CIRCULAR

ON AMENDMENTS TO CIRCULAR NO. 46/2012/TT-BGTVT DATED NOVEMBER 07, 2012 OF THE MINISTER OF TRANSPORT ON DRIVER TRAINING, DRIVING TESTS, AND ISSUANCE OF DRIVING LICENSES

Pursuant to the Law on Road traffic dated November 13, 2008;

Pursuant to the Law on Vocational training dated November 29, 2006;

Pursuant to the Government's Decree No. 107/2012/NĐ-CP dated December 20, 2012, defining the functions, tasks, entitlements and organizational structure of the Ministry of Transport;

At the request of Director of Organization and Personnel Department and Director of Directorate for Roads of Vietnam,

The Minister of Transport promulgates a Circular on amendments to Circular No. 46/2012/TT-BGTVT dated November 07, 2012 of the Minister of Transport on driver training, driving tests, and issuance of driving licenses.

Article 1. Amendments to some Article of Circular No. 46/2012/TT-BGTVT dated November 07, 2012 of the Minister of Transport on driver training, driving tests, and issuance of driving licenses

1. Article 29 is amended as follows:

“Article 29. Duration of a driving license

1. Class A1, A2 and A3 licenses have no expiration dates.

2. A Class B1 license shall expire when its holder reaches the age of 55 (females) or 60 (males); licenses issued to persons over the age of 45 (females) or 50 (males) shall be effective for 10 years from the dates of issuance.

3. Class A4 and B2 licenses are valid for 10 years from the date of issue.

4. Class C, D, E, FB2, FC, FD, FE licenses are valid for 05 years from the date of issue.”

2. Clause 5 Article 29 is amended as follows:

“5. Any foreigner or Vietnamese citizen residing overseas that wishes to drive in Vietnam shall:

a) Follow procedures for replacing an equivalent driving license of Vietnam if that person already has a national driving license;

b) Be permitted to operate the types of vehicles written on the international driving license without having to replace it with a Vietnam’s driving license if that person already has an international driving license issued by a competent authority of a member state of Convention on Road Traffic 1968;

The contents of the international driving license are specified in Appendix 32 enclosed herewith;

c) In case an international agreement on driving license to which Vietnam is a signatory prescribes otherwise, such international agreement shall apply."

3. Clause 2 and Clause 3 of Article 50 is amended as follows:

“2. Verification

a) The driving license must be immediately verified by phone, email, or fax, then in writing;

b) After a verification result is given, the receiving authority shall update information about the driving license on the national driving license management database. If an issued driving license is found invalid, the issuing authority shall: issue a decision on revocation of the license; cooperate with Directorate for Roads of Vietnam in taking actions and update the violations on the national driving license management database; publish the case on the website of the Service of Transport and driving license management website in order to abolish that license, take actions against the violations in accordance with Clause 9 Article 49 of this Circular.

3. Deadline for verification

a) When receiving full and satisfactory documents, the receiving authority shall request Directorate for Roads of Vietnam or the Service of Transport in writing to verify the issued driving license;

b) As soon as the request is received, Directorate for Roads of Vietnam or the Service of Transport shall verify the driving license and make a response.”

4. Clause 8 of Article 53 is amended as follows:

“8. Deadline for replacing driving licenses

a) Within 05 working days from the day on which full and satisfactory documents are received;

b) When replacing a driving license, the licensing authority shall trim the corner of the old license (except for driving licenses issued by other countries).”

5. Appendix 32 added to Circular No. 46/2012/TT-BGTVT is enclosed with this Circular.

Article 2. Effect

This Circular takes effect from December 01, 2014.

Article 3. Implementation

Chief of the Ministry Office, the Chief Inspector of the Ministry, Directors of Departments affiliated to the Ministry of Transport, Director of Directorate for Roads of Vietnam, Directors of Services of Transport of provinces, heads of agencies, and relevant entities are responsible for implementation of this Circular./.
