CIRCULAR

PROMULGATING THE NATIONAL TECHNICAL REGULATION ON ANIMAL FEED

Pursuant to the Law on Technical regulations and standards dated June 29, 2006;

Pursuant to the Ordinance on Livestock breed dated March 24, 2004;

Pursuant to the Government's Decree No. 08/2010/NĐ-CP dated February 05, 2010 on the management of animal feed;

Pursuant to the Government's Decree No. 01/2008/NĐ-CP dated January 03, 2008, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural development ; the Government's Decree No. 75/2009/NĐ-CP dated September 10, 2009, amending Article 3 of the Government's Decree No. 01/2008/NĐ-CP dated January 03, 2008;

At the proposal of the Director of the Department of Science, Technology, and Environment, and The Director of the Department of Livestock Production, the Minister of Agriculture and Rural development decides:

Article 1. Promulgating together with this Circular 02 National Technical Regulation on Animal feed:

1. National Technical Regulation: Animal feed factories - Conditions for veterinary hygiene and food safety.

2. National Technical Regulation: Animal feeding stuffs - Criteria of safety and maximum level in animal feeding stuffs

Article 2. This Circular takes effect after 06 months as from the date of its signing.

Article 3. The Director of the Department of Livestock Production, Heads of relevant organizations, and individuals concerned are responsible for its implementation.

Organizations and individuals are recommended to send feedbacks on the difficulties arising during the course of implementation to the Ministry of Agriculture and Rural development for amendment and supplementation./.

Foreword:

QCVN 01 – 77: 2011/BNNPTNT is compiled by the Department of Livestock Production, submitted by the Department of Science, Technology, and Environment, and promulgated together with the Circular No. 61/2011/TT-BNNPTNT dated September 12, 2011 of the Ministry of Agriculture and Rural development.

 

NATIONAL TECHNICAL REGULATION

ANIMAL FEED FACTORIES - CONDITIONS FOR VETERINARY HYGIENE AND FOOD SAFETY

1. GENERAL PROVISIONS

1.1. Scope of regulation

This Regulation deals with the conditions for food safety and hygiene of animal feed factories.

1.2. Subjects of application

This Regulation is applicable to animal feed factories (hereinafter referred to as factories)

1.3. Interpretation of terms

In this Regulation, the terms below are construed as follows:

1.3.1. Animal feed factories are enterprises or households that process or produce animal feed.

1.3.2. Animal feed is fresh or processed products that domestic animal eat or drink.

1.3.3. Total mixed ration is a mixtures of multiple food ingredients, being blended according to certain formulas, in order to ensure adequate nourishment for sustaining the life and productivity of domestic animals in each stage of growth or period of production without any additional food, except for water.

1.3.4. Commercial animal feed are feed produced on an industrial scale and circulated on the market.

1.3.5. Animal feed ingredients, or single feed, are feed used for providing one or multiple nutrients in the feed rations.

1.3.6. Supplementary feed is a single ingredient of a mixture of multiple ingredients being added to the feed ration in order to balance the nutrients necessary for the domestic animals.

1.3.7. Premix is a mixture of one or multiples active ingredients and buffering agents.

1.3.8. Buffering agents are edible substances being mixed with active ingredients in the premix without affecting the health of animal.

1.3.9. Feed additives are substances that does not have or have very little nutritional value, that are added in animal feed during the production in order to sustain or improve some properties of animal feed.

1.3.10. Animal feed production and trade is the performance of one or all the tasks of producing, processing, packing, preserving, transporting, and trading animal feed.

1.3.11. Food safety and hygiene of animal feed are necessary conditions and measures for ensuring that animal feed does not harm the health of animals, the people that use their products, and the environment.

2. TECHNICAL PROVISIONS

2.1. Requirements of facilities

2.1.1. Location

a) The factory must be situated in locations that are not flooded, isolated, and do not affect the surrounding environment.

b) Animals are not allowed within the factory premises.

