CIRCULAR

GUIDING IMPLEMENTATION OF A NUMBER OF ARTICLES OF AGREEMENT AND PROTOCOL TO IMPLEMENT THE AGREEMENT TO FACILITATE THE CROSS-BORDER MOVEMENT OF MOTOR VEHICLES BETWEEN THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIETNAM AND THE GOVERNMENT OF THE LAO PEOPLE'S DEMOCRATIC REPUBLIC

Pursuant to the Agreement to facilitate cross-border movement of motor vehicles between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic signed on April 23, 2009 (hereinafter referred to as " Agreement");

Pursuant to the Protocol to implement the Agreement to facilitate cross-border movement of motor vehicles between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic signed September 15, 2010 (hereinafter referred to as "Protocol");

Pursuant to Decree No. 51/2008/ND-CP dated April 22, 2008 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Transport;

The Minister of Transport guides the implementation of a number of articles of the Agreement and the Protocol as follows:

Chapter 1.

GENERAL PROVISIONS

Article 1. Scope of adjustment

This Circular guides the implementation of a number of articles of Agreement and Protocol to facilitate cross-border movement of motor vehicles (hereafter referred to as “vehicles” ) between Vietnam and Laos

Article 2. Subject of application

This Circular applies to organizations and individuals involved in the operation of commercial and non-commercial vehicles license of trains crossing the border between Vietnam and Laos.

Article 3. Provisions for vehicles

1. Vehicles issued with the Vietnam – Laos cross-border transport Permit are automobiles, forward tractors, trailers or semi-trailers pulled by cars and special-use motorcycles circulating on road with vehicle registration certificate and number plate issued by the competent authorities of the Republic Socialist of Vietnam.

2. Commercial vehicles are the ones which belong to the use right of enterprises and cooperatives involved in transporting goods and passengers with fees or vehicle transporting people or goods for enterprises and cooperatives’ business activities  particularly including:

a) Vehicles of passenger transport business along fixed routes;

b) Vehicles of passenger transport business under contract and tourist transport;

c) Vehicles of goods transport business

d) Vehicles of transport enterprises and cooperatives in service of works and projects or business activities of their units in Laotian territory.

3. Non-commercial vehicles are the ones which belong to agencies, organizations and individuals operating across the border of the two countries not for the purpose of business, specifically including:

a) Vehicles of domestic or international agencies, organizations, enterprises and cooperatives used for business trips, sightseeing and tourism;

b) Means of the individuals used for personal affairs (only applicable for cars of less than 09 (nine) seats and pickup;

c) Fire trucks, ambulances, rescue vehicles and vehicle used in humanitarian missions.

4. For each trip, the vehicles may stay in the other Contracting Party for thirty (30) days from the date of entry. In case of exceeding the time limit with rational reasons, the vehicles will be extended once for a maximum period of 10 (ten) days.

5. Each vehicle while cross-border operation must be attached with national symbol plate on the front windshield on the right-hand corner of the driver. The Vietnamese national symbol plate is stipulated in Annex 1 of this Circular.

Article 4. Regulation on vehicle papers

1. When circulating, vehicles must have the following valid papers with their certified Laotian or English translation if those papers are not in Vietnamese - Laotian or Vietnam - English bilingual for presentation to the agencies concerned as required:

a) Vehicle registration Certificate;

b) Certification book of technical safety inspection and environmental protection

c) Cross-border transport Permit

d) Certificate of insurance for civil liability of motor vehicle owners;

dd) Declaration of road transport vehicle temporarily imported and re-exported

2. For passenger transport vehicles, in addition to the documents specified in Clause 1 of this Article, there must be a passenger list. This list applies to passenger transport vehicle along fixed routes specified in Annex 2a of this Circular. The list applies to passenger transport vehicles under contract and tourists transport specified in Annex 2b of this Circular.

3. For goods transport vehicles, in addition to the provisions of Clause 1 of this Article, they must have following papers:

a) Bill of lading;

b) Customs declaration of goods;

c) Certificate of animal and plant quarantine (under specialized regulation).

4. Transport vehicles of dangerous goods or goods with size and load in excess of regulations of Vietnam and Laos must be issued with special circulation Permit by Vietnamese and Laotian competent authority.

Article 5. Provision for driver

Drivers controlling vehicles across the border must have the following valid documents:

1. Driver’s License;

2. Passport or other valid documents in lieu of Passport and visa issued by the competent authority (except for subjects exempted from visa);

3. In case the driver’s Passport and vehicle registration certificate are not issued by the same Contracting Party, there must be a certified copy of the driver’s labor contract with definite term of 01 (one) year or more with the enterprise or cooperative or temporary residence card or Diplomatic Identification Card

Chapter 2.

