DECREE

REQUIREMENTS FOR MOTOR VEHICLE INSPECTION SERVICE BUSINESS

Pursuant to the Law on Government organization dated June 19, 2015;

Pursuant to the Law on Investment dated November 26, 2014;

Pursuant to the Law on Road traffic dated November 13, 2008;

At the request of the Minister of Transport;

The Government has promulgated the Decree providing for requirements for motor vehicle inspection service business.

Chapter I.

GENERAL PROVISIONS

Article 1. Governing scope

This Decree regulates requirements for inspection service business with respect to automobiles, trailers, semi-trailers hauled by automobiles and similar vehicles (hereinafter referred to as 'motor vehicles') and the issue of certificates of satisfaction of conditions for motor vehicle inspection (hereinafter referred to as ‘inspection condition certificates’).

Article 2. Regulated entities

1. This Decree applies to agencies, organizations and individuals in relation to motor vehicles inspection service management and business.

2. This Decree does not apply to agencies, organizations and individuals performing inspection of motor vehicles used by military, public security forces for national defense and security purposes.

Article 3. Interpretation of terms

In this Decree, some terms are construed as follows:

1. Motor vehicle inspection (hereinafter referred to as ‘inspection’) refers to regular inspection of quality of technical safety and environmental protection for motor vehicles.

2. Certificate for inspection of technical safety and environmental protection for road motor vehicles (hereinafter referred to as “inspection certificate’) refers to the certificate confirming that motor vehicle has been inspected and met all the standards, regulations on quality of technical safety and environmental protection.

3. Motor vehicle registration unit (hereinafter referred to as ‘the registration unit’) refers to organizations established according to laws, providing services of verification, registration and issuing the inspection certificate.

4. Inspection station refers to the area where inspection equipment, support equipment and other facilities is located.

5. Inspection line refers to the place where positions of inspection and installation of inspection equipment are arranged. An inspection line comprises two types:

a) Type I inspection  line: Able to inspect a motor vehicle with weight distributed on each single axis up to 2,000 kg;

b) Type II inspection  line: Able to inspect a motor vehicle with weight distributed on each single axis up to 13,000 kg;

6. Head of the registration unit is the person who is responsible for organizing and implementing regulations on inspection performed at the registration unit and signing the inspection certificate.

Article 4. Principles for motor vehicle inspection services

1. Organizations that are granted inspection condition certificates shall be eligible for performing motor vehicle inspection services.

2. Organizations performing motor vehicle inspection services (hereinafter referred to as ‘inspection organizations’) shall not be allowed to be involved in provision of auto transport services, services of motor vehicle care, repairs or establish relationship with organizations performing such services. If the inspection organization is a joint-stock company, the organization providing auto transport services, services of motor vehicle care, repairs (hereinafter referred to as ‘auto transport & care provider’) shall own no more than 10% of the inspection organization’s shares.

Chapter II.

REQUIREMENTS FOR MOTOR VEHICLE INSPECTION SERVICE BUSINESS

Article 5. General requirements

1. Establishment of the registration unit should conform to the general planning for registration units and inspection lines.

2. Organizations that meet requirements for facilities, equipment, human force as prescribed in this Chapter shall be granted inspection condition certificates.

Section 1. REQUIREMENTS FOR FACILITIES

Article 6. Premises of the registration unit

1. For registration units with one Type I inspection  line, minimum area of the premises for inspection activities is 1,250 m2.

2. For registration units with one Type II inspection  line, minimum area of the premises for inspection activities is 1,500 m2.

3. For registration units with two inspection lines, minimum area of the premises for inspection activities is 2,500 m2.

4. For registration units with at least three inspection lines, usable area for each corresponding additional inspection line should not be less than 625 m2.

Article 7. Inspection station

1. Inspection stations with only one Type I inspection line: Minimum size including clearance around the vehicle (length x width x height): 30 x 4 x 3.5 (m)

2. Inspection stations with only one Type II inspection  line: Minimum size including clearance around vehicle (length x width x height): 36 x 5 x 4.5 (m)

3. For inspection stations with several adjacent inspection lines, the distance between centers of inspection lines should be at least 4 meters and the distance between the center of the outermost line and inner face of the station's wall should be at least 2.5 meters.

4. In case inspection lines are positioned in several inspection stations, minimum total length of the inspection stations should be equal to the length of corresponding inspection lines as prescribed in Clauses 1 and 2, this Article.

