DECISION

APPROVING TARGET PROGRAM FOR VOCATIONAL EDUCATION, EMPLOYMENT AND OCCUPATIONAL SAFETY DURING 2016 - 2020

PRIME MINISTER

Pursuant to the Law on Government organization dated June 19, 2015;

Pursuant to the Law on Public Investment dated June 18, 2014;

Pursuant to the Law on State Budget dated June 25, 2015;

For the purpose of implementing Resolution No.1023/NQ-UBTVQH13 dated August 28, 2015 of the Standing Committee of National Assembly on rules, criteria and limit on allocation of capital for development investment from state budget during 2016 – 2020;

For the purpose of implementing Resolution No.73/NQ-CP dated August 26, 2016 of the Government on approval for investment guidelines of target programs during 2016 -2020;

Pursuant to Decision No.40/2015/QD-TTg dated September 14, 2015 of the Prime Minister on promulgating principles, criteria and limit on allocation of capital for development investment from state budget during 2016 - 2020;

At the request of Minister of Planning and Investment,

HEREBY DECIDES:

Article 1. Granting approval for the target program for vocational education, employment and occupational safety during 2016 – 2020 with the main contents below:

I. Name of the program and supervisory authority thereof:

1. Name of the program: Target program for vocational education, employment and occupational safety during 2016 – 2020 (hereinafter referred to as “the program”).

2. Supervisory authority: Ministry of Labor, War Invalids and Social Affairs

II. Objectives:

1. General objectives: Give assistance in vocational education development, foster labor market development, improve efficiency in labor supply and demand, create jobs, enhance labor export, occupational safety and health in order to meet the demand for country development and integration into the international economy, boost job stability in combination with labor productivity increase, improve working conditions and increase income as well as prevent occupational accidents.

2. Particular objective to be reached by 2020:

a) Assist in investment in facilities and equipments for vocational schools according to Decision No.761/QD-TTg dated May 23, 2014 of the Prime Minister on approving the scheme for development of high-quality vocational schools by 2020 and for around 30 special schools that are eligible to provide education of several key occupations for marine economy development and ethnic minorities studying in boarding schools and the disabled.

b) Make a synchronous investment in around 100 key occupations according to Decisions of Minister of Labor, War Invalids and Social Affairs and ensure eligibility for vocational education at various levels.

c) Give assistance in providing professional training in skills, foreign languages and special occupations for about 8,800 employees and select 6,200 persons of which for overseas working under provisions of labor contracts.

d) Provide advice on employment and apprenticeship policies to ensure that 45% to 50% labors coming to the employment service center could receive job advice and 70% of which will successfully get a job.

dd) Annually reduce 5% of frequency in occupational accidents causing death in certain trades and fields facing high risk in occupational accidents such  as mining, construction, metal production, chemical production and other trades and occupations.

e) Assist in pilot operation of 600 small and medium-scale enterprises which efficiently apply the occupational safety and health management system, gradually satisfy international standards for occupational safety and health (e.g. OHSAS 18001, SA 8000, etc) and create a culture of occupational safety and health.

III. Scope and regulated entities:

1. Scope: This program is run nationwide in order to carry out activities for improving the capacity to ensure vocational education quality and develop labor and job market and applies for trades, enterprises and key trade villages facing high risk of occupational accidents, occupational diseases and occupational environmental pollution. 

2. Regulated entities: Ministries, local authorities and entities assigned to carry out projects and activities included in the program.

IV. Time for running the program: from 2016 to 2020.

V. Funding for the program:

Total funding for the program is VND 14,024 billion (increases when available but not exceeds VND 15,520 billion), including:

1. Central government budget:

a) Development investment capital: VND 484 billion (increases where available but not exceeds VND 1,980 billion);

b) Non-business capital: VND 8,075 billion

2. Local government budget:

a) Development investment capital: VND 1,930 billion;

b) Non-business capital: VND 1,370 billion

3. ODA loans: VND 625 billion

4. Other contributions: VND 1,540 billion

VI. Component projects of the program:

1. Project No.1: "Renovation and improvement of vocational education quality"

a) Objectives:

* General objectives: Assist in extensive and comprehensive renovation of basic factors of vocational education in terms of policies, training according to competence standards and output standards and conditions for assurance of vocational education quality for the purpose of improving education quality to satisfy labor market demands and integrate into developing ASEAN countries and the whole world.

* Particular objectives to be reached by 2020:

- Contribute to the assistance in vocational education at college and intermediate-level provided for around 1,35 million people (in which 5% of total learners finish the training meeting international, ASEAN and national standards) to satisfy the demand for skilled-workers for the purpose of socio-economic development and integration;

-  Assist in investment in facilities and equipments for vocational schools according to Decision No.761/QD-TTg and for around 30 special schools that are eligible to provide education of several key occupations for marine economy development and ethnic minorities studying in boarding schools and the disabled.

- Make a synchronous investment in around 100 key occupations according to Decisions of Minister of Labor, War Invalids and Social Affairs and ensure eligibility for vocational education at various levels.

- Organize dissemination, job orientation and provide advice on vocational education in conjunction with employments meeting the labor market demand in order to separate jobs and give advice on jobs to students with the aim of ensuring that by 2020, there are at least 30% students graduated from lower-secondary schools receiving vocational education.

