CIRCULAR

PROMULGATING REGULATION OF VOCATIONAL TRAINING UNDER FORM OF BOTH LEARNING AND DOING

Pursuant to the Education Law dated June 14, 2005; the Law amending and supplementing some Articles of the Education Law dated November 25, 2009;

Pursuant to the Decree No.178/2007/ND-CP dated December 03, 2007 of the Government regulating functions, duties, powers and organizational structure of ministries, ministerial-level agencies;

Pursuant to the Decree No.32/2008/ND-CP dated March 19, 2008 of the Government regulating functions, duties, powers and organizational structure of Ministry of Education and Training;

Pursuant to the Decree No.75/2006/ND-CP dated August 02, 2006 of the Government detailing and guiding the implementation of some Articles of the Education Law;

Pursuant to the Decree No.31/2011/ND-CP dated May 11, 2011 by the Government on amending and supplementing some Articles of Decree No.75/2006/ND-CP dated 02/08/2006 of the Government detailing and guiding the implementation of some Articles of the Education Law;

At the proposal of the Director of Professional Education,

Minister of Education and Training decides:

Article 1. To issue together with this Circular the Regulation of vocational training in the form of both learning and doing.

Article 2. This Circular takes effect as from January 10, 2012. This Circular replaces Decision No.13/2006/QD-BGD&DT dated April 18, 2006 of the Minister of Education and Training on the issuance of Regulation of of vocational training in the form of both learning and doing.

Article 3. Office Chief, Director of Professional Education, heads of concerned units under the Ministry of Education and Training, directors of Education and Training; heads of the school management agencies, principals of vocational schools, heads of facilities assigned the task of vocational training, concerned organizations and individuals shall implement this Circular./.

REGULATION

OF VOCATIONAL TRAINING IN FORM OF BOTH LEARNING AND DOING
(Issued together with Circular No.46/2011/TT-BGDDT dated October 17, 2011 of Minister of Education and Training)

Chapter I

GENERAL PROVISIONS

Article 1. Scope of governing and application subjects

1. This Regulation provides for vocational training (vocational) in the form of both learning and doing (hereinafter referred to as vocational education of both learning and doing), including: Organizing training; evaluating subjects and reserving the learning outcomes; examination and graduation recognition.

2. This Regulation applies to vocational schools; the education facilities with vocational training in the form of both learning and doing (hereinafter referred to as schools) and other concerned organizations and individuals.

Article 2. The training program

1. Vocational training programs of both learning and doing compiled by the schools on the basis of vocational training program of regular system. Based on sector framework program, the schools determine their own training programs.

2. The schools must determine the output standard under their own vocational training programs of both learning and doing. In standard output, it must confirm that the students gain the knowledge, skills and specific attitudes upon graduation.

Article 3. Training duration

1. Duration for a program of vocational training of both learning and doing is calculated from the opening date of school year until completion of training program of the course. Training duration is determined on the basis of ensuring enough duration for students to complete training programs, as follows:

a) From three to four school years for people who have graduated secondary school;

b) Two school years for people who have graduated from high school or equivalent;

c) Between one and one and a half year for people who have diplomas from high school or equivalent, and have certificates of elementary level graduation of occupational education or more (training duration from a school year or more and the same group of study).

2. The maximum period for completion of vocational training programs of both learning and doing include duration applicable to each training object specified in clause 1 of this Article plus the maximum duration that students are allowed to suspend their study as prescribed in Article 8 and Article 9 of this Regulation.

Article 4. Conditions for training

Schools are allowed to train vocational education of both learning and doing for the sectors when meeting in full the following conditions:

1. Have been decided to open sector of vocational training in regular system by competent agencies.

2. There are sufficient conditions to ensure the quality of vocational training.

a) Making sure to have adequate teachers;

b) Facilities, equipment and teaching aids reach a minimum volume in accordance with provisions on the vocational framework program for training programs;

c) Have compiled completely the vocational training program of both learning and doing;

d) There are plans to train vocational education of both learning and doing.