Article 8. Offices, parking lot, internal roads

1. The registration unit should have offices, lounge for drivers, vehicle owners.

2. Roads for motor vehicles entering and leaving the inspection station, internal roads: should be at least three meters in width, parking lot should be paved with asphalt concrete or cement concrete.

Article 9. Inspection equipment, tools

1. Inspection equipment of an inspection line comprises:

a) Brake inspection equipment;

b) Vehicle scale;

c) Longitudinal wheel slip meter;

d) Emission analyzers;

dd) Smoke meter;

e) Noise meter. For registration units with at least two inspection lines arranged in the same inspection station, only one noise meter is required;

g) Headlight tester;

h) Chassis testing device;

i) Jacks/hoists or inspection pit;

k) Motor load testing equipment (in case of load method- based emission tests)

2. Inspection equipment of each inspection line can be arranged inside or outside inspection stations.

3. Inspection equipment:

a) Must have an central operating software capable of controlling operation of the equipment in accordance with inspection process, capable of installing evaluation standards, establishing inspection procedures depending on inspection equipment arrangement (except the equipment as prescribed in Points b, h, i, Clause 1, this Article);

b) The operating software should have Vietnamese installed for all functions;

c) The software’s database should be kept secret if required and connected to national inspection database system at the Vietnam Register.

4. Inspection equipment should be inspected, calibrated before and during use as prescribed; technical functions of the equipment should be maintained during use and between the periods of inspection, calibration.

5. Inspection tools of an inspection line:

a) Tire pressure gauge;

b) Flash lights;

c) Special-use hammers;

d) Tape measure;

dd) Inspection pit jack (if inspection pit is available).

Article 10. Regulations on communications, data storage and transmission equipment

1. Have internet connection to ensure transmission of data, images of inspection activities; have static IP address and equipment to establish connection of virtual private network (VPN) to the server of the Vietnam Register.

2. The registration unit shall store inspection data as archives according to regulations of the Ministry of Transport.

3. Servers, computers shall be internally connected and installed with software programs capable of managing inspection information, controlling inspection equipment of the line. Data of such software shall be stored in the server of the registration unit and synch up with the central database on the server of the Vietnam Register.

4. Other facilities include:

a) Office equipment;

b) Cameras for taking pictures of vehicles entering for inspection;

c) IP cameras for monitoring inspection activities on the line; storing pictures of motor vehicles undergoing inspection for at least 30 days since the date of inspection;

d) Monitors shall be installed at the lounge for drivers (or vehicle owners) to follow up during the inspection process;

dd) Fire prevention and fighting facilities, labor protective and environmental protection equipment.

5. Have a system of receiving registration for inspection from vehicle owners via phone, websites.

Section 2. REQUIREMENTS FOR HUMAN FORCE

Article 11. Inspectors

There are two types of inspector: motor vehicle inspectors (herein ‘inspectors’) and high-level motor vehicle inspectors (herein ‘high-level inspectors’).

1. Inspectors:

a) Qualifications: Obtain at least university degrees in automotive mechanical engineering, automotive engineering technology or mechanical engineering, mechanical engineering technology. The training program should cover following subjects: Automotive theory, automotive structures, structure calculation, technical maintenance, internal combustion engine, automotive electricity or equivalent subjects.

b) Obtain at least level B of English or equivalent;

c) Have been trained in professional competence in motor vehicle inspection according to programs organized by the Ministry of Transport.

d) Experience at least 12 months of probation as an inspector in the registration unit after completing training;

dd) Meet requirements for motor vehicle inspection;

e) Driving license that remains effective;

2. High-level inspectors:

a) Be an inspector with at least 36 months of experience;

b) Have been trained in professional competence in motor vehicle inspection at high level according to programs organized by the Ministry of Transport.

c) Meet requirements for motor vehicle inspection at high level;

Article 12. Procedures of issue of inspector certificates

1. Persons who meet requirements as prescribed in Clauses 1, 2, Article 11 hereof may make requests to the Vietnam Register for the issue of the inspector certificate. The application for the issue of the inspector certificate includes:

a) Written request;

b) Resume according to the form in Annex I enclosed herewith (in case of applying for the first issuance or re-issuance after revocation);

c) Certified or authenticated copy of university diplomas, transcripts and higher (for an inspector) and other certificates as prescribed in Clauses 1, 2, Article 11 hereof;

d) Written confirmations of probation period of the inspector issued by the registration unit (for an inspector);

dd) Certificates of training in professional competence of inspection (herein 'training certificates')

e) One (01) color 4x6 photo, taken for no more than six months.

