CIRCULAR

PROVIDING AMENDMENTS TO ARTICLE 2 OF THE CIRCULAR No. 31/2010/TT-BGTVT DATED OCTOBER 01, 2010 BY THE MINISTER OF TRANSPORT ANNOUCING THE PORT WATERS WITHIN HAI PHONG TERRITORY AND UNDER THE MANAGEMENT OF MARITIME ADMINISTRATION OF HAI PHONG

Pursuant to the Vietnam Maritime Code dated June 14, 2005;

Pursuant to the Decree No. 107/2012/NĐ-CP dated December 20, 2012 by the Government defining the functions, tasks, entitlements and organizational structure of the Ministry of Transport;

Pursuant to the Decree No. 21/2012/NĐ-CP dated March 21, 2012 by the Government on the management of ports and navigable channels;

On the basis of the opinions of the People’s Committee of Hai Phong City in the Official Dispatch No. 7258/UBND-GT dated October 26, 2012;

At the request of the Head of the Legal Department and the Director of Vietnam Maritime Administration;

The Minister of Transport promulgates the Circular providing amendments to Article 2 of the Circular No. 31/2010/TT-BGTVT dated October 01, 2010 by the Minister of Transport annoucing the port waters within Hai Phong territory and under the management of Maritime Administration of Hai Phong,

Article 1. Amendments to Article 2 of the Circular No. 31/2010/TT-BGTVT dated October 01, 2010 by the Minister of Transport annoucing the port waters within Hai Phong territory and under the management of Maritime Administration of Hai Phong

1. Clause 2 Article 2 is amended as follows:

"2. Geographical limitation to the territory is determined as follows:

- From the point HP14 running along the right bank of Lạch Huyện channel, connected by lines with the points HP15, HP16 with the coordinates:

HP15: 20^o50’01”N, 106^o54’17”E;

HP16; 20°50’11”N, 106°52’21”E (the right edge of Cái Tráp channel to Lạch Huyện);

- From the point HP16 running along the right bank of Cái Tráp channel to the point HP17, located at 20°49'10”N, 106°50’17”E (the end of the right bank of Cái Tráp channel, contiguous to Bạch Đằng river);

- From the point HP17 running along the right bank of Bạch Đằng river to the point HP18, located at 20°56'46"N, 106^o46'18"E;

- From the point HP18 running along the right bank of Giá river to the point HP19, located at 20°56'46"N, 106°45'51"E;

- From the point HP19 running along the right bank of Giá river to the point HP20, located at 20°57'08"N, 106°44'33"E;

- From the point HP20 running along the line crossing Giá river, 200 m distance from the central of Minh Đức dam toward the lower section to the point HP21 at the left bank of Giá river, located at 20°56’54”N, 106°44'33" E;

- From the point HP21 running along the left bank of Giá river to the point HP1;

- From the outfall of Đình Vũ canal running along Cấm river to the line crossing the river, 200 m distance from Kiên bridge pier toward the lower section.”

2. Clause 3 is added to 2 Article 2 as follows:

“3. Position of the points HP16, HP17, HP18, HP19, HP20 and HP21 are determined according to the VN - 2000 coordinate system  and are transferred in to other coordinate systems as follows:

Article 2. Effect

1. This Circular comes into effect from February 01, 2014.

2. The limitation of the port waters prescribed in this Circular are determined on the 2^nd edition, 2009 of IA-100-03 nautical chart of Vietnam People’s Navy.

Article 3. Implementation

the Chief of the Ministry Office, the Chief Inspector of the Ministry, Heads of Departments affiliated to the Ministry, Director of Vietnam Maritime Administration, Director of Vietnam Inland Waterway Administration, Director of the Services of Transport of Hai Phong City, Director of Maritime Administration of Quang Ninh, Heads of relevant agencies and organizations and relevant individuals are responsible for implementing this Circular./.