- Assist in providing professional training in skills, foreign languages and special occupations for about 8,800 labors to select 6,200 persons out of which for overseas working under provisions of labor contracts.

b) Scope and regulated entities:

* Scope: The project is run nationwide.

* Regulated entities: Ministries, local authorities and entities assigned to carry activities included in the project.

c) Duties and main contents:

* Applying information technology in management, vocational education and apprenticeship by 2020

- Modernize information technology infrastructure to ensure that by 2020, there are at least 50% vocational schools having information technology infrastructure and teaching equipment serving the management, vocational training and learning; at least 50% vocational schools applying information technology in training and learning in key occupations meeting the national, ASEAN and international standards and applying online training in vocational education and at least 60% programs and curriculums used for occupation training digitalized and retained by advance technology in conformity with real conditions of such occupation.  To be specific:

+ Establish and upgrade the center for data integration, invest in information technology infrastructure for vocational schools, multimedia classrooms, and specialized classrooms, system of simulation device, virtual reality equipment and software for simulation of virtual reality equipment used for teaching.

+ Establish and invest in systems for teaching and learning activities in vocational education such as online training system, e-library system, database of technical incidents of a number of key occupations in education; system for supporting teaching activities in vocational education and digitalize training programs, textbooks, learning material, e-lessons, simulation lessons and scientific  material concerning vocational education.

+ Establish an information system and database of skill evaluation, and information system and database for education accreditation and vocational education quality assurance.

- Standardize the criteria system and indicators for gathering and using information and data on vocational education, upgrade and create software for management, utilization and analysis of forecasts about database on vocational education and information system for vocational education, establish a portal for integration which provides public services in vocational education and applies information technology in labor recruitment and the working process or further education, and establish an information system to operate the vocational education system.

* Assisting in school facility and equipment investment

Assist in investment in vocational schools’ facilities and equipment in order to improve the education quality with the aim of meeting requirements for renovation and improvement of vocational education quality according to the reality. To be specific:

-  Give assistance in vocational schools’ facilities and equipment investment according to Decision No.761/QD-TTg dated May 23, 2014 of the Prime Minister on approving the scheme for development of high-quality vocational schools by 2020.

- Give assistance in facility investment and repair, and equipment purchase to 5 Universities of Technology and Education; vocational education faculties in colleges and National Institutes for Vocational Education and Training in order to provide education for vocational teachers at the associate's degree and bachelor's degree level, and increase the capacity for researching and applying science technology in vocational education.

-  Give assistance in facility investment and repair, and equipment purchase for 30 specialized vocational schools in order to provide training in several key occupations for marine economy development for ethnic minorities who study in boarding schools and the disabled.  

- Give assistance in facility investment and repair, and equipment purchase for schools selected to provide key occupation education according to the Decision of Minister of Labor, War Invalids and Social Affairs.

- Give assistance in facility investment and repair as well as equipment purchase for high-tech laboratories, high-tech centers and test production establishments in certain vocational schools.

* Standardizing and developing teaching staff and education administrators for vocational education

- In terms of vocational teaching staff

+ Develop 3 training programs and material used for training of vocational teachers based upon their capacity at 3 levels (elementary, intermediate and college) 

+ Provide re-training in standardization of vocational education for around 20,000 teachers.

+ Offer credit-based training courses, write textbooks and conduct class in integration, provide education and evaluation according to job performance, and soft skill training for about 15,000 vocational teachers and lecturers.

+ Provide education and re-training for vocational teachers that meet regional and international standards. To be specific: 

. Transfer 40 training programs and material of overseas teachers.

. Provide overseas training for about 1,000 vocational teachers transferred,

. Provide training in professional English for about 6,000 teachers of key occupations in ASEAN countries and the whole world.

. Provide education for 600 main teachers in Universities for Technology and Education and teachers in overseas education faculties in order to widely run 40 teacher training programs which are transferred by overseas teachers during 2016 - 2020.

+ Provide national standard education and training:

. Develop 100 programs and material used for training skills of teachers and lecturers.

. Provide teaching skill training and carry out test and evaluation to grant certificate of teaching practice to around 15,000 teachers and lecturers.

. Provide training in professional English for about 6,000 teachers for education of key occupations in the country.

. Develop 100 programs on new technology training for teachers and lecturers

. Provide new technology training for about 10,000 teachers and lecturers.

+ Conduct the study on establishment of training programs and training material and offer training courses to increase the capacity of scientific research for 4,000 lecturers in research institutes and vocational education institutions, especially prioritize teachers in high-quality schools.

- In terms of vocational education administrators:

Train and standardize the vocational education management staff in order to create a professional vocational education management staff. To be specific:

+ Provide domestic training courses in management of vocational education for 12,000 vocational education administrators.

+ Provide domestic and overseas short-term training courses to increase foreign language proficiency for around 300 vocational education administrators. 

+ Provide training courses to increase the capacity for scientific research and scientific management for about 3,000 educational administrators, researchers and lecturers in science institutes and vocational education institutions, especially prioritize teachers of schools selected to develop into high-quality schools according to Decision No.761/QD-TTg dated May 23, 2014 of the Prime Minister.

+ Provide education and training for 2,500 education administrators of equipment in vocational schools.  

* Developing pilot training programs and making a list of school equipment, and establishing standards for facilities and technical-economic restrictions in vocational education

- With regard to program development:

+ Transfer 20 overseas textbooks for training in key occupations at international level according to Decision No.630/QD-TTg dated May 29, 2012 of the Prime Minister.