2. Procedures:

a) Organizations, individuals should prepare the application as prescribed in Clause 1 of this Article and make the submission to the Vietnam Register. For an inspector (distinguished from high-level inspector), submission of the application should be done within 12 months since the date of completion of probation period;

b) Within three working days since receipt of the application, the Vietnam Register shall carry inspection of the application and give notification to applicants of the time for performing evaluation of professional competence and knowledge of relevant standards, regulations

c) The Vietnam Register shall carry out the evaluation and record inspector's performance in the evaluation record according to the form in Annex II enclosed herewith; if the performance is satisfactory, the inspector certificate shall be issued within five working days since the date of evaluation. Otherwise, the applicant may make a request to the Vietnam Register for re-evaluation after six months since the date of evaluation;

d) Receiving and handling of applications shall be carried out in person, by post or through online public services;

3. The inspector certificate conforms to the form in Annex III enclosed herewith and takes effect for 36 months since the date of issue and shall be re-issued in case of expiration, loss or damage; Validity period of the re-issued inspector certificate shall not exceed that of the previously issued one except in case of re-issuance as a result of expiration.

Article 13. Procedures of re-issue of inspector certificates

1. Within 30 days before the inspector certificate expires, the registration unit, inspector should send a written request (accompanied by one color 4x6 photo, taken for no more than six months) to the Vietnam Register for re-issue of the inspector certificate. Within five working days since receipt of the written request, the Vietnam Register shall carry out evaluation of the inspector’s professional competence at the registration unit and issue the inspector certificate after three working days since the date of evaluation (if result is satisfactory). If result is unsatisfactory, the applicant may make a request to the Vietnam Register for re-evaluation after one month since the date of evaluation.

2. If the inspector certificate is lost or damaged, the inspector may make a written request to the Vietnam Register for re-issuance and at the same time stop performing inspection at the registration unit. The Vietnam Register shall rely on records to re-issue the inspector certificate after seven working days since receipt of the written request.

Article 14. Suspension of inspectors’ inspection activities

The inspector shall be suspended from performing inspection activities from one to three months in following cases:

1. Falsify inspection results;

2. Fail to comply with relevant procedures, technical regulations and standards.

Article 15. Revocation of inspector certificates

The inspector shall be stripped of inspector certificate in following cases:

1. Falsify applications for issue of inspector certificate;

2. Fail to meet requirements as prescribed in Clauses 1 and 2, Article 11 hereof;

3. Falsify inspection results; fail to comply with procedures, standards, regulations causing serious consequences.

4. Be suspended from inspection activities more than two times in a year.

5. Be convicted by the court;

6. Have civil act capacity lost or limited;

7. Fail to work for more than 12 months in any registration unit;

8. Work for two registration units at the same time.

Article 16. Procedures for suspension of inspection activities and revocation of inspector certificates

1. The Vietnam Register shall make decision on suspension of inspection activities and revocation of inspector certificates from inspectors, give notification to relevant agencies for coordination and make public notice on the website.

2. The inspector should return the inspector certificate to the Vietnam Register (in case of revocation) and at the same time stop performing activities in the registration unit immediately after the decision on revocation takes effect.

3. Inspectors with inspector certificates revoked may apply for re-issuance of inspector certificates only after 36 months since the date of revocation.

Article 17. Inspection staff

1. Vocational secondary school degrees at a minimum.

2. At least level B of English or equivalent;

3. Have been trained and granted certificates of training in inspection as prescribed by the Ministry of Transport.

Article 18. Inspection line captain

1. Must be an high-class inspector:

2. Be appointed by the organization establishing the registration unit;

Article 19. Head of registration unit

1. Must be an inspector who has performed inspection for at least 36 months.

2. Be appointed by the organization establishing registration unit;

Article 20. Number of inspectors, motor vehicles to be inspected by registration unit

1. To carry out inspection, each inspection line should have at least three inspectors at least one of which is high-class inspector.

2. Inspection line captain should be arranged in place. Each captain shall take charge of two inspection lines at a maximum.

3. Number of motor vehicles to be eligible for issue of inspection certificates in a day (within eight working hours) should meet simultaneously following requirements:

a) No more than 20 vehicles/day if each inspector takes charge of one vehicle; no more than 20 times the number of inspectors/day (number of inspector multiplying by 20) if more than one inspector takes charge of one vehicle;

b) No more than 90 vehicles (in case of Type I inspection line) and 70 vehicles (in case of Type II inspection line)

Chapter III

ISSUE AND REVOCATION OF INSPECTION CONDITION CERTIFICATES

Article 21. Procedures for issue of inspection condition certificates

1. After construction and installation of technical facilities are completed, the registration unit should prepare and deliver one application to the Vietnam Register for issue of the inspection condition certificate. The application includes:

a) A written request;

b) List of personnel working in the registration unit accompanied by employment contracts as prescribed or employment hiring decisions (in case of inspectors, inspection staff); appointment decision (in case of captains of inspection lines or heads of registration units);

c) List of inspection equipment, tools, communications, data storage and transmission equipment as prescribed in Article 9, Article 10 hereof.

