DECISION

ON LIMITATION AND PERMIT FOR TRUCKS TO TRAVEL IN METROPOLITAN AREAS OF HO CHI MINH CITY

PEOPLE'S COMMITTEE OF HO CHI MINH CITY

Pursuant to the Law on Organization of People's Councils and People's Committee dated November 26, 2003;

Pursuant to the Law on Road Traffic dated June 29, 2001;

At the proposal of the City Public Security at the Statement No.53/TT-CATP (PV11) dated August 21, 2007 and Department of Justice at the Official Dispatch No.2595/STP-VB dated September 06, 2007,

DECIDES:

Article 1. To issue together with this Decision the Regulation on limitation and permit for trucks to travel in metropolitan areas of Ho Chi Minh City.

Article 2. This Decision takes effect after 10 (ten) days from the date of signing; to annul the Decision No.621/QD-UB dated February 11, 2003, Decision No.878/QD-UB dated March 07 2003, Decision No.2390/QD-UB dated June 27, 2003, Decision No.4565/QD-UB dated October 24, 2003, Decision No.262/2004/QD-UB dated November 29, 2004, Decision No.186/2006/QD-UBND dated December 29, 2006 and the previous documents with contents related to this decision.

Article 3. Office chief of People's Council and People's Committee of city, City Public Security Director, Director of Department of Transport - Public Works, the heads of departments - branches of the city, Chairmen of People's Committees of rural and urban districts and other concerned organizations and individuals shall implement this Decision./.

REGULATION

ON LIMITATION AND PERMIT FOR TRUCKS TO TRAVEL IN METROPOLITAN AREAS OF HO CHI MINH CITY
(Issued together the Decision No.121/2007/QD-UBND dated September 19, 2007 of City People’s Committee)

Chapter 1:

GENERAL PROVISIONS

Article 1. Scope of application

This Regulation defines limitation of trucks to travel in metropolitan areas of Ho Chi Minh City, order, procedures, competence to permit trucks to travel and responsibilities of the individuals and organizations involved in traffic management and participating in road transport in the area of city.

Article 2. Subjects and time limited travel

1. Trucks with load less than 2.5 tons or a total tonnage of under 5 tons (called as light trucks) are not allowed to travel into metropolitan areas of city from 06 am to 08 am in the morning, from 16 pm to 20 pm in the evening.

2. Trucks with load more than 2.5 tons or a total tonnage of more than 5 tons (called as heavy trucks) are not allowed to travel into metropolitan areas of city from 06 am to 21 pm, except for some corridors route defined in Article 4 of this Regulation.

3. The trucks of sectors of Army, Police, Fire Fighting and Prevention, Public Works traffic Inspectorate as being on duty, double-cabin semi-trucks are not regulated by this Regulation.

Article 3. Limitation of metropolitan areas of Ho Chi Minh City

1. Metropolitan areas of Ho Chi Minh City are limited as follows:

a) The northern and western direction: the National Highway 1A (Section from Binh Phuoc bridge to the intersection of Highway 1A + Nguyen Van Linh street).

b) The eastern direction: Saigon River Bank (from Binh Phuoc bridge to Tan Thuan bridge).

c) The southern direction:

- Huynh Tan Phat street (Section from Tan Thuan Bridge to Tan Thuan Export Processing Zone).

- Nguyen Van Linh street (from intersection of Highway 1A + Nguyen Van Linh street to the intersection of Nguyen Van Linh + Huynh Tan Phat).

2. Trucks are traveled unlimited of time on the limited ring roads above.

Article 4. The corridors allowed to travel from 09 m to 16 pm

1. Heavy trucks are allowed to travel from 09 am to 16 pm on the corridors defined in the Appendix attached to this Regulation.

2. Director of Department of Transport - Public Works to preside over and coordinate with the Committee of City Traffic Safety, City Public Security to gather, adjust, change the roads, the routes for heavy trucks to travel specified in Appendix.

Chapter 2:

OBJECTS PERMITD FOR TRAVEL INTO CITY METROPOLITAN AREAS

Article 5. The types of trucks permitted for travel into city metropolitan areas (both day and night)

1. The trucks for repair and construction of the electricity projects of the Power Company of City, the enterprises with function of transmission, power distribution.

2. Vehicles for rescue of information, construction of works of the city post office, fixing the communications works of the enterprises with functions trading telecommunications and information network on the area of City. Vehicles transporting issuance of letters, newspapers, postal maters, parcels specialized in post office.

3. Vehicles for repair of public lighting, emergency repair of bridges and roads, water supply, drainage, care for the green park of the enterprises, compactors.

4. Light trucks transporting goods for express of the enterprises such as transporting postal matters, parcels, packed goods, goods for export, import.

5. Light trucks for the transport of cash, jewelries of enterprises.

6. Light trucks carrying seeds, seedlings, ornamental fishes, fresh flowers.

7. Light trucks transporting fresh food, basic necessities for social centers, supermarkets, markets and industrial zones.

8. Vehicles of the branches serving food safety inspection, for measuring quality serving disease prevention and fighting, hospitals and health centers.

