DECISION

PROMULGATING THE 2011 LIST OF KEY ENERGY-USING ESTABLISHMENTS

THE PRIME MINISTER

Pursuant to the Law on Government organization dated December 25, 2001;

Pursuant to the Law on economical and efficient use of energy dated June 28, 2010;

Pursuant to the Government’s Decree No. 21/2011/ND-CP dated March 29, 2011 detailing the Law on economical and efficient use of energy and measures for its implementation;

At the proposal of the Minister of Industry and Trade,

DECIDES:

Article 1. To promulgate the 2011 list of key energy-using establishments at the Annex enclosed with this Decision.

Article 2. Organization for implementation

1. The Ministry of Industry and Trade:

a. Assuming the prime responsibility for, and coordinating with relevant Ministries, sectors and localities in managing activities of using energy of key energy-using establishments as prescribed in the Law on economical and efficient use of energy and the Government’s Decree No. 21/2011/ND-CP dated March 29, 2011 detailing the Law on economical and efficient use of energy and measures for its implementation;

b. Assuming the prime responsibility for, and coordinating with relevant Ministries, sectors and People’s Committees of central-affiliated cities and provinces in updating and submitting the Prime Minister for promulgation of List of key energy-using establishments so as to announce before March 31 of every year.

2. People’s Committees of central-affiliated cities and provinces:

a. Directing relevant Departments, sectors in their localities in notifying the key energy-using establishments in their localities mentioned in List in the Annex enclosed with this Decision and managing, monitoring implementation of programs on economical and efficient use of energy to establishments;

b. Directing the local specialized agencies in examining, reviewing, making list of key energy-using establishments in their localities; summing up and sending to the Ministry of Industry and Trade before February 01 of every year.

3. Economic Groups, State Corporations:

a. Requiring key energy-using establishments being members under management of their units in the List in Annex enclosed with this Decision to implement tasks on economical and efficient use of energy and other relevant legal documents, to report to People’s Committees of central-affiliated cities and provinces where establishments located head offices, concurrently report to Economic Groups, Corporations for summing up and reporting to the Ministry of Industry and Trade;

b. Reviewing an dupdating list of key energy-using establishments under their management; summing up and sending to the Ministry of Industry and Trade before February 01 of every year.

4. Key energy-using establishments in the List in Annex promulgated together with this Decision shall implement full obligations specified in the Law on economical and efficient use of energy and the Government’s Decree No. 21/2011/ND-CP dated March 29, 2011 detailing the Law on economical and efficient use of energy and measures for its implementation as well as other relevant legal documents.

Article 3. This Decision takes effect on the day of its signing.

Article 4. Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, the Presidents of the People’s Committee in central-affiliated cities and provinces, heads of economic groups, state corporations and establishments with name in the List of key energy-using establishments shall implement this Decision.