+ Formulate regulations on minimum knowledge volume and required technical competence of learners after graduating from college or intermediate-level vocational schools for 300 popular occupations. 

+ Set out training programs for six general subjects

+ Develop 300 programs for professional English training for national and international occupations.

+ Conduct a research on procedures and methods for development of module-based or credit-based vocational education programs and pilot development of 5 programs for training of national key occupations in 5 popular fields.

- With regard to pilot education given to students who enroll in international key occupation training following transferred programs and will be issued with an overseas degree after graduation, including lease of overseas lecturers and experts for guidelines on pilot education and final examination setting: Provide pilot education for 2,750 students with an associate's degree for 34 international key occupations under 34 programs transferred from overseas countries during 2011 - 2015 and 1,500 students with an associate’s degree learning 20 international key occupations transferred from overseas countries during 2016 - 2020.

- With regard to preparation of the list of school equipment, technical-economic restrictions in education and facility standards:

+ Create and publish 300 lists of school equipment;

+ Create and publish 300 technical-economic restrictions applied to education; 

+ Create and publish 50 standards for school facilities;  

* Developing vocational education accreditation and assurance of vocational education quality

- Establish an exam bank (300 exams) for education accreditor evaluation with the aim of issuing accreditor card and grant such card to 2,000 education accreditor.

- Provide education and training for 1,000 vocational education accreditors.

- Provide training in professional knowledge to ensure quality of 2,600 educational employees and teaching staff in intermediate schools and colleges.

- Assist vocational schools in carrying out school accreditation (200 colleges, primary and intermediate-level schools) and accreditation of training programs for national key occupations, training programs of schools that are selected to become high-quality schools and other training programs for the purpose of state management (500 programs).   Prioritize schools that run pilot autonomy programs, high-quality schools and vocational schools for ethnic minorities and the disabled and schools in the areas with poor development conditions.

- Study, adjust and complete the criteria system applied to high-quality schools and evaluation procedures; carry out pilot evaluation and recognition of 10 schools specified in Decision No.761/QD-TTg dated May 23, 2014 of the Prime Minister and evaluation and recognition of high-quality schools.

- Set up and develop a system for assurance of quality of 80 colleges and intermediate-level schools, especially schools selected to become high-quality schools specified in Decision No.761/QD-TTg dated May 23, 2014 of the Prime Minister, establish and apply information system for management and monitoring devices used for quality evaluation in 60 colleges and intermediate-level schools. 

- Apply pilot establishment and operation of the regime for education quality assurance for 12 national key occupations.

- Conduct a research on establishment of Vietnamese qualifications framework (vocational education component) based upon consideration of regional and international quality assurance framework. 

* Developing a national system for skill evaluation

- Set up, complete and publish national standards for skills applied to 60 occupations, update and provide additional national standards for national skills applied to 90 occupations in order to satisfy actual demand for technical technology, business and integration into ASEAN countries.

- Create new multiple choice question bank and practice exam bank for 50 occupations, update the multiple choice question bank and practice exam bank for 32 occupations.

- Provide education and training in evaluation of national skills for 8,000 people as demanded.

- Carry out pilot assignment and grant of national skill certificate to employees for 50 trades and occupations and pay attention to trades demanding numerous employees and trades with jobs requiring national skill certificate (pilot application to 1,000 people for each trade).

- Conduct a study on a framework for mutual recognition of qualifications and skills between Vietnam and ASEAN countries and the world.

* Assisting in education and improvement of knowledge of employees working overseas under definite term contracts

Give assistance in providing training in skills, foreign languages and special occupations that meet the labor market demand for about 8,800 labors to select 6,200 out of which for overseas employment under labor contracts.

- Beneficiary from the assistance: Employees enrolling in training program for qualification and foreign language proficiency improvement under the service supply contract between the Vietnamese labor export company and its overseas partners and employees participating in programs for exporting Vietnamese nursing care to Japan under the Vietnam-Japan Economic Partnership Agreement, especially prioritize employees of poor households, near-poor households, employees that are ethnic minorities or those that are relatives of people with meritorious services to the revolution and those of households subject to agricultural land appropriation.

- Employees receiving partial assistance in tuition fee for vocation and foreign language training.

+ With regard to employees enrolling in education programs under provisions of the agreement between Vietnam and the receiving country: The Ministry of Labor, War Invalids and Social Affairs shall decide the mode for giving funding to such employees in conformity with provisions of the agreement between Vietnam and the receiving country or receiving country's requirements.

+ With regard to employees participating in programs for training to improve vocational qualification and foreign language proficiency under provisions of the service supply contract: the assistance shall be given under the order contract between the Ministry of Labor, War Invalids and Social Affairs (Department of Overseas Labor) with the provider of labor export service under the contract as per regulations on bidding, order placement and assignment of public service provision funded by state budget. * Increasing the capacity for consultancy, job orientation, dissemination and forecast of demand for vocational education in conjunction with employment meeting the labor market demand and requirements for inspection, supervision and evaluation of project execution

- Conduct a study on establishment of job orientation programs for students in lower and upper-secondary schools which are carried out in vocational education centers.

- Increase the capacity for consultancy, job orientation, dissemination and forecast about demand for vocational education in conjunction with employment meeting labor market demand:

+ Produce and publish material, publications, books, leaflets, reportage and documentary concerning vocational education.   Use mass media to disseminate vocational education.

