DECISION

ON ISSUANCE OF REPORTING MECHANISM ON IMPLEMENTATION OF ODA PROGRAMS AND PROJECTS

THE MINISTER OF PLANNING AND INVESTMENT

Pursuant to Decree No. 61/2003/ND-CP issued on 06 June, 2003 by the Government on the functions, tasks, responsibilities, authorities and organizational structure of the Ministry of Planning and Investment;
Pursuant to Decree No. 131/2006/ND-CP issued by the Government on 09 November, 2006 on the issuance of the Regulation on Management and Utilization of Official Development Assistance (hereinafter called the Regulation);
Pursuant to Decision No. 94/2007/ND-TTg on 27 June, 2007 of the Prime Minister on approval of Action Plan for Implementation of the Strategic Framework for Official Development Assistance Mobilization and Utilization for the period 2006-2010;
Pursuant to Decision No. 52/2007/ND-TTg on 16 April, 2007 of the Prime Minister on issuance of reporting mechanism on the implementation of the State investment capital plan;
Pursuant to Decision No. 555/2007/ND-BKH on 30 May, 2007 on issuance of the Result- based Monitoring and Evaluation Framework for Implementation of the 5-year Social-Economic Development Plan 2006-2010;
At the request of the Director General of the Foreign Economic Relations Department of the Ministry of Planning and Investment,

HAS DECIDED:

Article 1. Issuance of the reporting mechanism on implementation of ODA programs and projects (hereinafter called Reporting Mechanism).

Article 2. Scope of Regulation and Application Objects

1. Scope of Regulation: Applying the Reporting Mechanism to all ODA programs and projects.

2. Application Objects: Program or Project Owners (hereinafter called Project Owners), Line Agencies responsible for the ODA programs and projects, the Ministry of Planning and Investment and the Ministry of Finance.

Article 3. Reporting Formats and Reporting Mechanisms at the Program and Project Level

1. Reporting Formats

The System of Reporting Formats at the Program and Project Level consist of monthly or quarterly reporting formats (Appendix 1), and a yearly reporting format (Appendix 2) attached to this Decision. The ODA programs and projects that are due to be completed in 2007 shall not be subject to this set of reporting formats. As a transition, they should continue to comply with the system of reporting formats that applied over the past period.

As specified in Article 36 of the Regulation, in process of implementation of ODA programs and projects, the Program or Project Management Units shall prepare and submit the reports mentioned above to their Project Owners for sending to the relevant agencies.

2. Reporting Mechanism

a) Monthly Reporting

Monthly reporting shall be applied to all the investment programs and projects under the approval authority of the Prime Minister and the ODA investment programs and projects equivalent to Group A.

Within 10 working days after the end date of the previous month, the Project Owners must send their reports using Forms No. 1 and No. 2 in Appendix 1 by hard copy, fax and Email to their Line Agencies, the Ministry of Planning and Investment, the Ministry of Finance and the People's Committees of provinces and centrally-run cities (hereafter called Provincial People's Committees) of the localities where the program or project is implemented.

Form No. 1 is required to be sent only once after the specific international agreements on ODA takes effect (unless there are any changes).

b) Quarterly Reporting Quarterly reporting shall be applied to all ODA programs and projects.

Within 15 working days after the end date of the previous quarter, Project Owners must send their reports using Forms from No. 1 to No. 20 in Appendix 1 by Email (Forms No. 1 and No.2 sent by hard copy, fax and Email) to their Line Agencies, the Ministry of Planning and Investment, the Ministry of Finance and the Provincial People's Committees of the localities where the program or project is implemented, the relevant line ministries and the Donor (in English, unless there are other agreements). With regards to Form No. 1, it is required to be sent only once after the specific international agreements on ODA takes effect (unless there are any changes - in which case a revised copy should be sent at the time of approved changes).

With regard to programs and projects that have no contents relating to land acquisition, compensation, resettlement and environment protection, Forms from No. 13 to No. 18 are not be applicable and do not need to be reported.

c) Yearly Reporting

Yearly reporting shall be applied to all ODA programs and projects.

Before 31st January of the following year, the Project Owners must send their reports with application of the Annual Report Form in Appendix 2 by hard copy, fax and Email to their Line Agencies, the Ministry of Planning and Investment, the Ministry of Finance and the Provincial People's Committees of the localities where the program or project is implemented, the relevant line ministries and the Donor (if required).

d) Program/Project Completion Report

Program/Project Completion Report shall be applied to all ODA programs and projects. Within 6 months of the completion date of the programs and projects, the Project Owners must send their reports using the Project Completion Report Form in Appendix 3 by hard copy, fax and Email to their Line Agencies, the Ministry of Planning and Investment, the Ministry of Finance and the Provincial People's Committees of the localities where the program or project is implemented, the relevant line ministries and the Donor.

Article 4. Reporting mechanism and reporting formats for the Line Agencies responsible for ODA programs and projects

Within 20 working days after each quarter, Line Agencies must send their consolidated reports on the results of ODA mobilization, portfolio assessment of the implementation of their ODA programs and projects with application of the Form in Appendix 4 by hard copy, fax and Email to the Ministry of Planning and Investment and the Ministry of Finance.

Article 5. Reporting mechanism and reporting formats for the Ministry of Planning and Investment

The Ministry of Planning and Investment shall prepare 6-month and annual comprehensive reports on national ODA attraction and utilization with application of the Form in Appendix 5 and submit to the Prime Minister (by hard copy) and send to the Ministry of Finance and other relevant agencies by hard copy, fax and Email.

- The deadline for 6-month reports: By 31st July of the current year.

- The deadline for annual reports: By 31st January of the following year.

Article 6. Reporting mechanism and reporting formats for the Ministry of Finance The Ministry of Finance shall prepare 6-month and annual reports on overall disbursement of ODA programs and projects with application of the Form in Appendix 6 to submit to the Prime Minister (by hard copy) and send to the Ministry of Planning and Investment and other relevant agencies by hard copy, fax and Email.

- The deadline for 6-month reports: By 31st July of the current year.

- The deadline for annual reports: By 31st January of the following year.

Article 7. Implementation

1. The Head of the units and agencies as specified in Item 2, Article 1 shall be responsible for implementing this Decision.

2. This Circular shall come into effect 15 days from the date of its announcement in the Official Gazette. During its implementation, if encountering any issues or problems, the line ministries, localities and relevant agencies are required to provide timely feedback to the Ministry of Planning and Investment for further amendment and improvement of this Circular./.
