CIRCULAR

ON THE NATIONAL TECHNICAL REGULATION ON THE ENVIRONMENT

THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT

Pursuant to the Law on Technical regulations and standards dated June 29th 2006;

Pursuant to the Government's Decree No. 127/2007/NĐ-CP dated August 01st 2007 detailing the implementation of a number of articles of the Law on Technical regulations and standards;

Pursuant to the Government's Decree No. 25/2008/NĐ-CP dated March 04th 2008 on defining the functions, tasks, powers and organizational structure of the Ministry of Natural Resources and Environment ;

At the proposal of the Director of the Vietnam Environment Administration, the Director of the Department of Science and technology, and the Director of the Legal Department,

PRESCRIBES:

Article 1. Promulgates 4 National Technical Regulation on the environment under this Circular:

1. QCVN 26:2010/BTNMT – National Technical Regulation on noise.

2. QCVN 27:2010/BTNMT – National Technical Regulation on vibration.

3. QCVN 28:2010/BTNMT – National Technical Regulation on medical wastewater.

4. QCVN 29:2010/BTNMT – National Technical Regulation on the effluent of petroleum terminal and stations.

Article 2. This Circular takes effect on February 15th 2011.

Article 3. The Director of the Vietnam Environment Administration, Heads of the units affiliated to the Ministry of Natural Resources and Environment, the Directors of the Services of Natural Resources and Environment, and relevant organizations and individuals are shall implement this Circular.

QCVN 26:2010/BTNMT

NATIONAL TECHNICAL REGULATION ON NOISE

Foreword

QCVN 26:2010/BTNMT, written by the Compilation Board of the National Technical Regulation on noise and vibration, submitted by the Vietnam Environment Administration, the Department of Science and technology, and the Legal Department, and promulgated together with the Circular No. 39/2010/TT-BTNMT dated December 16th 2010 of the Minister of Natural Resources and Environment.

 

NATIONAL TECHNICAL REGULATION

ON NOISE

1. GENERAL PROVISIONS

1.1. Scope of regulation

This Regulation prescribes the maximum noise limits in areas where humans live and work.

The noise in this Regulation is the noise created by human, regardless of the sources of noise and their positions.

This Regulations is not applicable to the assessment of noise inside the producing, constructing, trading, and service providing establishments.

1.2. Subjects of application

This Regulation is applicable to the organizations and individuals of whom the activities create noise that affect the areas where humans live and work in the Vietnam’s territory.

1.3. Interpretation of terms

1.3.1. Special areas

Are areas within the boundaries of the medical establishments, libraries, kindergartens, schools, churches, temples, pagodas, and other areas with special provisions.

1.3.2. Usual areas

Including: apartment buildings, detached or terraced houses, hotels, guest houses, administrative agencies.

2. TECHNICAL PROVISIONS

2.1. The noise created by the production, construction, trading, service provision, and life must not exceed the values provided in Table 1.

3. METHODS OF DETERMINATION

3.1. The methods of noise measurement must comply with the following National Standards:

TCVN 7878 Acoustics -- Description, measurement and assessment of environmental noise, comprising 2 parts:

- TCVN 7878 - 1:2008 (ISO 1996 - 1:2003) Part 1: Basic quantities and assessment procedures.

- TCVN 7878 - 2:2010 (ISO 1996 - 2:2003) Part 2: Determination of sound pressure levels.

3.2. In particular situations, the method of noise measurements may be other standards or other methods chosen by the competent agency.

4. IMPLEMENTATION ORGANIZATION

4.1. This Regulation supersedes the TCVN 5949:1998 on Acoustics – Noise in public areas and residential areas – Permissible noise levels, in the List of applicable Vietnam’s Standards of standards, promulgated together with the Decision No. 35/2002/QĐ-BKHCNMT dated June 25th 2002 of the Minister of Science, Technology, and Environment.

4.2. The organizations and individuals relevant to the creation of noise in areas where humans live and work must comply with this Regulation.