2.1.2. Factory design:

a) Congruent with the one-way process requirement, avoiding cross-contamination.

b) The area of each section must suit the requirements of production, facilitate the technical tasks, and be convenient for the inspection and supervision.

c) The area of processing liquid ingredients must be able to release moisture, smell, easy to clean and sterilize.

e) The thermal processing area must be airy, safe, and able to dissipate heat.

2.1.3. Requirements of the workshop

The materials and structure of the factory must ensure the construction safety, food safety and hygiene, in particular:

a) The walls, the ceiling, the ground, the floor, and the partitions must be made of cleanable materials.

b) The floor must be able to drain water.

c) The ceiling and the objects fixed thereon must be able to reduce dirt accumulation and condensation.

d) The doors and windows must be airy, cleanable, and able to reduce dirt accumulation.

2.1.4. Tools and equipment

The tools and equipment must satisfy the following requirements:

a) Easy to work with, to clean, and to maintain.

b) The machinery must be located to be run in accordance with their use purposes.

c) The measuring instruments must be periodically tested and calibrated.

d) The operation, testing, and maintenance of mechanical equipment, equipment using electricity, thermal energy, and pneumatic tools must be specified in writing in order to ensure labor safety and product quality.

2.1.5. The yard and internal roads

a) The yard and the roads must be wide enough for convenient transport and loading.

b) The slope of the yard and roads must be able to avoid puddles, easy for cleaning and sterilizing.

2.1.6. The warehouses

a) The area of warehouses must suit the requirement of production, be dry, airy, and convenient for the import an export of ingredients and products.

b) The warehouses of ingredients and finished animal feed must be separated and isolated from inflammable, explosive substances, toxic chemicals, and able to prevent the infestation of insects and rodents.

c) The ingredients must be preserved in accordance with the technical requirements in order to avoid mold and moisture, termites, and prevent the infestation of insects and rodents.

d) The preservation of additives, premix, and other supplementary feed must satisfy the requirements of each type.

dd) The finished animal feed must be preserved on shelves above the ground (unless the ground is already moisture-proof).

e) Periodically spray pesticides in the warehouses to prevent the damage from termites, molds and fungi.

2.1.7. The electricity and water supply system

a) There must by a safe electricity supply system as prescribed by current laws.

b) There must be a clean water supply system that satisfy the technical requirements to serve the production.

2.1.8. The sewage treatment system

a) The drainage system must be efficient, easy for improving, cleaning, and not pollute the adjacent areas; the sewage must satisfy the requirements of industrial sewage before being taken to the general system.

b) The solid wastes and hazardous wastes must be collected and treated as prescribed by current regulations.

2.2. Requirements of the production

2.2.1. The ingredients of animal feed must

a) Have clear origins, good quality, not contain pathogens and toxins that exceed the prescribed limits.

b) Not contain the substances banned from the production of animal feed.

2.2.2. The requirements of the production process

a) It is required to devise formulas for blending the ingredients of each kind of products; inspect and control the weighing and feeding system in order to ensure the accurate weight of ingredients before they are blended.

b) The production must comply with the technical process in order to assure the product quality and avoid cross-contamination.

c) The machinery and equipment must be periodically checked and maintained.

d) All stages of the production must be recorded.

2.2.3. Requirements of the products

a) The fundamental standards or the conformity of the finished animal feed must be declared as prescribed by current laws.

b) The quality must be inspected before the products are released. The products of inferior quality must not be put on the market.

c) The animal feed must be labeled. The content and method of packaging and labeling must comply with law. The goods produced under contracts or goods in bulk must have certificates of qualification for being released, enclosed with the information about the products, the date of production, and date of expiry.

2.2.4. The requirements of the quality control system

The factory must devise and use a quality inspection system that suit their conditions; the application of Good Manufacturing Practice, ISO and HACCP standards is recommended.

2.3. The requirements for employees

a) The people directly participating in the production must satisfy the following requirements:

- Having good health as prescribed by the Ministry of Health, being provided with health-checks once a year.

