CIRCULAR

PROVIDING THE REGIME OF COLLECTION, REMITTANCE, MANAGEMENT AND USE OF CHARGE FOR TESTING AND FEE FOR GRANT OF THE DRIVING LICENSE FOR PEOPLE'S POLICE

Pursuant to the Law on Road Traffic No. 32/2013/TT-BTC, of November 13, 2008;

Pursuant to the Ordinance No. 38/2001/UBTVQH10, of August 28, 2001, on charges and fees;

Pursuant to the Government’s Decree No. 57/2002/ND-CP of June 03, 2002 detailing the implementation of the Ordinance on charges and fees and the Decree No. 24/2006/ND-CP of March 06, 2006 amending and supplementing a number of articles of the Decree No. 57/2002/ND-CP of June 03, 2002;

Pursuant to the Government’s Decree No. 118/2008/ND-CP of November 27, 2008 defining the functions, tasks, powers and organizational structure of the Ministry of Finance;

At the proposal of the Director of the Tax Policy Department,

The Minister of Finance promulgates the Circular providing the regime of collection, remittance, management and use of charges for testing and fee for grant of the road motor driving license for People's Police, as follows:

Article 1. Subjects of application

When officers, soldiers who are in service for Police sector, request for testing on driving road motor at units of People’s Police and are tested, granted for motor driving license by these units, they must pay charge for testing and fee for grant of motor driving license as prescribed in this Circular, except for trainees whose major is traffic police, fire prevention and fighting at People’s Police Schools studied to drive according to the training program of the Ministry of Public Security.

Article 2. Levels of charge, fee

1. Levels of charge for testing on driving motor are provided as follows:

a) For testing on driving motorcycle (ranks of A1, A2, A3, A4):

- Theory testing: VND 40,000 /time;

- Practice testing: VND 50,000 /time;

b) For testing on driving automobile (ranks of B1, B2, C, D, E, F):

- Theory testing: VND 90,000 /time;

- Practice testing in pictures: VND 300,000 /time;

- Practice testing on public traffic roads: VND 60,000 /time;

c) The participants of testing for grant of permit of driving road motor vehicles in a part shall pay charge of testing of that part (calculated under times of testing: First testing, testing to upgrade rank, retesting).

2. The level of fee for grant of the driving license is VND 30,000 /time (for new issuance, extension, grant for change and re-issuance of driving license).

Article 3. Management and use of charges, fees

1. Agencies, units managing the testing for grant of the driving license are the agencies collecting charges, fees.

2. Charges of testing, fees for grant of the driving license are revenues of the State budget. The agencies collecting charges, fees are entitled to deduct 65% of collected testing charges for expenditures of holding the testing and grant of the driving license and collection of charges, fees in accordance with the regulation (including the rent of the testing center, if any).

Agencies collecting charges, fees shall submit 35% of collected testing charges and 100% of fees for grant of the driving license into the state budget in accordance with chapter, section, sub-item of the current index of state budget.

Article 4. Implementation organization

1. This Circular takes effect on May 05, 2013.

2. Other contents relating to registration, declaration, collection, remittance, management, use, public of regime of collection of charges for testing, fee for grant of the driving license for People’s Police not provided in this Circular comply with guides in the Circular No. 63/2002/TT-BTC of July 24, 2002 of the Ministry of Finance guiding the implementation of the law provisions on charges and fees, the Circular No. 45/2006/TT-BTC of May 25, 2006, amending and supplementing the Circular No. 63/2002/TT-BTC of July 24, 2002, the Circular No. 28/2011/TT-BTC of February 28, 2011, of the Ministry of Finance, guiding implementation of a number of articles of the Law on Tax Administration and the Government’s Decree No. 85/2007/ND-CP of May 25, 2007 and the Government’s Decree No. 85/2007/ND-CP of May 25, 2007, the Circular No. 153/2012/TT-BTC of September 17, 2012 of the Ministry of Finance, guiding the printing, issuance, management and use of documents for the collection of charges and fees belonging to the state budget and documents of amendments, supplementations (if any).

3. In the course of implementation, any arising problems should be reported timely to the Ministry of Finance for research and additional guidance.