3. Have been determined vocational training targets by competent agencies.

Chapter II

TRAINING ORGANIZATION

Article 5. Organization to implement training programs

1. The principal is responsible for planning the training for the courses and choosing the form of implementation of programs and teaching plans in accordance with conditions to ensure training quality.

2. At the beginning of the course, the school must notify teachers and students on the regulation of training; content and learning plan of the training program; curriculum content for each semester; list of compulsory subjects and optional subjects, form of subjects exam; rights and obligations of students.

3. The teaching arrangement is required to ensure a maximum number of theory classhours being 6 classhours/session; 9 classhours/day (02 sessions); training hours not more than 8 hours/day.

4. Faculty (or the subject) assigns the teachers to teach the correct trained field and monitors and supervises the implementation of the program.

5. When conducting training programs, teachers must meet the following requirements:

a) Having teaching plans, syllabus, lesson outline to be approved by head of subject team. Teaching on schedule assigned and performing other provisions on classroom management;

b) Not to change arbitrarily the order of execution of subjects in the training program or arbitrarily cut program content;

c) Assessing learning outcomes of students and reporting to the subject team or training office on the self-assessment results of implementation of curriculum for contents: conditions for quality assurance, curriculum content of subject, learning situation, learning attitude of students and proposing, recommending to the school the measures to improve training quality.

Article 6. Adjustment of the training program

1. Based on social needs and characteristics of the learning sectors and subjects of training, principals can adjust the content, program duration, but not exceeding 25% of the duration of the program to ensure outcome standard for vocational training sector. The total number of credits of program (after adjustment) is still ensured equal or greater than the total number of credits in the school’s program registered for training.

2. The adjustment of program is implemented only at the beginning of the course.

Article 7. Management of training program

1. The competent authorities for approval to open training sector are responsible for monitoring, guiding and directing the adjustment of the program; Department of Education and Training shall monitor and inspect the implementation of adjustment of program.

2. Principles are responsible for:

a) Directing and approving the compilation of documents, lesson outline, syllabus of the subjects;

b) Evaluating, learning from experience, modifying and supplementing program to meet the training needs of learners and labor market;

c) Examining and supervising the implementation of plans, training program of teachers and faculties, professional groups to improve the quality of training.

Article 8. Conditions for students to be continued studying, to be temporarily absent from school, be suspended their study, or be forced to stop learning

1. At the end of school year, the school based on the number of students’ studied subjects, GPA of students in that school year, points of all studied subjects from the beginning of the course and training outcomes of students in that school year to review for permitting students to be continued their study, or to be temporarily absent from school or for temporarily suspending students’ study or for forcing students to stop learning.

2. Students are entitled to proceed to the next school year if it satisfies the following conditions:

a) Having grade point average of the school year reached 5.0 or higher;

b) Having volume of the subjects got less than 5 points from the beginning of the course to the time of review not more than 20 credits;

c) Not being subject to temporary absences from school or enforcement of stopping learning.

3. Students can make application to the school for permission of temporary absences from school and reservation of study results in the following cases:

a) Being sick or injured required to be treated for a long-time with written certification by the competent health facilities;

b) Due to personal aspirations, students must study at least one semester at school and grade point average must be reached not less than 5.0 from the beginning of the course to the time of review. Duration of temporary absences from school for personal needs shall be specified by the Principal and must be included in the official school time of student as defined at Clause 1, Article 3 of this Regulation;

c) The cases of temporary absences from school wishing for being back to study are required to send application to the Principal for at least one week before starting the new semester or new school year.

4. Students who are not subject to the provisions of Clause 2 and Clause 3 of this Article shall be entitled to temporarily suspend from learning for the time to improve knowledge and learning outcomes.

a) Students who are not subject to priority in training are entitled to temporarily suspend their studies to improve knowledge not more than three years wihtin full-course for the programs with the training time from three to four school years, not more than two years for the programs with the training time from one to two years;

b) During the temporary suspension from learning, students must enroll for relearning the unsatisfactory subjects if they are compulsory subjects; enroll for relearning or may enroll to swich to the new subjects if they are optional subjects and ensure the prerequisite conditions as specified in the vocational framework program issued by the Ministry of Education and Training. The principal shall consider allocating these students to learn a number of subjects of the next school year if they recommend.