+ Organize thematic seminars, conferences and talks regarding vocational education.

+ Carry out investigation, survey, supervision, evaluation, analysis and forecast about education demand.

- Provide education and training for 2,000 consultants on job orientation for students;

- Provide education and training for 4,800 teachers, administrators and staff handling students' affairs.

- Increase the capacity for monitoring and evaluating the project:

+ Establish a monitoring and evaluating system, report form system, set up an information collection regime, reporting regime, mode for using information retrieved from the monitoring and evaluating system;

+ Carry out periodic, annual or irregular (where necessary) inspection, supervision and evaluation of the result of the performance of activities included the project;

+ Hold conferences to fulfill tasks, preliminarily and officially review the project.

f) Funding:

Total funding for the project is VND 12,197.2 billion (increase where available but not exceed VND 12,845 billion), including: development investment capital from central government budget: VND 157,2 billion (increase where available but not exceed VND 805 billion), non-business capital from central government budget: VND 7,495 billion, local government budget: VND 2,800 billion (including VND 1,600 billion of investment capital and VND 1,200 billion of non-business capital), ODA loans: VND 625 billion (non-business capital) and other contributions: VND 1,120 billion (non-business capital).

e) Obligatory expenditures and principles for allocation of funding from central government budget:

* Obligatory expenditures of the funding:

- Central government budget:

+ Funding given to ministries and central authorities to carry out activities included in the project.

+ Target assistance given to local authorities for carrying out activities included in the project as assigned by central competent authorities.

- Local government budget expenditure include sufficient funding for increasing the capacity for consultancy, job orientation and dissemination about vocational education and inspection, supervision, and evaluation of local project execution, reciprocal capital given to agencies for carrying out activities included in the project with the funding from central government budget and funding for other relevant local projects and programs integrated into this project to ensure performance of activities within the project.  

- ODA loans shall be used for investment in facilities and training equipment for several key occupation training in schools under projects funded by ODA loans and government’s foreign concessional loans.

- Other legal funding sources shall be used along with the funding for the projects to achieve the project’s objectives.

* Principles for central government budget allocation:

Save funding for key tasks of the project, especially for investment in facility and training equipment in vocational schools in a practical and efficient manner and avoid non-concentrated funding allocation.

Assist in investment in projects approved by competent authorities upon consideration of opinions from the presiding agency of such project to ensure the project is run in consistent with the local and regional socio-economic development planning and policies on autonomy applied to vocational education.   To be specific:

- With regard to investment capital:

+ Allocate funding in accordance with regulations in section VI of Decision No.40/2015/QD-TTg dated September 14, 2015;

- With regard to non-business capital:

+ Prioritize funding for key and urgent tasks and tasks having influence on vocational education development, high-quality schools, university of technology and education, special schools providing education of a number of key occupations that support the marine economy development and ethnic minorities studying in boarding schools, the disabled, schools providing education of key occupations, especially schools in areas with poor conditions for socio-economic development and areas that are incapable for balancing their own budget. 

+ Give financial assistance in reform and repair of several practice facilities in vocational schools which is equal to 30% of non-business capital amount provided for the project as decided by the competent authority but not exceed VND 7 billion/school or facility.

2. Project No.2: “Development of labor and job market”

a) Objectives:

* General objectives: Boost the labor market development, improve efficiency in labor supply -demand, create jobs for disabled persons and ethnic minorities, give assistance in start-up and reduce the rate of unemployment.

* Particular objectives:

- Provide advice on employment and apprenticeship to ensure that 45% to 50% labors coming to the employment service center could get job advice and 70% of which will successfully get a job.

- Give assistance in participation in start-up training to 10,000 youths.

- Give assistance in job seeking to 25,000 young people, 7,500 disabled persons and 7,500 ethnic minorities.

- Give advisory assistance in job search to 10,000 migrant labors.

b) Scope and regulated entities:

* Scope: The project is run nationwide.

* Regulated entities: Ministries, local authorities and entities assigned to carry out activities included in the project.

c) Main contents

* Increasing the capacity of the employment service center system

- Give assistance in facility and equipment investment to 25 employment service centers (including 21 centers affiliated to the Ministry of Labor - War Invalids and Social Affairs and 4 centers of the Ho Chi Minh Communist Youth Union).

- With regard to assistance in construction of 21 employment service centers affiliated to the Ministry of Labor – War Invalids and Social Affairs : Assist in construction, improvement, repair and expansion of the center and purchase of equipment supporting transaction, analysis and dissemination of labor market information in employment service centers in a professional manner, and ensure great task performance; give advice on employment and apprenticeship as well as relevant policies, recommend jobs, recruit and supply labors, collect, process and provide labor market information, provide unemployment insurance, forecast labor market fluctuation and provide education as per law provisions.  

- With regard to assistance given to 4 employment service centers of the Ho Chi Minh Communist Youth Union which are tasks uncompleted in the project during 2011 - 2015 (employment service centers in Can Tho, Quang Binh, Quang Ninh and Hanoi City): Make investment in facilities and equipment to well perform tasks related to job orientation, vocational training and job recommendation for young people and operate the center.

* Developing the labor market information system

- Give assistance in job transaction: Provide assistance for employment service centers affiliated to the Department of Labor – War Invalids and Social Affairs create a job market and job fair, focus on local authorities hosting job market and job fair.  