2. Sequence, procedures for issue of inspection condition certificates:

a) Within three working days since receipt of the application, the Vietnam Register shall give notification to the registration unit of the time for inspection and evaluation (if the application is satisfactory) or reasons for failure (if the application is unsatisfactory);

b) Within seven working days since notification, the Vietnam Register shall carry out inspection and evaluation and record results in the inspection note according to the form in Annex IV enclosed herewith. If result is satisfactory, within five working days the Vietnam Register shall issue the inspection condition certificates or otherwise shall give notification within three working days.

3. Receiving and handling of applications shall be carried out in person, by post or through online public services;

4. Inspection condition certificates (according to the form in Annex V enclosed herewith) shall be re-issued in case of loss, damage or changes to personnel, location, premises of inspection stations, re-arrangement of inspection lines, inspection equipment.

Article 22. Procedures for re-issue of inspection condition certificates

1. Procedures for re-issue of inspection condition certificates due to revocation are the same as procedures as instructed in Article 21 hereof.

2. If the inspection condition certificate is lost or damaged, the registration unit may make a written request for re-issuance to the Vietnam Register and at the same time should stop performing inspection. The Vietnam Register shall rely on records to re-issue the inspection condition certificate after 15 working days since receipt of the written request.

Article 23. Suspension of inspection activities

Part or whole of the registration unit’s operation shall be suspended from one to three months in following cases:

1. Fail to meet requirements for facilities, personnel, inspection equipment, tools, communications, data storage and transmission equipment as prescribed hereof.

2. Perform inspection with inspection equipment, tools being damaged, failing to ensure accuracy or not undergoing inspection, evaluation and calibration as prescribed.

3. Perform inspection and issue inspection certificates to motor vehicles without compliance with technical regulations and standards, authority.

4. At least three times inspectors are suspended from activities or at least two inspectors are stripped of inspector certificates within 12 months;

5. Use and assignment of inspectors not in conformity with inspector certificates;

Article 24. Revocation of inspection condition certificates

The registration unit shall be stripped of inspection condition certificate in following cases:

1. Falsify applications, documents to be eligible for issue of inspection condition certificates.

2. Intentionally erase and falsify contents of the issued inspection condition certificate;

3. Fail to carry out inspection activities within six months since the inspection condition certificate is issued;

4. Stop performing inspection for more than six months;

5. Be suspended from inspection activities more than two times in a year.

6. At least five times inspectors are suspended from activities or at least three inspectors are stripped of inspector certificates within 12 months;

7. The registration unit goes dissolved or subject to revocation.

Article 25. Procedures for revocation of inspection condition certificates

1. The Vietnam Register shall make decision on revocation of inspection condition certificates, give notification to relevant agencies for coordination and make public notice on the website.

2. The registration unit should return the inspection condition certificate to the Vietnam Register in case of revocation and at the same time stop activities immediately after effective date of the decision.

3. The organization establishing registration unit that is stripped of inspection condition certificate shall be prohibited from performing motor vehicle inspection for 36 months since the date of revocation except for organizations as public non-business units.

4. After inspection condition certificates are revoked and inspection activities are suspended, heads of registration units and inspectors shall continue to be responsible to the law for inspection results issued and still in force.

5. After inspection condition certificates are revoked and inspection activities are suspended, relevant organizations, individuals shall continue to perform other obligations and responsibilities according to laws.

Article 26. Procedures for bringing inspection activities to a halt;

1. In case of an abrupt halt for more than one day due to objective reasons, the registration unit should give notification to the Service of Transport in the locality, the Vietnam Register specifying reasons and remedial plans; post notice at the lounge and maintain personnel for handling matters relating to inspection documents; remedial works should be completed within one month.

2. In case registration units make requests for a halt for six months straight;

a) The registration unit should give notification to the Service of Transport, the Vietnam Register 30 days prior to the halt and at the same time post a notice at the lounge.

b) Maintain personnel for handling matters relating to inspection documents.