5. Students shall be forced to stop learning if they fall into one of the following cases:

a) Having school year grade point average of less than 4.0;

b) Having all subject grade point average of less than 4.5 calculated from the beginning of the course;

c) The maximum duration that students are allowed to study at school as prescribed in Clause 2, Article 3 of this Regulation has been over;

d) Committing acts of violation of discipline at the level of dismissal.

For the cases that students are forced to stop learning, the school must notify the locality (where students permanently reside) and family no later than 15 days from the date of signing the decision.

6. The principal decides to establish a Council to review for permitting students to be continued their study, or to be temporarily absent from school or for temporarily suspending students’ study or for forcing students to stop learning. Number, participants in the Council shall be defined by the principal.

Article 9. Priority in training

1. The beneficiaries of preferential policies as those defined in the current Regulation of vocational enrollment are entitled to enjoy priority in training.

2. Students subject to priority in training are temporarily suspended from learning not more than four years within full-course for the programs with the training time from three to four school years, not more than two years for the programs with the training time from one to two school years.

3. Within the temporary suspension from learning to relearn the unsatisfactory subjects, students subject to priority in training are still enjoyed the preferential regimes of the State.

4. Students learning in the right sector and being working at the agencies, enterprises, shall considered for reduction of practice by the principal, but must make prctical reports and are not exempted from examination.

Article 10. Conditions and procedures for school transfer

1. Students are transferred their schools if meeting the following conditions:

a) If school applied for in-transfer has discipline that students are studying in school applied for out-transfer;

b) Having completed at least one semester;

c) Having application for school transfer and being agreed by the in-transfer school’s principal and the out-transfer school’s principal.

2. Procedures for school transfer:

a) Students applying for school transfer must make application for school transfer under the provisions of the school;

b) The principal of the school having students applying for in-transfer decides to accept or not accepting and decides on the continuation of students’ learning such as the school year, number of subjects that students applying for in-transfer must supplement, based on the comparision of programs of out-transfer school with in-transfer school;

c) Time limit for review of application for school transfer and respond to students does not exceed 20 working days from the date of receiving valid dossiers of students. In case of refusal, the Principal must clearly state the reasons and inform students.

3. Students who are disciplined under the form of caution or higher in the challenge training period are not transferred their schools.

4. School transferring student is certified and reserved learning results achieved in the former school.

Chapter III

EVALUATION OF SUBJECT AND RESERVATION OF LEARNING RESULTS

Article 11. Organization of examination of ending subject

1. The school holds the examination of ending subject. The organization of the examination of ending subject can be carried out immediately after the subject completion or at the end of each semester and decided by the Principal. Students who did not attend the first exam or have subject point of less than 5 at the first exam will be attended the next examination decided by the Principal.

Students who are absent from school more than 20% of the classhours as designed for each subject are not attend the examination to end the first subject. After these students add to the missing knowledge content of the subject, they shall be attended the examination to end subject at the next exam. Students who do not add to the missing knowledge content of the subject due to absence from school in excess of duration according to provisions without legitimate reason shall get the point 0 as score of the exam to end that subject.

2. Students missing exam with legitimate reason shall be allowed to suspend. The school shall arrange for these students to attend the next examination. Scores are calculated as the first examination. The principal provides the conditions and procedures for suspended students.

3. The principal specifies the exam duration in the time plan for examination in each semester. Duration for making the test of ending subject for each personnal statement shall be from 90 minutes to 120 minutes, for each multiple choice shall be from 45 minutes to 60 minutes. For specific subjects, Duration for making the test of ending subject shall be specified by the Principal.

Article 12. Subject evaluation

1. Depending on each subject, the general evaluation point of subject (referred to as the subject point) is calculated based on regular test point, the periodic test point and exam point of ending subject.

a) The regular test point is the point of testing in the early hours of class time, or during class time, practice test or written test with a under 45-minute duration;

b) The periodic test point is the point of the program ending test, exercise test, practice test or each prime part of the subject with a 45-minute or more duration;

c) Subject ending exam point is the point to end the subject organized by the school at the end of each semester or after ending subject.