- Collect, update, manage, analyze and forecast the labor market:

+ Collect, update and manage labor supply – demand: Carry out inspection, survey and establishment of the labor market database, provide information for evaluation of recruitment and use of labors in enterprises for the management purpose and implement employee-employment policies, labor market development policies and unemployment insurance policies.

+ Analyze and forecast the labor market, evaluate the impact of factors on labor market development and provide forecast about the job market to formulate the labor market development policy, provide information to support the forecast for labor demand of the whole country with the aim of formulating the policy and plan for socio-economic development and human resource development as well as job orientation.

- Develop the employment information network and job seeker empty job database of employment service centers and the whole employment service system.

+ Increase the capacity of the center for integration of labor market information. To be specific:

. Upgrade the server, network system, power system, air-conditioning system, monitoring system for the server room, security system, software system and software for database administration;

. Develop a center for labor market information integration, establish a back-up system with full capacity for storing, processing, analyzing and disseminating labor market information, install and upgrade the software and database with copyright for the server room in the center.

+ Upgrade and develop the network for employment service: Upgrade and develop the local area network for employment self-service (ESS) in each employment service center for the purpose of uniform management and operation of such center.  Upgrade and develop the database of empty jobs and job seekers.

+ Upgrade the Vietnamese employment portal in connection with the ESS software to provide information on jobs, recruitment demand and job searching demand nationwide through the Internet with the aim of helping job seekers get access to job information.

+ Establish a network to connect local employment service centers to the central ones for management and operation purpose and provide labor market information for employers and employees.

* Giving assistance to labors moving from rural to urban areas, industrial zones and bordering labors

- Conduct a survey on labor migration in provinces, cities and key economic zone to which the labor moves and areas with large number of migrant labors and survey on labor migration in bordering provinces.

- Assistance given to migrant labors by employment service centers:

+ Provide advice and information on jobs and labors;

+ Provide occupational advice and job recommendation;

+ Provide training in job searching skills and working skills.

* Giving assistance to young people, disabled persons, ethnic minorities and poor women in rural areas

- Provide job orientation for students of upper-secondary schools and young people studying in universities and vocational schools. To be specific:

+ Provide information and advice on job orientation for young people;

+ Conduct job orientation in schools and combine job orientation with vocational education in vocational schools;

+ Prepare material for job orientation given to the students.

- Give assistance in start-up to young people. To be specific:

+ Offer training courses in consultancy and start-up (providing knowledge and provisions of the law on enterprise foundation);

+ Give assistance in education and training in start-up and enterprise management to young people (skills for enterprise management and general knowledge on accounting) 

+ Write textbooks used for training in start-up and enterprise management.

- Provide job searching assistance for young people who already graduated from universities and vocational schools, ethnic minorities and disabled persons. To be specific:

+ Give job orientation and job advice to employees;

+ Provide training in working skills and job searching skills;

+ Offer training courses and field visit to enterprises;

+ Provide employment services

* Increasing the capacity for disseminating, checking, monitoring and evaluating the project

- Improve the capacity of persons in charge of state management in employment and providers of employment services

+ Offer training courses in employment consultancy skills and skills for information collection and analysis as well as forecast on domestic and overseas labor market.

+ Prepare professional material supporting employment service providers such as employment service skill manual and other material

- Raise people’s awareness

+ Disseminate and provide information on labor and employment on mass media and focus on dissemination of employment policies intended for migrant labors, bordering labors as well as special labors such as young people, disabled persons and ethnic minorities.

+ Organize thematic seminars, conferences and dissemination regarding employment and labor market.  

+ Produce and publish material, publications, books, leaflets, reportage and documentary and hold contests to disseminate information on employment and labor market.

- Increase the capacity for managing, monitoring and evaluating the project:

+ Establish a system for checking, monitoring and evaluating the project, report form system, set up an information collection regime, reporting regime, mode for using information retrieved from the monitoring and evaluating system;

+ Carry out periodic, annual or irregular (where necessary) inspection, supervision and evaluation of performance of activities included in the project;

+ Hold conferences to fulfill tasks specified the project, and carry out review as well as evaluation of such project.

d) Funding:

Total funding for the project is VND 1,146.8 billion (increases where available but not exceeds VND 1,995 billion), including: development investment capital from central government budget: VND 326,8 billion (increases where available but not exceeds VND 1,175 billion), non-business capital from central government budget: VND 280 billion, local government budget: VND 450 billion (including VND 330 billion of investment capital and VND 120 billion of non-business capital), external aids, and other contributions: VND 90 billion (non-business capital).

e) Obligatory expenditures and principles for allocation of funding from central government budget for the project:

* Obligatory expenditures of the funding:

- Obligatory expenditures of central government budget include:

+ Expenditure on investment in improvement of employment service centers' capacity

+ Funding given to ministries and agencies carrying out activities included in the project as assigned,

+ Target assistance given to local authorities in order to carry out activities included in the project

- Obligatory expenditures of local government budget include expenditure on dissemination, education  and training to improve the capacity of employees in districts and provinces, expenditure on inspection, supervision and evaluation of local task performance, reciprocal capital for activities included in the project together with local government budget and funding for other relevant local programs and projects run in conjunction with this project for the purpose of fulfilling objectives and activities specified.