- Being provided with personal protective equipment; training in professional skills, personal hygiene, and industrial hygiene in the production of animal feed.

b) People suffering from infectious diseases must not participate in the production of animal feed.

2.4. Requirements of overall hygiene

a) The factory must appoint a person in charge of the hygiene and safety of animal feed; the people working at the factory must be provided with knowledge about the infection and the threats to the quality, hygiene and safety of animal feed.

b) Plan and periodically clean the producing area, the tools and equipments; periodically clean the entire factory, remove the impurities on the floor, the ceiling, and the equipment. Wastes must not accumulate in the production areas.

c) The detergent and antiseptic must be used properly according to current regulations and guidance of the producers;

d) Take measures for controlling pests

e) Having adequate equipment, chemicals, and instruments for personal hygiene.

3. THE MANAGEMENT

3.1. The certification of conformity and declaration of conformity.

3.1.1. The animal feed factories must apply for the Certificate of conformity to the conditions for food safety and hygiene as prescribed in this Regulation.

3.1.2. The method of assessing and certifying the conformity is guided in the Circular No. 83/2009/TT-BNNPTNT dated December 25, 2009 of the Ministry of Agriculture and Rural development, guiding the certification of conformity and declaration of conformity under the management of the Ministry of Agriculture and Rural development.

3.2. Implementation organization.

3.2.1. The animal feed factories must comply with this Regulation, and subject to the inspection from competent State agencies.

3.2.2. The Ministry of Agriculture and Rural development shall appoint the Department of Livestock production to direct and cooperate with relevant functional agencies in disseminating and guiding the implementation of this Regulation.

3.2.3. In case this Regulation is changed, amended, or superseded, the new documents issued by the Minister of Agriculture and Rural development shall apply./.

ANIMAL FEED – CRITERIA OF HYGIENE AND SAFETY, AND MAXIMUM LEVEL OF SOME INGREDIENTS IN ANIMAL FEED

1. GENERAL REGULATIONS

1.1. Scope of regulation

This Regulation deals with the criteria of hygiene and safety, and maximum level of some ingredients in animal feed (including the animal feed ingredients and total mixed rations). This Regulation is not applicable to supplementary feed, additives, and concentrated feed.

1.2. Subjects of application

This Regulation is applicable to the organizations and individuals engages in the activities relevant to the production, processing, export, import, and trade of animal feed in Vietnam.

2. TECHNICAL REGULATIONS

2.1. The technical regulations on ingredients of animal feed

The criteria of hygiene and safety, and maximum levels, and the corresponding test methods are provided in Table 1.

3. THE MANAGEMENT

3.1. Inspection

The competent State agency must test the criteria prescribed in this regulation when inspecting the quality of animal feed.

The inspection order:

- Check the Note of test result of the domestic factory or the technical agency appointed to inspect, or the competent agency at the departure gate (export location).

- Test all the primary criteria of animal feed ingredients.

- Test at least 50% of the criteria of microorganisms, molds, fungi, and heavy metal.

- Test randomly 1 – 3 criteria of antibiotics and herbs.

3.2. Supervision and handling of violations

3.2.1. The Department of Livestock production, Services of Agriculture and Rural development of central-affiliated cities and provinces shall inspect the implementation of this Regulation according to the appointment of the Ministry of Agriculture and Rural development.

3.2.2. The inspection and handling of violations must comply with current law.

3.3. Implementation organization

3.3.1. The organizations and individuals engages in the activities relevant to the production, processing, export, import, and trade of animal feed in Vietnam must comply with this Regulation.

3.3.2. The Ministry of Agriculture and Rural development shall appoint the Department of Livestock production, Services of Agriculture and Rural development of central-affiliated cities and provinces to disseminate, guide, and inspect the implementation of this Regulation.

3.3.3. In case this Regulation is changed, amended, or superseded, the new documents issued by the Minister of Agriculture and Rural development shall apply./.
