List of medical consumables or substitutes used for healthcare services at healthcare establishments, the Health Insurance Fund shall continue to make payment until the number of purchased medical equipment is used up with reference to the result of bidding, supply as well as bidding contract with contractors before the effective date of this Circular.

3. In case legal documents used for reference in this Circular are replaced or amended, documents created after being so replaced or amended shall become effective.

Article 6. Effect

1. This Circular shall come into force as from November 15, 2013.

2. The Decision No. 6282/2003/QD-BYT dated December 8, 2003 adopted by the Minister of Health on promulgating the List of medical consumables incurring costs covered by the Social Security (Health Insurance) Fund, and the Decision No. 21/2008/QD-BYT dated June 9, 2008 granted by the Minister of Health on promulgating the List of medical consumables or substitutes used for healthcare services at healthcare establishments shall become defunct as from the effective date of this Circular.

In the course of implementation of this Circular, if there is any difficulty that may arise, agencies, organizations, and individuals concerned are advised to consult with the Ministry of Health (the Health Insurance Department) about any possible solution./.
