DECISION
FEES AND CHARGES FOR MANAGEMENT OF POSTAL SERVICE QUALITY AND ACTIVITIES OF POSTS AND TELECOMMUNICATIONS (THE MINISTER OF FINANCE’S DECISION No. 89/2004/QĐ-BTC DATED NOVEMBER 22, 2004)
THE MINISTRY OF FINANCE
Pursuant to Ordinance on post and telecommunications dated May 25, 2002;
Pursuant to Ordinance on goods quality dated December 24, 1999;
Pursuant to the Government’s Decree No. 57/2002/NĐ-CP dated June 03, 2002 detailing the implementation of the Ordinance on Fees and Charges;
Pursuant to the Government’s Decree No. 77/2003/NĐ-CP dated July 01, 2003 defining the functions, tasks, entitlements and organizational structure of the Ministry of Finance;
Pursuant to the Prime Minister's Decision No. 37/2002/QĐ-TTg dated March 14, 2002 on the Government’s Action Program to implement the Poliburo's Resolution No. 07-NQ/TW dated November 27 2001 on international economic integration;
Pursuant to comments from the Ministry of Posts and Telecommunications (At the Official Dispatch No. 1624/BBCVT-KHTC dated August 19, 2004 and Official Dispatch No. 1997/BBCVT-KHTC dated October 11, 2004);
At the request of General Director of Department of Tax Policy,
HEREBY DECIDE:
Article 1. Enclosed with this Decision is the Schedule of fees, charges for management of postal service quality and activities of post and telecommunications.
Article 2. Any organization or individual that is granted certificates for postal service quality shall pay fees, charges according to the Schedule enclosed herewith.
Article 3. Fees, charges for management of postal service quality and activities of posts and telecommunications shall not be charged for:
1. Telecommunications network used by the Ministry of Public Security, the Ministry of National Defense, the Ministry of Foreign Affairs for the tasks of national security and defense, external affairs;
2. Communication networks used for emergency cases such as floods and other natural catastrophes;
3. Communication networks belonging to international agencies and organizations in Vietnam that are entitled to diplomatic immunity (except for fees, charges for issuance of certificates of standard conformity for material and equipment of posts and telecommunications).
Article 4. Fees, charges for the management of postal service quality and activities of post and telecommunications as prescribed hereof are receipts belonging to the state budget, being managed and used as follows:
1. Agencies that collect fees, charges for management of quality of postal service quality and activities of posts and telecommunications (hereinafter referred to as 'fee-collecting agencies') shall receive 90% of the fees (the remaining to be paid to the state budget) for the management of postal service quality and activities of posts and telecommunications and for collection of fees as prescribed;
2. The fee-collecting agency shall be responsible for making declaration and payment of the remaining 10% to the state budget according to chapter, type, clause, section, sub-section in proportion to current table of content of the state budget.
Article 5.
1. This Decision takes effect since 15 days since the Official Gazette is published.
2. This Decision shall supersede the Minister of Finance’s Decision No. 150/2000/QĐ-BTC dated September 19, 2000 promulgating the Schedule of fees for management of postal service quality.
3. Other issues in connection with collection, payment, management and use of fees, documentary evidence of fees, declaration of collection of fees...not prescribed hereof shall be instructed in the Ministry of Finance’s Circular No. 63/2002/TT-BTC dated July 24, 2002 providing guidance on law provisions on fees and charges.
Article 6. Organizations, individuals who pay fees for the management of postal service quality and activities of posts and telecommunications, units tasked with organizing collection of fees for the management of postal service quality and activities of posts and telecommunication and relevant agencies shall be responsible for executing this Decision.
