AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF REGULATION ON LIMITATION AND LICENSE FOR TRUCKS TO RUN IN METROPOLITAN AREAS OF HO CHI MINH CITY PROMULGATED TOGETHER WITH DECISION NO. 121/2007/QD-UBND DATED SEPTEMBER 19, 2007, OF THE CITY PEOPLE’S COMMITTEE 

PEOPLE’S COMMITTEE OF HO CHI MINH CITY

Pursuant to Law on organization of People's Council and People’s Committee dated November 26, 2003;

Pursuant to Law on road traffic dated November 13, 2008;

At the proposal of the provincial Department of Transport at the Report No. 34/TTr-SGTVT dated September 28, 2011 and Report No. 103/SGTVT-BC dated August 12, 2011,

DECIDES:

Article 1. To amend and supplement a number of articles of Regulation on limitation and license for trucks to run in metropolitan areas of Ho Chi Minh city promulgated together with Decision No. 121/2007/QD-UBND dated September 19, 2007, of the city People’s Committee, as follows:

1. Amending and supplementing content of Article 2:

“1. The transport automobile with load-bearing capacity of less than 2.5 ton or total tonnage of less than 5 tons (called as light trucks) are not allowed running into areas limiting truck circulation from 06:00 AM to 08:00 AM in the morning, and from 16:00 PM to 20:00 PM in the afternoon.  

2. The transport automobile with load-bearing capacity of more than 2.5 ton or total tonnage of more than 5 tons (called as heavy trucks) are allowed running into areas limiting truck circulation from 06:00 AM to 24:00 PM, except for some corridor roads specified in Article 4 of this Regulation.

3. Trucks under sectors of Military, Public Security, Fire Prevention and Fighting, Transport Inspectorate as being on duty, pickup-trucks, and hearse are not regulated by this Regulation.”

2. To amend the subject name of Article 3 and content of Clause 1 Article 3:

“Article 3. Areas limiting truck circulation in geographical areas of Ho Chi Minh City

1. Areas limiting truck circulation as follows:

a) The northern and western direction: The National Highway 1 (Section from Thu Duc intersection to crossroads of Highway 1 and Nguyen Van Linh road).

b) The eastern direction:  Ha Noi highway (section from Thu Duc intersection to Cat Lai intersection) – inter-provincial roads 25B (section from Cat Lai intersection to crossroads of inter-provincial roads 25B and the eastern belt).

c) The southern direction: the eastern belt road (from inter-provincial roads 25B to Phu My bridge) – Phu My bridge – overhead road (connected from intersection of A Nam Sai Gon zone to Phu My bridge) – Nguyen Van Long road (from intersection of A Nam Sai Gon zone to crossroads of national highway 1A - Nguyen Van Linh road)".

3. To amend the subject name of Article 4 and content of Clause 1 Article 4:

“Article 4. Duration for and roads, road sections where heavy trucks are allowed running.

1. Duration for heavy trucks to be allowed running on corridor roads and roads, road sections is specified in Annex promulgated together with this Regulation.”

4. To amend and supplement content of Clause 4, Clause 5 and Clause 6 Article 5:

“4. Light trucks transporting express delivery cargoes of enterprises such as: postal matters, parcels (including letters, newspapers, documents, vouchers) licensed by the Service of Information and Communications or the Ministry of Information and Communications; goods for export, import (including breeds, seedling, ornamental fishes, fresh flowers and food as meat, aquatic and marine products … )

5. To annul Clause 6 Article 5 of Regulation.

6. Light trucks of enterprises with function of transporting industrial meals, raw and fresh foodstuffs (meat, aquatic and marine products) in serve of social centers, schools, hospitals, supermarkets and industrial parks".

5. To amend and supplement content of Clause 1, Clause 9 and supplement Clause 10, Clause 11 Article 6 of Regulation:

“1. Vehicles transporting kinds of construction supplies and equipment for the key works not influencing traffic order and safety, and security and order at public places and construction is not able to perform in the evening.

9. Vehicles transporting garbage by dump trucks, the garbage trucks with closed tank.

10. Vehicles of enterprises with function of traffic rescue.

11. Trucks of agencies, mass associations transporting instruments, equipment in serve of Tet, cultural and art performances in city; trucks transporting props of lion dance teams in serve of Traditional Tet annually”.

6. To amend and supplement the subject name and content of Article 7:

“Article 7. Other cases:

1. The provincial Department of Transport is assigned competence of license, consideration to decide the license for ad-hoc cases, other than cases specified in Article 5 and Article 6 of this Regulation, with time limit of circulation not exceeding 10 (ten) days.

2. The provincial Department of Transport is assigned competence of license for automobiles to be allowed running into banned roads and stopping, parking temporarily on routes, road sections which not cause impacts to traffic order and safety of the city.”

7. To amend and supplement content of Clause 1, Clause 2 Article 8 of Regulation:

“1. Competence for licensing: The provincial Department of Transport.

2. The forces of city traffic Police and transport Inspectorate shall conduct inspection on compliance of contents specified in license of units and individuals licensed and handle violations in accordance with current regulations.  In case of special serious violations, they shall have written report to the licensing agencies for considering withdrawal of licenses".

8. To amend and supplement content of point c, point d, point dd Clause 1, and content of Clause 3 Article 9 of Regulation:

“c) Copies of documents involving vehicles (enclosed with the originals for comparison):  certificate of automobile registration; inspection book of technical safety and environmental protection for road motor transport means.

d) Copy of the certificate of business registration of agencies, organizations requesting for license (in case of truck lease, units leasing trucks must have certificate of business registration, the inspection book of technical safety stated clearly function of trading in transport); and service contract (for postal matters, parcels, imports and exports), enclosed with the original for comparison or certified for copying from the original.

dd) Copies of papers involving the transported goods, enclosed with originals for comparison, or certified for copying from the original.