4.3. The State management agencies in charge of the environment must guide, inspect, and supervise the implementation of this Regulation.

4.4. When the National Standards of the methods of determination cited in Section 3.1 of this Regulation is amended, supplemented, or superseded, the new standards shall apply.

NATIONAL TECHNICAL REGULATION ON VIBRATION

NATIONAL TECHNICAL REGULATION

ON VIBRATION

1. GENERAL PROVISIONS

1.1. Scope of regulation

This Regulation prescribes the maximum limits on the levels of vibration acceleration in areas where humans live and work.

The vibration in this Regulation is the vibration created by human, regardless of the sources of vibration and their positions.

This Regulations is not applicable to the assessment of vibration acceleration inside the producing, constructing, trading, and service providing establishments.

1.2. Subjects of application

This Regulation is applicable to the organizations and individuals of whom the activities create vibrations and shock that affect the areas where humans live and work in the Vietnam’s territory.

1.3. Interpretation of terms

1.3.1. Special areas

Are areas within the boundaries of the medical establishments, libraries, kindergartens, schools, churches, temples, pagodas, and other areas with special provisions.

1.3.2. Usual areas

Including: apartment buildings, detached or terraced houses, hotels, guest houses, administrative agencies.

1.3.3. Base level

Is the level of vibration acceleration measure without the activities of the producing, constructing, trading, and service providing in the surveyed areas.

2. TECHNICAL PROVISIONS

2.1. The vibrations and shock created during the construction must not exceed the values provided in Table 1.

2.2. The noise created by during the production, trading, and service provision must not exceed the values provided in Table 2.

The levels or vibration acceleration provided in Table 1 and 2 are:

1) The levels measured when the oscillation is stable, or

2) The average level of the local maxima of if the oscillation occurs at regular intervals, or not continuous, or

3) The average value of 10 values measured every 5 seconds or its equivalent (L10) when the oscillation is unstable and random.

3. METHODS OF DETERMINATION

3.1. The method of measuring the vibrations and shock caused by the production, trading, and service provision must comply with the following National standards:

- TCVN 6963 : 2001 Vibrations and shock. The vibrations created by construction and industrial production. methods of measurement

- 3.2. In particular situations, the method of measuring vibration and shock (vibration acceleration) may be other standards or other methods chosen by the competent agency.

3.2. The vibration acceleration in dB and in m/s2 shall be converted using the Table below:

4. IMPLEMENTATION ORGANIZATION

4.1. This Regulation supersedes the TCVN 6962:2001 on Vibrations and shock – Vibrations created by construction and industrial production – Permissible levels for public areas and residential areas, in the List of applicable Vietnam’s Standards of standards, promulgated together with the Decision No. 35/2002/QĐ-BKHCNMT dated June 25th 2002 of the Minister of Science, Technology, and Environment.

4.2. The organizations and individuals relevant to the creation of vibration and shock during the production, trading, and service provisions must comply with this Regulation.

4.3. The State management agencies in charge of the environment must guide, inspect, and supervise the implementation of this Regulation.

QCVN 28:2010/BTNMT

NATIONAL TECHNICAL REGULATION ON HEALTH CARE WASTEWATER

QCVN 28:2010/BTNMT, written by the Compilation Board of the National Technical Regulation on health care waste water submitted by the Vietnam Environment Administration, the Department of Science and technology, and the Legal Department, and promulgated together with the Circular No. 39/2010/TT-BTNMT dated December 16th 2010 of the Minister of Natural Resources and Environment.

 

NATIONAL TECHNICAL REGULATION

ON HEALTH CARE WASTEWATER

1. GENERAL PROVISIONS

1.1. Scope of regulation

This Regulation prescribes the maximum limits on the levels of the factors and pollutants in the wastewater from medical facilities.

1.2. Subjects of application

This Regulation is applicable to the organizations and individuals relevant to the discharge of medical wastewater into the environment.

1.3. Interpretation of terms

The terms in this Regulation are construed as follows:

1.3.1. Medical wastewater is the liquid discharged from medical facilities.

1.3.2. The outlets of sewage include the surface water, the coastal seawater, the drainage system, into which the medical wastewater is discharged.

