CIRCULAR
ON THE PROMULGATION OF THE PROVISIONAL LIST OF ARDUOUS, HARMFUL, AND DANGEROUS WORKS AND LIST OF EXTREMELY ARDUOUS, HARMFUL, AND DANGEROUS WORKS
THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS
Pursuant to the Government's Decree No. 15/CP dated March 02, 1993, defining the duties and powers of Ministries and ministerial agencies;
Pursuant to the Government's Decree No. 96/CP dated March 02, 1993, defining the duties and powers of the Ministry of Labor, War Invalids and Social Affairs;
Pursuant to the Labor Code dated June 23, 1994;
After considering opinions of the Ministry of Health in the Official Dispatch No. 1120/YT-DP dated February 25, 1999 on delegating the Ministry of Labor, War Invalids and Social Affairs to promulgate the list of arduous, harmful, dangerous works, and extremely arduous, harmful, and dangerous works.
DECIDES
Article 1. Promulgating together with this Decision the provisional “List of arduous, harmful, and dangerous works” and “List of extremely arduous, harmful, and dangerous works”
Article 2. The employees doing the works in Article 1 are entitled to labor protection, wages, and social insurance in the Labor Code and its guiding documents.
Article 3. This Decision takes effect after 15 days from the day on which it is signed. The Ministry of Labor, War Invalids and Social Affairs, other Ministries and agencies shall review and make a list of the works that are not enumerated in the lists promulgated together with this Decision, the Decision No. 1453/LĐTBXH-QĐ dated October 13, 1995, the Decision No. 915/LĐTBXH-QĐ dated July 30, 1996, and the Decision No. 1629/LĐTBXH-QĐ dated December 26, 1996 of the Ministry of Labor, War Invalids and Social Affairs, then send it to the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Health for consideration and supplementation.