INTERNATIONAL ROAD TRANSPORT OPERATION PERMIT

Article 6. Conditions for issuance of international road transport operation permit

1. The subjects that are issued with the international road transport operation permit are enterprises or cooperative having Permit for Transport Business by motor vehicle

(for enterprises or cooperatives carrying on business of passenger and goods transport by containers) or business registration Certificate with registration of business line of transport by motor vehicles (for enterprises or cooperatives carrying on business of other goods transport);

2. Having experience of 03 (three) years or more in domestic transport operation; not being declared bankrupt or in the state of declaration of bankruptcy;

3. Having sufficient number of vehicles to carry out business plan.

Article 7. Dossier and order of issuance of international road transport operation Permit

1. Dossier for issuance of the international road transport operation Permit

a) Application for issuance of international road transport operation Permit under the form in Annex 3 of this Circular;

b) Permit for Transport Business by motor vehicle (for enterprises or cooperatives carrying on business of passenger and goods transport by containers) or business registration Certificate with registration of business line of transport by motor vehicles (for enterprises or cooperatives carrying on business of other goods transport) (certified copy or a copy attached to the original for comparison);

c) Plan for international road transport business

2. Order of issuance of international road transport operation Permit:

a) Enterprises or cooperatives submit 01 (one) set of dossier directly or via post to the licensing authority. The licensing authority checks and receives the dosser. If the dossier needs modification or supplementation, the licensing authority will notify in writing of the contents to be modified or supplemented.

b) Within 03 (three) after fully receiving dossier as prescribed, the licensing authority will issue the international road transport operation Permit.

c) The receipt of dossier and return of result are done at the licensing authority or via post.

3. Fee for issuance of international road transport operation Permit is regulated by the Ministry of Finance.

4. The duration of international road transport operation Permit is 05 (five) years.

5. The form of Permit is specified in Annex 4 of this Circular.

Article 8. Revocation and re-issuance of international road transport operation Permit

1. The licensing agency may revoke the issued Permit if the enterprises or cooperatives do not ensure provisions on conditions for Licensing;

2. When the duration of Permit expires or is damaged or lost, the enterprises or cooperatives will prepare dossier to request the issuance of new Permit as specified in Article 7 of this Circular. The old Permit expired must be returned to the Licensing agency.

Chapter 3.

CROSS-BORDER TRANSPORT PERMIT

Article 9. Cross-border transport Permit

1. The cross-border transport Permit issued to commercial vehicles of enterprises or cooperatives for frequent movement is valid for 01 (one) year but does not exceed the duration specified in the international road transport operation Permit.

As for passenger transport vehicles under contract or tourist transport, the cross-border transport Permit may depend on the duration of the trip but will not exceed thirty (30) days.

2. The cross-border transport Permit issued to non-commercial vehicles has duration of 30 (thirty) days from the issue date.

As for public service vehicles or vehicles of diplomatic missions, consular offices, representative offices of international organizations in Vietnam, the duration may depend on the time of the trip but will not exceed 01 (one) year.

3. The form of cross-border transport Permit (including Book of of cross-border transport Permit

Article 10. Dossier for issuing cross-border transport Permit

1. For commercial vehicles:

a) Application for issuance of Vietnam – Laos cross-border transport Permit is specified in Annex 6a (applicable for vehicles of transport business) and Annex 6b (applicable for the remaining subjects) of this Circular.

b) The international road transport operation Permit (A certified copy or copy attached to the original for comparison);

In case the enterprises or cooperatives work for the works and projects or operate their own business in Laos, they have to present the contract or documents evidencing their unit is carrying out works or projects or operating their business (certified copy);

c) Vehicle registration Certificate (copy)

d) In case the vehicles do not belong to the enterprises or cooperatives, it is necessary to present the enterprises or cooperatives’ evidence of use right over those vehicles (copy).

2. For non-commercialveicles: dossier will comply with provisions at Point a, c, Clause 1 of this Article.

Article 11. Order of issuance of cross-border transport Permit

1. Receipt and processing of dossier:

a) Organizations or individuals will submit a set of dossier to the licensing Agency. This agency receives dossier and check it. In case the dossier needs modification or supplementation, the licensing Agency will notify directly or in writing of the incomplete contents or modification;

b) Within 03 (three) working days, after fully receiving dossier as prescribed, the licensing Agency will issue the Permit;

c) The receipt of dossier and return of result at the licensing Agency or via post.

2. Licensing fee is prescribed by the Ministry of Finance.

Article 12. Cross-border Permit issuing Agency

1. The Ministry of Transport authorizes the Vietnam Road Administration to issue the Permit to the following subjects

a) The vehicles belonging to the agencies of the Party, National Assembly, the Government, the ministerial Offices, ministerial-level agencies, the agencies attached to the ministries with their head offices in Hanoi;

b) The vehicles of agencies and units directly under the Ministry of Transport.

In case of vehicles of passenger transport business along fixed routes, the Vietnam Road Administration will approve in writing of the enterprise’s route operation issue the first cross-border transport Permit to the vehicles. The Service of Transport will base on the written approval to direct the bus station to sign contract so that the vehicles can disembark passengers at the station.