2. TECHNICAL PROVISIONS

2.1. Medical wastewater must be treated and sterilized before being discharged into the environment.

2.2. The maximum value (Cmax) of the factors and pollutants in the medical wastewater when being discharged from the outlet is calculated as follows:

Cmax = C x K

In particular:

C is the value of the factors and the pollutants as the basis for calculating Cmax, specified in Table 1.

K is the coefficient of the scale and the form of the medical facility, specified in Table 2.

The factors of pH, total coliforms, Salmonella, Shigella and Vibrio cholera in the medical wastewater, use the coefficient K = 1.

- The factor of gross α activity and β activity are only applicable to the medical facilities that use radioactive sources.

In Table 1:

- Column A provides the value of C of the factors and the pollutants as the basis for calculating the limits in medical wastewater when being discharged into the sources of water for living.

- Column B provides the value of C of the factors and the pollutants as the basis for calculating the limits in medical wastewater when being discharged into the sources of water not for living.

- The medical wastewater being discharged into the common sewer of a residential areas shall apply the value of C in column B. The medical wastewater being discharged into the collecting system and taken to concentrated sewage treatment site must be sterilized, other factors and pollutants shall apply the provisions of the operators of the concentrated sewage treatment system.

3. METHODS OF DETERMINATION

3.1. The methods of determining the values of pollution factors in the hospital wastewater must comply with the following national standards:

- TCVN 6492:1999 (ISO 10523:1994) – Water quality – Determination of pH;

- TCVN 6001 - 1:2008 - Water quality. Determination of biochemical oxygen demand after n days (BODn). Part 1: Dilution and seeding method with allylthiourea addition;

- TCVN 6491:1999 (ISO 6060:1989) – Water quality -- Determination of the chemical oxygen demand;

- TCVN 6625:2000 (ISO 11923:1997) - Water quality -- Determination of suspended solids by filtration through glass-fibre filters;

- TCVN 6637:2000 (ISO 10530:1992) - Water quality -- Determination of dissolved sulfide -- Photometric method using methylene blue;

 - TCVN 5988:1995 (ISO 5664:1984) - Water quality -- Determination of ammonium -- Distillation and titration method;

- TCVN 6180:1996 (ISO 7890 - 3 : 1988) - Water quality -- Determination of nitrate --  Spectrometric method using sulfosalicylic acid;

- TCVN 6494:1999 - Water quality - Determination of dissolved fluoride, chloride, nitrite, orthophosphate, bromide, nitrate and sulfate ions, using liquid chromatography of ions.

- The determination of vegetable oil and animal fat shall apply US EPA Method 1664 Extraction and gravimetry (Oil and grease and total petroleum hydrocarbons);

- TCVN 6053:1995 - Water quality. Measurement of gross alpha activity in non-saline water. Thick source method;

- TCVN 6219:1995 - Water quality. Measurement of gross beta activity in non-saline water;

- TCVN 6187-1:2009 (ISO 9308 - 1:2000/Cor 1:2007) - Water quality -- Detection and enumeration of coliform organisms, thermotolerant coliform organisms and presumptive Escherichia coli -- Part 1: Membrane filtration method.

- TCVN 6187 - 2:1996 (ISO 9308 - 2:1990) - Water quality -- Detection and enumeration of coliform organisms, thermotolerant coliform organisms and presumptive Escherichia coli -- Part 2: Multiple tube method;

- TCVN 4829:2001 – Microbiology - General guidance on methods for the detection of Salmonella;

- SMEWW 9260: Detection of Pathogenic Bacteria, Standard methods for the Examination of Water and Wastewater;

3.2. The application of methods of determination with equivalent or higher accuracy is permissible. When there is no National Standards of determining the factors in the Regulation, the international standards shall apply.

4. IMPLEMENTATION ORGANIZATION

4.1. the organizations and individuals relevant to the discharge of medical wastewater into the environment must comply with this Regulation.