2. Grade point average is the plus average of subject test points and point average of the exam points.

GPA of test points is the plus average of the regular, periodical test points by the coefficient of each point, which regular test point shall be the coefficient 1, periodic test point shall be the coefficient 2.

3. The selection of test forms, the number of test times shall be specified by the Principal and must be publicized to students before they learn subject, but it must be ensured that every subject shall have at least one regular test point and one periodic test point for each student.

4. Teachers who directly teach shall set the test questions, hold the tests and score the tests of the subjects.

Article 13. Exam questions, exam forms, scoring of the exam to end the subject

1. Exam question content must be consistent with the basic knowledge content of the subject specified in the program. The process of setting exam questions for ending subject shall be specified by the Principal.

2. Exam forms to end subject can be written examination (multiple choice or personnal statement), question, practice, or a combination of the above forms. The principal shall decide the appropriate forms for each subject and announce publicly to the students at the beginning of the school year.

3. The scoring of exams to end the subjects for the written examinations shall be conducted only after the taking the tests’ detachable heads off. Result of the written examinations must be announced no later than 10 days after the test.

Principal shall prescribe exam scoring process, unify the way to score the tests, preserve, and store the written tests after they are scored. Reservation time of the written tests after they are scored is at least after after the end of the course.

4. The scoring of the oral and practical tests must follow prescribed form of exam scoring slip, which corresponds to each area of ​​assessment, teachers must write their comments, point of each part and the overall point on exam scoring slip. Oral examination score shall be announced after the examination when two teachers as examiners unify the points. The principal provides the content, form of exam scoring slips for the oral exam, practical exam.

5. The subject ending exam scores must be recorded in the transcript under the unified form by school, signed by the two teachers as examiners, and certified by the subject head or dean. Transcript of the subject ending exam scores and grade point average which must be managed and kept at the department and sent to the faculty office, training office no later than a week after the end of scoring the subject exam.

6. Students may apply for checking examination papers for the subject ending exam scores over the exam under form of personal statement; the time limit to apply for checking examination papers is within 15 days from the date of publication of subject ending exam results. The principal takes the responsibility to organize the checking of examination papers and publicize the results of the checking of examination papers to students.

Article 14. Re-examination, examination to get points for owed subjects and reservation of the subject results

1. Students who fail or quit the exam without legitimate reason at the first exam, are attended the re-examination for at least two times.

2. Students who are absent from class beyond the levels specified for a subject (absences of more than 20% prescribed classhours for each subject) must sign up to learn additionally the missing knowledge content of the subject; Students who have not yet completed two thirds of all experiments, practice, homeworks, essays, assignments, if they supplement fully, they will be attended the re-examination.

3. After three times of taking examination, the students’ subject grade point averages are still not reached 5.0 or more, they have to enroll to re-learn for owed subject.

4. Students who have graduated from vocational education or higher level are reserved results (free from education and examination) of the equivalent subjects of content and with the results of subject grade point average achieved from 5.0 points or more.

Principal regulates on the time to organize the re-examination, conditions and procedures for students to enroll in school for paying for owed subjects and reserve the learning outcomes.

Article 15. Calculation of test scores, exam scores, grade point average and learning performance classification

1. Part evaluating points (including the regular test point, periodic test point), subject ending exam point are scored by 10 score and be rounded to the integer part.

2. Subject evaluating points are rounded up to one decimal.

3. GPA of study per semester, of each school year, and the course is the grade point averages of subjects in each semester, each school year and the whole course by coefficient of each subject and be taken to a decimal after being rounded.
Coefficient of subject depends on number of credits of each subject. Each credit unit corresponds to a coefficient.

4. Subject point, learning grade point average for scholarship consideration (if any), student commendations are reviewed only on the first subject ending exam result. Subject point, learning grade point average used to review for permitting students to be continued their study, or to be temporarily absent from school or for temporarily suspending students’ study or for forcing students to stop learning and graduation is calculated according to the highest point in the subject ending exam times.