2. The Ministry of Transport will authorize the Service of Transport to issue the Permit to the vehicles of agencies, organizations or individuals of the remaining subjects located in the local area and issue the cross-border transport Permit from the second time for the vehicles of passenger transport along fixed routes.

Article 13. Revocation and re-issuance of cross-border transport Permit

1. The licensing Agency may revoke the issued Permit if the vehicles do not comply with the contents specified in the Permit.

2. When the duration of the Permit expires or the Permit is damaged or lost, the organizations or individuals should prepare dossier for settlement.

Article 14. Renewal of cross-border transport Permit and the circulating time in Vietnam for Laotian vehicles

1. Subjects to be renewed: The Laotian vehicles whose permit is expired or exceeding the circulating time in Vietnam if having plausible reasons (natural disaster, accident, breakdown without immediately repair) may be renewed 01 (one) with the duration of no more than 10 (ten) days from the expiration date.

2. The dossier includes: Cross-border transport Permit, vehicle registration Certificate; Application for renewal under the form in Annex 9 of this Circular.

3. Receipt and processing dossier:

a) Organizations or individuals will submit 01 (one) set of dossier directly to the Service of Transport;

b) Within 01 (one) working day after fully receiving dossier as prescribed, the Service of Transport will renew the cross-border transport Permit for the vehicles. In case of failure of renewal, it will reply in writing stating the reason right on the date of receipt of dossier.

4. Competence of renewal: The Service of Transport of provinces and centrally-affiliated cities where the vehicles have troubles

Article 15. Registration of operation of international cross-border fixed passenger transport route between Vietnam and Laos

1. Enterprises or cooperatives meet all conditions specified in Article 6 of this Circular are allowed operating the international cross-border fixed passenger transport route between Vietnam and Laos

2. Dossier for operation of route includes:

a) “Registration of operation of the international cross-border fixed passenger transport route between Vietnam and Laos” under the form specified in Annex 7 of this Circular;

b) A copy of vehicle registration Certificate of the vehicles in the list of registration;

c) Plan for operation of the international cross-border fixed passenger transport route between Vietnam and Laos as prescribed in Annex 8 of this Circular.

3. Order of approval for operation of route:

a) Enterprises or cooperatives will submit 01 (one) set of dossier directly or via post to the licensing Agency. This Agency will check and receive the dossier. If the dossier needs modification or supplementation, it will notify directly or in writing of the contents to be modified or supplemented.

b) Within 03 (three) working days after fully receiving dossier as prescribed, the licensing Agency will issue a written approve for the enterprise cooperatives’ operation

c) The receipt of dossier and return of result are done at the licensing Agency or via post

Chapter 4.

IMPLEMENTATION PROVISION

Article 16. Effect

1. This Circular takes effect 45 days from the date of its signing

2. This Circular replaces Circular No. 17/2005/TT-BGTVT dated December 22, 2005 of the Ministry of Transport guiding the implementation of the Protocol between the Ministry of Transport of Vietnam and the Ministry of Transport, Post and Construction of Laos and implement Lao Construction to implement the road transport Agreement between the Government of the Socialist Republic of Vietnam and the Government of Lao People's Democratic Republic

Article 17. Responsibility for implementation

1. The Ministry of Transport authorizes the Vietnam Road Administration to issue the international road transport operation Permit and approve the Plan for operation of the international cross-border fixed passenger transport route between Vietnam and Laos, on the basis of licensing plan approved by the Ministry of Transport.

2. Vietnam Road Administration

a) Organizing and guiding the operation for cross-border movement of motor vehicles between Vietnam and Laos;

b) Assuming the prime responsibility and coordinating with the agencies concerned in checking and handling commercial and non-commercial vehicles of Vietnam and Laos moving across border of the two countries.

c) Organizing annual meeting with the Lao Department of Transport to negotiate solve problems related to road transport between the two countries;

d) Printing and publishing the Vietnamese national symbol plate, cross-border transport Permit and List of passengers.

3. Service of Transport of provinces and centrally-affiliated cities.

a) Disseminating the implementation of this Circular to the organizations or individuals concerned in the area;

b) Making annual report to the Vietnam Road Administration on the organization and management of Vietnam – Laos cross-border movement operation for monitoring, summary and report to the Ministry of Transport.

4. Any difficulty arising during the implementation of this Circular should be promptly reported to the Vietnam Road Administration for settlement. In case of beyond the competence, the Vietnam Road Administration will report to the Ministry of Transport for direction.

5. Chief of Ministerial Office, Chief Inspector of the Ministry, Director of Departments, General Director of the Vietnam Road Administration, Director of the Service of Transport of the provinces and centrally-affiliated cities, agencies, organizations and individuals concerned are liable to execute this Circular.

Strictly observing all provisions of the law of Vietnam as well as the provisions stated in the Protocol to implement the Agreement to facilitate cross-border movement of motor vehicles between Vietnam and Laos.