3. Time limit of license:

Time limit of license for objects at Article 5 and Article 6 is granted under need of organizations and individuals and maximally not more than six months and not exceeding time limit stated in contract of hiring vehicles, economic contract and the inspection book of technical safety.”

9. To amend and supplement content of Clause 2 Article 10 of Regulation:

“2. To conduct license according to form of license; the set form of application for license and model insignias pasted on front glass of trucks (according to the enclosed Annex) for the licensed trucks to be convenient in supervision and inspection”.

10. To replace Annex promulgated together with the Decision No. 121/2007/QD-UBND dated September 19, 2007 of the City People’s Committee: 

“ANNEX 

A. Duration for trucks to be allowed running on corridor routes, and roads, road sections:

“1. Corridor 1 (not limited time).

Go out and in area of Sai Gon port: Direction of going in: Nguyen Van Linh – Huynh Tan Phat roads – Tan Thuan Bridge 1 – Truong Dinh Hoi; direction of going out:  Truong Dinh Hoi – Ton That Thuyet – Tan Thuan bridge 2 – Nguyen Van Linh.

Roads into Binh Dien wholesale market, in Binh Chanh rural District (section from Nguyen Van Linh to Binh Dien wholesale market).

Road 1, Thu Duc district, from Nguyen Van Ba road to branch of Sai Gon river.

2. Corridor 2 (allowed running from 09:00 PM to 16:00 AM everyday): Go for vehicle registration: From Xo Viet Nghe Tinh – Bach Dang – Phan Dang Luu – 282 No Trang Long to go out and vice versa.

3. Corridor 3 (allowed running from 09:00 PM to 16:00 AM everyday): Trucks running for inspection registration at the registration station 50.03V, No. 380, road 2 (Van Cao), Tan Phu district:  Going back Truong Chinh – Tan Ky Tan Quy – Binh Long roads and vice versa.

4. Corridor 4 (allowed running from 09:00 PM to 16:00 AM everyday): Trucks running for inspection registration at the registration station XCG 50.01S, No. 464, Kinh Duong Vuong road, Binh Tan district:  Going National highway 1 – Kinh Duong Vuong – Center of vehicle registration XCG 50.01S; and back along vice versa direction.

5. Corridor 5 (allowed running from 09:00 PM to 16:00 AM everyday): Trucks going for inspection registration at the Center of vehicle registration XCG 50.02S, No. 343/20 Lac Long Quan, district 11: going Kinh Duong Vuong – Hong bang – February 3^rd – Le Dai Hanh – Au Co – Lac Long Quan – Center of vehicle registration XCG 50.02S; and back along vice versa direction

6. Corridor 6 (allowed running from 09:00 PM to 16:00 AM everyday): Trucks running for inspection registration at the Center of vehicle registration XCG 50.05V, No. 03, Phan Van Tri road, Go Vap district:  Going National highway 1 – Ha Huy Giap – Nguyen Oanh -  Phan Van Tri - Center of vehicle registration XCG 50.05V; and back along vice versa direction.

7. Routes on which heavy trucks are allowed running from 09:00 PM to 16:00 AM everyday:

- Kinh Duong Vuong road (section from national highway 1 to Phu Lam traffic circle);

- Vo Van Kiet road (section from National highway 1 to Thu Thiem tunnel).

- Thu Thiem new road (section from Thu Thiem tunnel to inter provincial road 25N).

- Tran Xuan Soan road (section from Huynh Tan Phat road to Rach Ong bridge, district 7);

- Pham The Hien road (section from Au Duong Lan road to Ba To road);

- Nguyen Huu Tho road (Section from Nguyen Van Linh road to Kenh Te bridge at site of district 7);

- The National Highway 50 (Section from Nguyen Van Linh road to Pham The Hien road);

-Le Trong Tan road (section from national highway 1 into Tan Binh industrial zone, Tan Phu district);

- Tay Thanh road, Tan Phu district (throughout route);

- Quang Trung road, Go Vap district (section from National Highway 1 to Thong Nhat road);

- Truong Chinh road (section from National road 1 to Tay Thanh road);

- Dang Van Bi road (throughout route); Vo Van Ngan road (throughout route), Nguyen Van Ba road (throughout route); Le Van Chi road (throughout route) and road 14 (throughout route) in geographical areas of Thu Duc district.

- Ho Hoc Lam road (section from Vo Van Kiet road to An Duong Vuong road, district 8).

8. Heavy trucks are allowed running from 24:00 PM of previous day to 06:00 AM on routes:   Dien Bien Phu road (throughout route); February 3^rd road (throughout route); Bach Dang – Phan Dang Luu – Hoang Van Thu roads; Nguyen Thi Minh Khai road (throughout route); Tran Hung Dao (throughout route); Nam Ky Khoi Nghia – Nguyen Van Troi roads, Ly Thuong Kiet road (throughout route).

B. Forms of licensing:

To issue the set form of license; application for license and model insignias pasted on front glass of vehicles enclosed with this Decision.

Article 2. This Decision takes effect on November 01, 2011. Other contents not mentioned shall be kept intact and comply with Decision No. 121/2007/QD-UBND dated September 19, 2007, of the City People’s Committee.

Article 3. The Chief of office of the City People’s Committee; Director of Departments, sectors of City; chairpersons of People’s Committee of districts – rural districts, heads of relevant agencies and units; individuals and organizations shall implement this Decision.