4.2. The State management agencies in charge of the environment must guide, inspect, and supervise the implementation of this Regulation.

4.4. When the National Standards cited in this Regulation is amended, supplemented, or superseded, the new documents shall apply.

 

QCVN 29:2010/BTNMT

NATIONAL TECHNICAL REGULATION ON THE EFFLUENT OF PETROLEUM TERMINAL AND STATIONS

QCVN 29:2010/BTNMT, written by the Compilation Board of the National Technical Regulation on water quality, submitted by the Vietnam Environment Administration, the Department of Science and technology, and the Legal Department, and promulgated together with the Circular No. 39/2010/TT-BTNMT dated December 16th 2010 of the Minister of Natural Resources and Environment.

 

NATIONAL TECHNICAL REGULATION

ON THE EFFLUENT OF PETROLEUM TERMINAL AND STATIONS

1. GENERAL PROVISIONS

1.1. Scope of regulation

2.2. The maximum limits of the pollution factors in the effluent being discharged from the petroleum terminals and stations into the outlets.

1.2. Subjects of application

This Regulation is applicable to the organizations and individuals relevant to the discharge of effluent into the environment from the petroleum terminals and stations during their business; the national petroleum reserve, and the petroleum terminals serving National defense and security.

The effluent of petroleum terminals in producing establishments must apply the QCVN 24:2009/BTNMT – National Technical Regulation on industrial effluent.

1.3. Interpretation of terms

The terms in this Regulation are construed as follows:

1.3.1. Petroleum terminal is a complex of buildings, pipelines, and reservoirs for storing, preserving, preparing, and dispensing petroleum.

1.3.2. Petroleum stations are constructions on land that serve the trading of petroleum.. A petroleum station may provide vehicle washing services.

1.3.3. The effluent of petroleum terminals and stations is the effluent discharged from:

- Rinsing reservoirs and the pipeline;

- Discharging water from the reservoirs;

- Vehicle washing water;

- The water for cleaning the oil-contaminated surface;

- The rainwater on the oil-contaminated surface.

1.3.4. The outlets of effluent include the surface water, the coastal seawater, the drainage system, into which the effluent of petroleum terminals and stations is discharged.

2. TECHNICAL PROVISIONS

The maximum limits of the pollution factors in the effluent of petroleum terminals and stations are provided in Table 1 below:

In particular:

- Column A provides the maximum values of the pollution factors in the effluent being discharged into the sources of water for living, the coastal seawater planned for cultivating aquatic products and conserving aquatic organisms.

- Column B provides the maximum values of the pollution factors in the effluent being discharged into other water sources other than that of Column A. When the effluent is discharged in to the drainage network to the concentrated effluent treatment system, the factors of pollution in Table 1 shall apply the provisions of the operators of the concentrated effluent treatment system.

3. METHODS OF DETERMINATION

3.1. The methods of determining the values of polluting factors in the effluent of petroleum terminals and stations must comply with the following national standards:

- TCVN 6492:1999 (ISO 10523:1994) – Water quality – Determination of pH;

- TCVN 6491:1999 (ISO 6060:1989) – Water quality -- Determination of the chemical oxygen demand;

- TCVN 6625:2000 (ISO 11923:1997) - Water quality -- Determination of suspended solids by filtration through glass-fibre filters;

- TCVN 7875:2008 – Water - Determination of oil and grease - Partition-infrared method.

3.2. The application of methods of determination with equivalent or higher accuracy than that of the National Standards provided in Section 3.1. is permissible.

4. IMPLEMENTATION ORGANIZATION

This Regulation supersedes the QCVN 24:2009/BTNMT- National technical regulation on industrial effluent applicable to the effluent of petroleum terminals and stations during their business; the national petroleum reserve, and the petroleum depots serving National defense and security.

4.2. The State management agencies in charge of the environment must guide, inspect, and supervise the implementation of this Regulation.

4.4. When the National Standards cited in this Regulation is amended, supplemented, or superseded, the new documents shall apply.