5. Classification of learning outcomes:

a) Learning GPA is used as a basis for classification of student’s learning, specifically:

- Type of Excellent: from 9.0 to 10.

- Type of good: from 8.0 to 8.9.

- Type of pretty good: from 7.0 to 7.9.

- Type of fair medium: from 6.0 to 6.9.

- Type of medium: from 5.0 to 5.9.

- Type of weak: from 4.0 to 4.9.

- Type of less than weak: less than 4.0;

b) Students who have learning grade point average ranked from type of pretty good or higher shall be lowered one level if they have 20% or more of the subjects with less than 5.0 point at the first examination.

Chapter IV

GRADUATION EXAMINATION AND GRADUATION RECOGNITION

Article 16. Conditions for attending graduation exam

1. Students meeting the following conditions shall be attended the graduation exam:

a) At the time of graduation exam, students are not disciplined at level of suspension of learning, not being prosecuted for criminal liability;

b) Having accumulated sufficient number of subjects prescribed for the training program and having no subject got point of less than 5.

2. Students who are not attended the graduation exam due to not meeting the conditions specified at Point b, Clause 1 of this Article, if any learning grade point average of the last year is not less than 4.0, learning grade point average of the whole course is not less than 4.5 and the learning time of students at the school is ensured under the provisions of Clause 2 of Article 3 of this Regulation, the principal shall consider and decide for students to be re-learned the unsatisfactory subjects and review conditions for them to attend the graduation exam. If a student is eligible for attending the graduation exam, he/she will attend in the next exams. Time and plan for re-examination, the consideration of conditions for students to attend the graduation exam and graduation examinations shall be decided by principals.

3. Before organizing the graduation exam, the principals establish the Councils to review conditions for students to attend the graduation exam. Components, the number of Council members shall be specified by the principals.

Article 17. Exam subjects, form and content of graduation exam

1. Graduation exam subjects include: Politics, Vocational synthesis theory, professional practice.

2. For training system that subject of enrollment is students graduated from secondary school, apart from three graduation exam subjects specified in clause 1 of this Article, students must take exam three additional cultural subjects. The principals shall define the exam subjects, time to organize the exam of cultural subjects and publicize at the beginning of the course.

3. Exam Form: Based on the specific conditions of the school’s training industry, the principal shall define the appropriate graduation exam form.

4. The content of the graduation exam subjects:

a) Content of graduation exam subject of politics is of the program content of politics subject in accordance with provisions of the Ministry of Education and Training;

b) Content of graduation exam subject of Vocational synthesis theory is the knowledge synthesized from a number of compulsory subjects of the basis and expertise knowledge in the training program;

c) Content of graduation exam subject of the professional practice is of specialized, basic professional practice skills synthesized from a number of compulsory subjects of the professional skills in the training program;

d) Content of graduation exam subject of culture subjects is the basic knowledge synthesized from a number of compulsory subjects of the knowledge of culture subjects in the program as prescribed.

Article 18. Graduation Exam Council

1. The composition of a graduation exam council includes:

a) Chairman of the council is the principal or vice principal authorized by Principal;

b) Vice-chairman of the council is vice principal or head of training office;

c) Secretary member is the manager or deputy manager of training office;

d) Other members include the dean, manager of department, the subject team heads and other components decided by the Principal.

2. Duties of the graduation exam Council:

a) To assist the principal to organize, direct the graduation exams under the provisions of this Regulation and of the school plans;

b) To decide on setting up the boards to help the graduation exam Council, including the secretariat, board of exam questions, board of exam watching, the board of examiners. These boards are subject to the direct guidance of chairman of the graduation exam council.