3. In case registration units make requests for a halt for more than six months straight;

a) The registration unit should give notification to the Service of Transport, the Vietnam Register 30 days prior to the halt and at the same time post a notice at the lounge.

b) Return the inspection condition certificate;

c) Transfer all the records of motor vehicles to other registration units as instructed by the Vietnam Register.

Chapter IV

IMPLEMENTATION

Article 27. Responsibility

1. The Ministry of Transport

a) Preside over and cooperate with relevant ministries, departments and sectors in formulating general planning for a network of registration units and inspection lines;

b) Provide instructions on investigation and handling of violations as prescribed hereof.

2. The Ministry of Finance shall provide instructions on implementation of regulations on receipts and expenses in the area of motor vehicle inspection.

3. People’s committees of central-affiliated provinces and cities shall provide instructions to Services of Transport, local state agencies on motor vehicle inspection services performed by registration units in the administrative division as prescribed hereof; allocation of land for construction of registration units in conformity with general planning of registration units and inspection lines.

4. Organization establishing registration unit.

a) Be responsible for legality of application for inspection condition certificates;

b) Unify with the Vietnam Register in developing construction of inspection stations with the aim of ensuring general planning for registration units and inspection lines;

c) Ensure operation of registration units as prescribed;

d) Accept penalties imposed by competent agencies when the registration unit commits acts in violation of conditions for inspection operation;

dd) Ensure benefits to employees according to laws.

5. The Vietnam Register

a) Provide instructions, perform specialty investigation and implement assignments as prescribed hereof and instructions on inspection services from the Ministry of Transport;

b) Make annual inspection and assessment of registration units’ facilities, human force, inspection equipment, tools, communications, data storage and transmission equipment, documentation and reporting on inspection activities; make assessment and calibration of inspection equipment;

c) Construct inspection management software programs and database, manage and unify use of such programs and database system across the country; set up data connection;

d) Formulate plans for training in professional competence for inspectors, inspection staff at the request of registration units, organizations and individuals establishing registration units; provide training in professional competence, content and procedures for inspection as prescribed by the Ministry of Transport;

dd) Make reports on implementation of inspection activities as prescribed;

e) Handle or make proposals for handling organizations or individuals committing violations as prescribed hereof;

g) Publish on the website of competent agencies the list of registration units that are granted or stripped of inspection condition certificates;

6. Registration unit:

a) Comply with provisions set out in this Decree and provisions concerning inspection operation conditions;

b) Perform inspection and issue inspection certificates as prescribed;

c) Maintain conditions for facilities, personnel, inspection equipment, tools, communications, data storage and transmission equipment;

d) Collect fees, charges for inspection and other charges and fees as prescribed;

dd) After 18 months since the inspection condition certificate is issued, the registration unit should construct, apply and maintain quality management system according to ISO 9001;

e) Post at inspection stations procedures and content of inspection; prices, fees, charges, inspection cycle, hot lines of the Vietnam Register and other information as prescribed;

g) Perform or coordinate tasks concerning traffic safety, technical conditions of vehicles and protection of traffic infrastructure as requested by competent agencies;

h) Ensure normal working time from 8 hours/day and five days/week;

i) Treat personal information of vehicle owners and inspection database as confidential unless otherwise as requested by competent agencies;

k) Be subject to investigation and inspection of operation conditions by competent agencies;

l) Implement data transmission and reporting as prescribed;

Chapter V

IMPLEMENTARY PROVISIONS

Article 28. Transitional provisions

1. Any inspection condition certificate granted before the effective date of this Decree shall remain effective till the end of validity period noted thereon. Any registration unit that has been approved for establishment approved but fail to meet requirements as prescribed hereof shall remain eligible for the issue of inspection condition certificate according to provisions at the time the written approval for establishment is issued.

2. Any inspector certificate granted before the effective date of this Decree shall remain effective till the end of validity period noted thereon.

3. Within three years since the effective date of this Decree, registration units with establishment approved, certified inspectors should meet all the requirements as prescribed hereof except provisions set out in Points a and d, Clause 1, Article 11 hereof. Re-issuance of inspector certificates, inspection condition certificates to those failing to meet requirements as prescribed hereof before three years since the effective date of this Decree is instructed in existing regulations on issuance of certificates with validity period no more than three years since the effective date of this Decree.

Article 29. Effect

1. This Decree takes effect since July 01, 2016.

2. Ministries, heads of ministerial-level agencies, heads of governmental agencies, presidents of the People’s Committees of central-affiliated provinces and cities, relevant organizations and individuals shall be responsible for executing this Decree.