- Other contributions include financial assistance from non-refundable funding of international organizations (e.g. ILO, WAPES, etc) and foreign countries (Korea) for particular activities and aids for training activities, conference and meeting with international experts

* Principles for central government budget allocation:

Save funding for key tasks included in the project, especially for investment in facility and training equipment in vocational schools in a practical and efficient manner and avoid non-concentrated funding allocation.

Give assistance in investment in the project approved by competent authorities upon consideration of opinions from the presiding agency such project to ensure such project is run in consistent with the local or regional socio-economic development planning and autonomy policies applied to employment service centers.  To be specific:

- Allocate development investment capital in accordance with regulations in section VI of Decision No.40/2015/QD-TTg. To be specific: give assistance to employment service centers operating according to the approved planning, prioritize local authorities in key economic zone, development centers in areas and local authorities that fail to balance their own budget and the local government authorities shall provide funding for concurrent activities.  Provide higher funding amount to areas creating job market and areas developing the satellite job market

- Allocate funding from non-business capital for main tasks of the project in which areas hosting job market or job fair, first-time hosting areas, areas developing satellite job market, areas with large population of ethnic minorities, bordering areas, islands and areas that are incapable to balance their own budget shall be prioritized.

3. Project No.3: Occupational safety and health enhancement

a) Objectives:

* General objectives: Focus on working condition improvement, prevent occupational accidents and occupational diseases, raise people's awareness and compliance with the law on labor protection, ensure safety of employees and state's properties and enterprises' assets as well as contribute to sustainable development of the country.

* Particular objectives to be reached by 2020:

- Annually reduce 5% of frequency in occupational accidents causing death in certain trades and fields facing high risk of occupational accidents such as mining, construction, metal production and chemical production;

- Provide assistance in pilot operation of 600 small and medium-scale enterprises which efficiently apply the occupational safety and health management system, gradually satisfy international standards for occupational safety and health and create a culture of occupational safety and health.  

- Provide annual assistance in occupational safety and health training for 15,000 employees working in fields with strict requirements for occupational safety and health, 20,000 people holding hard, toxic or dangerous jobs, 10,000 providers of occupational safety and health services, 2,000 medical employees and 1,000 cleaning employees in production facilities and enterprises.

- Give annual assistance in providing occupational safety and health information for 50 trade villages, 200 cooperatives facing high risks of occupational accidents and diseases.

b) Scope and regulated entities:

* Scope: Activities included in the project shall be run in several provinces and centrally-affiliated cities according to their characteristic and size.

* Regulated entities: Ministries, local authorities and entities assigned to carry out tasks included in the project, key enterprises and production facilities, trades/occupations facing high risk of occupational accidents and occupational diseases and working environment pollution.  

c) Main contents:

* Improving the capacity and efficiency in occupational safety and health management

- Carry out pilot operation of the occupational accident reporting system and provide advice on the Law on Occupational Safety and Health for employees not working under labor contracts;

- Carry out sample assignment and work out employee classification methods under labor conditions applied for hard, toxic and dangerous work during integration into the international economy;

- Perfect the national database on occupational safety and health (conduct investigation to make statistical reports on fulfillment of the project's objectives and apply information technology in management of the national database of occupational safety and health);

- Apply appropriate systems for occupational safety and health management in enterprises, production facilities and trade villages facing high risk of occupational accidents and occupational diseases.

* Disseminating and raising the awareness as well as improving skills and compliance with the Law on Occupational Safety and Health

- Improve centers for occupational safety and health affiliated to the Ministry of Labor, War Invalids and Social Affairs;

- Complete the preparation of programs and material for training and dissemination, provide professional training and give assistance in expanding the network of trainers and communicators of occupational safety and health;

- Provide sample training, advice and assistance in occupational safety and health training for people holding jobs with strict requirements for occupational safety and health, people doing hard, toxic and dangerous work, providers of occupational safety and health service, medical employees and cleaning employees working in enterprises and production facilities;

- Complete and apply textbooks of occupational safety and health prepared during 2011 – 2015 in training programs run in universities and vocational schools;

- Conduct dissemination and give advice on occupational safety and health to enterprises, trade villages, cooperatives facing high risk of occupational accidents and occupational diseases.

* Giving advice and assistance in adoption of technical methods for occupational accident and disease prevention

- Conduct pilot application of model for technical measures to ensure safety in medium and small-scale enterprises facing high risk of occupational accidents (mineral extraction and processing, metallurgy, chemicals, construction and other trades)

- Give advice and assistance to enterprises in terms of establishment of a safety culture model in combination with technical methods to improve working conditions in small-scale production areas;

- Give advice and assistance in pilot prevention and control of occupational accidents when using machines and devices requiring strict conformity to occupational safety and health conditions within the installation place (assistance in inspection, advice on machine and device selection, and guidelines and monitoring for use);

- Give assistance in occupational disease detection during occupational disease investigation.

d) Funding:

Total funding for the project is VND 680 billion including VND 300 billion of central government budget (non-business capital), VND 50 billion of local government budget (non-business capital) and VND 330 billion of other contributions (non-business capital).  

e) Obligatory expenditures and principles for allocation of central government budget:

* Obligatory expenditures of the funding:

- Obligatory expenditures of central government budget include:

+ Funding given to ministries to carry out activities within the project

+ Target assistance given to local authorities performing the following activities:

. Conduct pilot operation of the occupational accident reporting system and provide advice on the Law on Occupational Safety and Health for employees not working under labor contracts; establish and complete the occupational safety and health database; apply appropriate occupational safety and health management system in enterprises and production facing high risk of occupational accidents and diseases;

. Provide dissemination and training to raise awareness and improve skills and compliance with the Law on Occupational Safety and Health for employers and employees;

. Give advice and assistance in pilot prevention and control of occupational accidents when using machines and devices requiring strict conformity to occupational safety and health conditions within the installation place and assistance in occupational disease detection during occupational disease investigation.