- Secretariat’s head shall be council secretary member;

- The board of exam questions’s head shall be incharged concurrently by the chairman of the Council. Board exam questions includes the sub-boards, each exam subject shall be incharged concurrently by a sub-board. The number of each sub-board shall not be more than 3 people, including one person as head of the sub-board;

- The board of exam watching’s head shall be in charged concurrently by the chairman or vice chairman of the Council;

- Board of examiners’ head shall be in charged concurrently by the chairman or vice chairman of the Council. Board of examiners includes the sub-boards, each sub-board is in charge of marking a graduation exam subject. Number of people in each sub-board depends on the number of written exams of subjects and decided by Chairman of the graduation exam Council. Each sub-board has at least three people, including one person as head of the sub-board;

c) To assign the organization and monitor the examination, to ensure the implementation of internal regulations and handle violations of internal regulations as prescribed at Article 26 of this Regulation;

d) To review and approve graduation exam results and resolve the written complaints (if any); to submit to the principal the list of students recognized for graduation, list of students not recognized for graduation;

e) To perform other duties related to the graduation exam at the request of the principal.

3. Standing graduation exam Council consists of chairman, vice chairman, and secretary member. Standing Council has the following tasks:

a) To prepare records and necessary documents for the meetings of the Council;

b) To resolve the works between two meeting sessions of the council in accordance with regulations, and report the results of works with the council in the next meeting session;

c) To gather and classify graduation exam results and present before the council to review for graduation recognition.

4. The Council must have the meeting schedule during the direction and organization of examination, specify the content of each session, each session must be recorded minute. The recommendations of the council and the minutes of the meetings must be signed by the chairman and secretary to submit to the principal.

5. Organization, duties and powers of boards assisting the graduation exam council shall be defined by the chairman.

Article 19. Graduation exam watching

1. Graduation Exam Council plans and organizes the examination watching plan, prepares thoughfully the conditions for the exam watching, ensuring strict and serious management at all stages of the exam watching process.

2. Disseminate internal rules to each exam watching official and candidates. List fully, publicly necessary information on the graduation exam.

3. Make sure each exam room to have two exam watching officials. Depending on conditions on the exam room, layout the number of appropriate exam room supervisors and ensure the requirements of exam watching tasks.

Article 20. Graduation exam scoring

1. Score of graduation exam is 10 points, small ideas are scored to 0.25 points. If the whole point has the odd point of 0.25, it shall be rounded up to 0.5, and the odd point of 0.75, it shall be rounded to 1.0. If score of graduation exam is marked with score different from 10 score, then after the exam scoring has been done, it must be converted to the 10 score. The Chairman of the graduation exam Council decides and publicly announces before the exam scoring.

2. Chairman of the graduation exam Council defines the exam marking process by the following principles:

a) All the written exams must be taken detachable heads off before scoring;

b) Scoring of the written exams must be made by two teachers complying with the process of marking two independent rounds, then unify results for each written exam;

c) Scoring of the oral exams and practical exams must be ensured to have two teachers to score each exam. After the exam scoring is done, it must unify points of each exam. Where the two examiners fail to unify points of the exam, it must be made minute to report to the heads of the sub-board, of board of exam scoring for deciding on the handling measures.

3. Students may apply for re-checking exam papers of the graduation exam scores for written exam subjects; the time for applying for re-checking exam papers is within 15 days from the date of publication of graduation exam results. The principal has the responsibility to organize the re-checking exam papers and publicize results of re-checking exam papers to students.

In case of having an application for re-checking exam papers, the organization of re-checking exam papers must comply with current Regulation of vocational enrollment issued by the Ministry of Education and Training.

Article 21. Conditions for graduation recognition

1. Students who meet fully the following conditions shall be recognized for graduation:

a) The grade point average of graduation exam subjects (DTBTN) reachs 5.0 or higher (GPA of graduation exam subjects is the plus average of the graduation exam scores);

b) There is only maximum one graduation exam subject reaching point of less than 5.0 but not lower than 4.5;

c) At the time of review for graduation, students are not disciplined by level of suspension from learning, not be prosecuted for criminal liability.

2. At the request of the Council of reviewing recognition for graduation of the school, the principals sign the decisions to recognize for graduation for students who meet the conditions as prescribed.

3. The students who are not eligible for graduation recognition due to not meeting the requirements for graduation exam scores specified in points a, b, Clause 1 of this Article or for special reasons that they do not attend all exam subjects, they will be organized by the school for re-examination of the unsatisfactory subjects within the period from 3 to 6 months from the date of the publication of graduation exam results. Exam content, exam form, exam questions, exam organization, exam scoring, review and recognition for graduation for these students are made as same as the official graduation exam period and shall be defined by the principal. Students who retake the graduation exam for the unsatisfactory subjects in the following exam period having unsatisfactory result shall be retaken the consecutive exams which are decided by the principal.