9. Light trucks serving the sectors of railway, and aviation.

10. Trucks carrying tools and equipment for the holidays, Tet and major festivals of the city.

Article 6. The heavy trucks, specially-used vehicles permitted for travel from 09 am to 16 pm

1. The vehicles transporting fresh concrete to construct the key projects, the big ones not affecting the traffic order and safety and security and public order and it cannot be constructed at night.

2. Freezers transporting seafood for production, processing, export, ice cream carrying trucks, trucks carrying fresh flowers, fruits.

3. Trucks carrying goods serving hospitals, schools, seedling, animal breeds, vaccines, fresh food.

4. Trucks carrying goods, food to serve aviation, railways, the collective kitchens, the food business establishments.

5. Trucks carrying hazardous waste (under Decision No.85/2007/QD-UBND dated June 14, 2007 the City People's Committee); vehicles of collection, transport of mud of tunnels, dredging mud (under the Decision No.73/2007/QD-UBND of May 10, 2007 the City People's Committee).

6. Vehicles for the relocation of the trading, manufacturing facilities from the inner city to the suburb.

7. Trucks transporting goods for the enterprises located near the ring roads to serve the production, trade not affecting the urban traffic tram situation.

8. Trucks transporting fresh water for daily life of the people.

9. The garbage carrying truck by dumper truck.

Article 7. Settlement of irregular cases

The agencies that are competent to permit consider the licensing decision for the irregular cases, in addition to the cases specified in Article 5 and Article 6 of this Regulation, with a travel period not exceeding 05 (five ) days.

Chapter 3:

COMPETENE AND ORDER OF PERMIT

Article 8. Competence to issue and revoke permits

1. Competence to issue permits to those defined in Articles 5, 6 and 7 of this Regulation:

a) Municipal Public Security shall issue permit until the end of December 31, 2007.

b) Department of Transport - Public Works shall issue permits from January 01, 2008.

2. Competence to revoke permits: Traffic Police of the city, inspectors of transportation - public works are competent to revoke permits when the organizations, individuals improperly perform one of the contents specified in the permit.

If the organizations and individuals find improper behavior of implementation as stated in the permits shall inform the Traffic Police of city or inspectors of Transportation - Public Works for handling according to competence.

Article 9. The order of issuing permits

1. Dossier for licensing includes:

a) The office dispatch of the agency or organization; Application of individual that applies for permit, stating clearly the reasons, the number of vehicles, location, route (diagram attached), the travel time needs to be permitted.

b) A copy of Identity card of the vehicle owner (together with the original for comparison); letter of attorney (if the vehicle owner does not directly apply); Letter of recommendation (if it is the agency or organization).

c) Copies of documents, means (together with the originals for comparison): certificate of vehicle registration, technical inspection book.

d) A copy of the permit for vehicle overloading, over-sized in accordance with provisions (with the original for comparison).

đ) A copy of the certificate of business registration, truck lease contract (together with the original for comparison).

2. The time limit for handling dossiers:

The time limit for granting permit shall not exceed 02 (two) working days after receiving complete and valid dossier.

3. The time limit of the permit:

The time limit of the permits is granted according to the needs of organizations and individuals but not more than six months.

4. Fees for licensing:

Comply with the provisions of the Circular No.76/2004/TT-BTC dated July 29, 2004 of Ministry of Finance guiding the regime of collection, remittance, management and use of fees, charges in road transport sector.

Chapter 4:

ORGANIZATION OF IMPLEMENTATION

Article 10. Responsibilities of the licensing agencies

1. To receive dossiers applied for permits under this Regulation and ensure to create favorable conditions for the organizations and individuals applying for permits. In Cases of beyond the competence, propose city People's Committee for consideration and decision.

2. To issue sample of badges to stick on front windshield of the vehicles permitted to facilitate the supervision and inspection.

3. To direct and inspect the dossier receipt, inspect the survey travel route to grant permits and badges for each vehicle as prescribed in order to implement effective prevention of traffic congestion.

Article 11. Responsibilities of relevant agencies

1. City Public Security, Department of Transport - Public Works inspects the implementation of permit and process the violations as prescribed.

2. Department of Planning - Architecture shall preside over and coordinate with the Department of Natural Resources and Environment, Department of Planning and Investment, Department of Transport - Public Works and People's Committees of the suburban districts to plan the construction of truck parking lots at the gateways to the city for the parking of trucks in the time that trucks are banned to travel into the inner city areas.

Article 12. Implementation provisions

1. Based on the contents of this Regulation, Director of Department of Transport - Public Works, City Public Security Director, Directors of the concerned Departments - Boards- Branches, the presidents of People's Committee of the rural, urban districts by their function and tasks have the responsibility to guide, inspect and organize the implementation.

2. In the course of implementation, should be problems and obstacles need to be adjusted, Department of Transport - Public Works is responsible for presiding over and coordinating with other concerned departments and branches to propose to the City People's Committee for consideration and decision./.