- Obligatory expenditures of local government budget include expenditure on local dissemination and training in occupational safety and health, expenditure on guideline, inspection, supervision and evaluation of local task performance, reciprocal capital for activities included in the project and funding for other relevant local programs and projects run in conjunction with this project for the purpose of fulfilling objectives and activities specified.

- * Obligatory expenditures of other contributions include:

+ Expenditure on investment in improvement of working conditions, dissemination, training and use of methods for prevention and control of occupational accidents and occupational diseases according to activities included in the project.  Reasonable expenditure of the enterprises on purchase of machinery, equipment and accessories used for installation of working environment improvement system in order to provide assistance for small and tiny-scale enterprises, productive households and individual business households.

+ Non-refundable funding from international organizations such as ILO and WHO and foreign countries such as Denmark, Germany, Japan and Korea for each particular activity included in the project and international cooperation activities such as training, seminar organization and international expert exchange regarding occupational safety and health.

* Principles for central government budget allocation

- Allocate funding to ministries and central government authorities engaged in the project as assigned in conformity with regulations on project launch to ensure such funding is used in an efficient manner.

- Give target assistance to local authorities for performance of tasks included in the project, especially areas facing high risk of occupational accidents and occupational diseases or those failing to balance the state funding and focus on solving problems related to occupational safety and health.

VII. Capital mobilization plans:

Central and local agency in charge of the program or project shall call for legal resources to fulfill objectives and duties specified in the program and project. To be specific: 

1. Ask for funding from central government budget, including investment capital, non-business capital, ODA loans and aids.

2. Ask for reciprocal capital from local government budget: People’s Councils of various levels shall allocate local government budget to fulfill objectives and duties of the program and project.  Local government authorities shall make a commitment and allocated funding for the program and project.

3. Integrate programs and projects with the same objectives and duties to one another for the purpose of concurrent implementation.

4. Diversify contributions from other organizations to run the program and project to ensure timely and sufficient funding for such program and project as regulated.

5. Enhance mobilization of funding from national target programs, other target programs, local government budget and ministerial budget.

6. Formulate policies to attract or encourage enterprises, domestic and foreign sponsors, organizations and individuals to fulfill objectives and duties specified in the program and project.

7. Call for voluntary contributions from learners, beneficiary from the program and project as per law soft. 

8. Call for contributions from community in cash or in kind or in the form of working days and legal funding sources from sponsors, socio – political organizations, associations, enterprises, investors and domestic and foreign individuals.

VIII. Program running methods

1. In terms of human resources and management

a) Manpower for the program and project may be local and central state managers of vocational education, employment, occupational safety and health, vocational schools and employment service centers;

b) Central state management agencies, ministries and local authorities shall establish a department in charge of project management in order to perform activities included in the project on schedule by using the funding approved to ensure efficient and quality of such project.

2. In terms of policies

a) Establish and complete the system of legislative documents on vocational education, employment and occupational safety and health.   Concurrently publish policies on encouragement to develop vocational education, labor market and occupational safety and health.

b) Review, amend and concurrently issue policies on mobilization of resources to fulfill objectives and duties specified in the program and project, especially those run in areas with poor development conditions.

c) Complete the establishment of the regime for state management in vocational education;

d) Impose heavy sanctions for violations relating to occupational safety.

dd) Improve management capacity of state management agencies of various levels regarding vocational education, employment and occupational accidents and health;

e) Increase private sector involvement and call for all social resources to develop vocational education, employment and occupational safety and health.

g) Strengthen cooperation among state management agencies in implementation and authorize local government authorities and entities running the project to enjoy the benefit thereof.

3. Promote leadership of party executive committees of various levels, guidelines from multi-level government authorities and participation of enterprises and social organizations in enforcement of policies and laws on vocational education, employment and occupational safety.

4. Set up a monitoring, checking and evaluating system

Set up a monitoring, checking and evaluating system for the program and project meeting the following criteria:

a) Establish a system for monitoring, checking and evaluating the performance results (input, process and output) and effects of the program and project;

b) Set up indicators for tracking, checking and supervising performance results and indicators for evaluating results and effects of the program and project to ensure information is collected from supervisory authorities and agency in charge of the project;

c) Conduct dissemination of the system for tracking, checking and supervising the performance results (input, process and output) and provide guidelines on evaluation of results and effects for supervisory authorities and agencies in charge of the program and project;

d) Make a consolidated report and notify the result of project's execution to relevant local and central agencies;

dd) Allocate responsibilities for information provision and reporting to agencies running the project included in the program as assigned;

Evaluation of the program and project may be carried out in the middle of the running process, at the end of such process or irregularly (where necessary) according to the use of information collected from monitoring and checking process for analysis of the efficiency, influences and stability of the program and project in an inclusive, systematical and objective manner.  And make necessary adjustment as well as learn from experiences for running such program or project in the next period.

5. In terms of international cooperation:

Strengthen cooperation with international organizations including multilateral and bilateral organizations and non-governmental organizations in technique, experience and finance for development of vocational education, labor market, labor supply and demand as well as science and technology for occupational safety and health assurance.