4. Students who are not eligible for graduation recognition due to the prosecution for criminal liability, or due to being disciplined at level of suspension from learning or higher from the time of review for graduation recognition shall be delayed graduation recognition. Depending on the seriousness of the violation, the delay time for graduation recognition is at least 6 months and is decided by the Principal. During that period, if students are certified by local governments where they reside or agencies, organizations where they work that they have consciousness of good cultivation, practice shall be considered for graduation recognition.

Article 22. Graduation classification

1. The graduation classification is based on point of the whole course. Learning point of the whole course (DHTTK) is the GPA of all subjects of the whole course (DTBCTK) and the GPA of graduation exam subjects (DTBTN), as follows:

In which: DHTTK means learning point of the whole course; DTBCTK means the GPA of all subjects of the whole course; DTBTN means the GPA of graduation exam subjects.

Learning point of the whole course is taken to a decimal after rounded up.

2. The graduation classification is done based on learning point of the whole course, it is specific as follows:

3. Students subject to the graduation exam re-taking are not ranked types of good or excellent.

4. Students whose learning performance of the whole course are type of excellent and good will be reduced one level if they fall into one of the following cases:

a) Having the official learning duration in excess of the stipulated time for training program;

b) Having the volume of the subjects required to re-take the exam exceeding 20% of the total credits prescribed for the whole course;

c) Being disciplined during the learning time at level of warning or higher.

Article 23. Diplomas issuance

1. Students regconized for graduation will be issued diplomas under current regulations on management of diplomas and certificates. Vocational diplomas of both learning and doing shall be issued by training sector. The diploma is granted to student only when it is filled fully and accurately contents on the embryo under the current regulations of the Ministry of Education and Training.

2. Students who have not graduated shall be issued the written certification of learning outcomes for the subjects learned in the school curriculum.

3. The principal is responsible for organizing graduation ceremony to hand over diplomas for students to be recognized for graduation. Graduation ceremony is held no later than 30 days since the date the principal signs the decision to recognize for graduation.

4. The principals are responsible for management, archiving graduation records, sending decisions together with a list of students accredited for graduation to the agencies managing schools. The sending as mentioned aboved must be made no later than 15 doing days from the date of graduation recognizing decision.

Article 24. Mode of report and inspection

1. At least 15 days before the graduation exam, principals must report to the agencies, organizations managing schools on the plans to hold graduation exam.

2. Within 30 days from the date of ending the graduation exam, the principals must report to agencies and organizations managing schools on the situation of organizing training, organizing the graduation exam, decision on recognizing graduation, list of students to be recognized and not recognized for graduation and other special issues related to examination and accreditation of graduation of school.

Article 25. Management and records archiving

Principals are responsible for managing records of vocational training of both learning and doing.

The records stored at the school include enrollment records, training records and graduation records. Records shall be archived under the current provisions of law on archives.

Chapter V

VIOLATIONS HANDLING

Article 26. Discipline for students violating the regulations on examination, testing

1. If students violate the Regulation during regular test, periodic test, subject ending exam, graduation exam (hereinafter referred to as the exam, test), they will be disciplined for each subject violated.

2. Students taking the exam for others or requesting others to take the exam for them will be suspended from learning one year for the first violation and will be forced to stop learning for the second violation.

3. Except for those provided in clause 2 of this Article, the seriousness of violations and disciplinary framework for violating students are as follows:

a) Reprimanding and permitting students to be continued to take the exam but subtracting 25% of the exam points;

b) Warning and permitting students to be continued to take the exam but subtracting 50% of the exam or test points;

c) Suspending the doing of exams, tests and received score 0;

d) Particularly for the graduation exam, in addition to the forms of handling mentioned above, depending on the seriousness of the violation, students can be handled at a level of suspension of exam for the violated exam subjects and the remaining exam subjects. The exam subject to be suspended shall be received score 0./.