 

APPENDIX

THE CORRIDOR ROUTES WHERE HEAVY TRUCK PERMITTED TO TRAVEL FROM 09 O’CLOCK TO 16 O’CLOCK
(Issued together the Decision No.121/2007/QD-UBND dated September 19, 2007 of City People’s Committee)

1. Corridor 1: From Hanoi Highway - Saigon Bridge – girder of Saigon Bridge - Nguyen Huu Canh - Ton Duc Thang - Ham Nghi - Nam Ky Khoi Nghia - Nguyen Truong To - Hoang Dieu - Nguyen Tat Thanh - Tan Thuan 2 Bridge - Nguyen Van Linh; opposite direction: Huynh Tan Phat - Tan Thuan 1 Bridge - Nguyen Tat Thanh - Ton Duc Thang - Nguyen Huu Canh - Saigon Bridge - Hanoi Highway.

2. Corridor 2: from Huynh Tan Phat - Tan Thuan 1 Bridge - Nguyen Tat Thanh - Ton Duc Thang - Nguyen Huu Canh - girder of Saigon Bridge - Dien Bien Phu – Hang Xanh Roundabout - Xo Viet Nghe Tinh - Binh Trieu 1 Bridge - Highway 13; opposite direction: Highway 13 - Binh Trieu 2 - Dinh Bo Linh - Nguyen Xi - Ung Van Khiem - girder of Saigon Bridge - Nguyen Huu Canh - Ton Duc Thang - Ham Nghi - Nam Ky Khoi Nghia - Nguyen Truong To- Hoang Dieu - Nguyen Tat Thanh - Tan Thuan 2 Bridge - Nguyen Van Linh; Vehicles with gross tonnage under 13 tons: Dinh Bo Linh - Bach Dang- Xo Viet Nghe Tinh - Dien Bien Phu.

3. Corridor 3: Dedicated for the tank cars for serving Tan Son Nhat airport (of the  Aviation Fuel Company):

Forward: Truong Son - Tran Quoc Hoan - Hoang Van Thu - Phan Dang Luu - Bach Dang- Xo Viet Nghe Tinh - Dien Bien Phu - Nguyen Huu Canh - Ton Duc Thang - Ham Nghi - Nam Ky Khoi Nghia - Nguyen Truong To – Hoang Dieu - Nguyen Tat Thanh - Tan Thuan 2 Bridge - Nguyen Van Linh - Huynh Tan Phat;

Backward: Huynh Tan Phat - Nguyen Tat Thanh - Ton Duc Thang - Nguyen Huu Canh - Dien Bien Phu - Xo Viet Nghe Tinh - Bach Dang - Phan Dang Luu - Hoang Van Thu - Phan Dinh Giot - Truong Son.

4. Corridor 4: Take the vehicles for registration: from Xo Viet Nghe Tinh - Bach Dang - Phan Dang Luu - 282 No Trang Long to the opposite direction.

5. Corridor 5: trucks travel for registry at the Registry Station 50.03V at 380 Road No. 2 (Van Cao) Tan Phu district: forward Truong Chinh - Tan Ky Tan Quy - Binh Long and backward at opposite direction.

6. Corridor 6: trucks travel for registry at the Registry Center XCG 50.01S No.189A Hoa Binh, Tan Phu:

a) Route 1: From Xo Viet Nghe Tinh - Bach Dang - Phan Dang Luu - Hoang Van Thu - Phan Dinh Giot - Phan Thuc Duyen - Tran Quoc Hoan - Hoang Van Thu - Xuan Dieu - Xuan Hong - Truong Chinh - Ly Thuong Kiet - 343 Lac Long Quan – Hoa Binh (the Registry Center XCG 50.01S No.189A Hoa Binh); backward  Hoa Binh- Lac Long Quan - Ly Thuong Kiet - Hoang Van Thu - Phan Dang Luu - Bach - Xo Viet Nghe Tinh.

b) Route 2: From Highway 1A - Thoai Ngoc Hau ... Hoa Binh Station XCG 50.01S to the opposite direction.

7. Corridor 7: trucks travel for registry at Registry Center XCG 50.02S No.343 Lac Long Quan Street, District 11:

a) Route 1: following the line of Registry Center XCG 50.01S.

b) Route 2: From Kinh Duong Vuong - Hong Bang - 3/2 street - Le Dai Hanh - Au Co - Lac Long Quan - XCG 50.02S Station No. 343 Lac Long Quan Street, District 11 and backward at opposite direction.

- Kinh Duong Vuong Street (Section from Highway 1A to the intersection of Nguyen Van Luong + Ba Hom (Phu Lam roundabout).

- Tran Xuan Soan street (section from Huynh Tan Phat to Rach Ong bridge, District 7).

- Nguyen Huu Tho street (section from Nguyen Van Linh to Kenh Te bridge, District 7).

- Le Van Luong street (section from Nguyen Van to Linh Tran Xuan Soan, District 7).

- Pham The Hien street (section from Au Duong Lan ​​to BA To street, District 8).

- Pham Hung street (section from Nguyen Van Linh  to Pham The Hien, District 8).

- Ta Quang Buu Street in District 8 (through the route).

- National Highway 50 (the section from Nguyen Van Linh to Pham The Hien).

- The road to the wholesale market Binh Dien, Binh Chanh district (section from Nguyen Van Linh to the wholesale market).