IX. Implementation

1. Ministry of Labor, War Invalids and Social Affairs:

a)  Take charge of implementation of the program

b) Take charge and cooperate with the Ministry of Planning and Investment and Ministry of Finance in instructing other ministries and local government authorities to implement the program

c) Take charge and cooperate with relevant ministries in adjusting, amending and formulating policies to ensure fulfillment of objectives specified in the program

d) Cooperate with the Ministry of Planning and Investment and Ministry of Finance in allocating resources and appraising funding sources and capacity to balance funding for the project and program

Send consolidated annual and mid-term plans for objectives and duties specified in the program to the Ministry of Planning and Investment and Ministry of Finance in accordance with provisions of the Law on Public Investment, the Law on State Budget and other relevant legal documents

e) Appraise objectives and specialized duties included in the project fulfilled by other ministries and local government authorities in consistent with the local and regional socio-economic development plan and autonomy policies applied to public service providers

g) Send annual estimate of central funding for the program (non-business capital) and forecast about objectives, duties and methods for allocation of central funding given to each project and ministries, central and local government authorities with explanation for principles, criteria and limit on funding allocation to the Ministry of Finance and Ministry of Planning and Investment for consolidation purpose upon consideration of objective fulfillment in the previous year, objectives specified in each project during 2016 - 2020 and reports provided by the Ministry of Finance

h) Take charge of giving instructions to relevant ministries and local government authorities regarding targets and duties included in the annual plan for the purpose of achieving objectives of the program and project; 

i) Take charge of establishment of the program or project monitoring system and instruct agencies running the program and project to evaluate and supervise such program and project as well as complete and operate the information system for management of funding and objectives of the program and project;

k) Take charge and cooperate with other ministries in carrying out periodic and irregular inspection and supervision of relevant ministries and local government authorities in implementing the program and project and conduct periodic review of the implementation result.

l) Take responsibility for management, use and finalization of funding provided directly for tasks included in the program and project for the right purpose in an efficient and economical manner;

m) Take responsibility to consider establishment of organizations for project management in an appropriate and efficient manner;

n) Send periodic and irregular reports as regulated.

2. Ministry of Planning and Investment:

a) Take charge and cooperate with the Ministry of Finance and the agency in charge of the program in balancing and allocating development investment capital according to mid-term and annual plan for the program;

b) Take charge and cooperate with the Ministry of Finance and the agency in charge of the program in appraising investment capital sources and the capacity to balance investment capital provided for projects funded by central government budget, national bonds, Government bonds, ODA loan and foreign concessional loans from foreign sponsor of the program;

c) Cooperate with the agency in charge of the program in checking and monitoring the implementation result.

3. Ministry of Finance:

a) Propose the amount of funding allocated from central government budget (non-business capital) according to the annual and mid-term plan to the Ministry of Planning and Investment for consolidation purpose and report the annual estimated funding amount to the agency in charge of the program, appraise the non-business capital allocation plan prepared by such agency and include it in the state budget estimate submitted to competent  authorities for approval purpose, and give estimate as regulated;

b) Take charge of management and use of non-business capital provided for the program;

c) Cooperate with the agency in charge of the program in checking and monitoring the implementation result.

4. Relevant ministries and central agencies and People’s Committees of provinces and centrally-affiliated cities:

a) Take charge of implementation of ministerial and local programs and projects;

b) Grant approval for the project run by relevant ministries and local government authorities in 5-year period and every year upon consideration of opinions from supervisory authorities of component projects in terms of targets and professional tasks and send such approval to the supervisory authority of the program and project as a basis for supervising the implementation and allocation of funding from central government budget as per provisions of the Law on  Public Investment and legislative documents in force;

c) Assign responsibilities to each department for implementation of the program and project adhering to the principle for raising decentralization and responsibility of local authorities;

d) Send a consolidated report on program implementation and review of proposal of objectives, activities, funding demand and funding structure for the project to the agency in charge of the project which are then included in the annual and mid-term plan as regulated;

dd) Allocate funding from central government budget for the program in a reasonable manner and ensure sufficient funding to cover local expenditures specified in Point e Section VI, Point e Clause 2 Section VI and Point e Clause 3 Section VI Article 1 herein and send reports to the provincial People's Council;

e) Take charge and cooperate with the Ministry of Labor, War Invalids and Social Affairs and relevant agencies in appraising, approving and allocating funding for works, projects and activities included in the program which is included in local expenditure;

g) Manage, evaluate and accept the result of execution of the project included in the program under local management and send periodic reports on local implementation progress to the Ministry of Labor, War Invalids and Social Affairs, Ministry of Planning and Investment and Ministry of Finance as well as conduct review of the program and project run in local areas as regulated;

h) Take responsibility to use the funding provided for duties included in the program and project in an efficient and economical manner and make finalization of such funding under current regulations;

i) Provide guidelines for efficient integration with other programs and projects in the areas under management;

k) Carry our regular and periodic inspection visit to entities running the program and project;

l) Send periodic and irregular reports as regulated.

Article 2. This Decision comes into force from the day on which it is signed.

Article 3. Ministers, Directors of ministerial agencies and Governmental agencies, Chairpersons of People’s Committees of provinces and centrally-affiliated cities and relevant organizations and individuals shall take responsibility to implement this Decision.
