DECREE

PROMULGATING THE LIST OF NARCOTIC SUBSTANCES AND PRE-SUBSTANCES

THE GOVERNMENT

Pursuant to the Law on Organization of the Government of September 30, 1992;
Pursuant to the Law on Drug Prevention and Fight of December 9, 2000;
At the proposals of the Minister of Public Security, the Minister of Health and the Minister of Industry,

DECREES:

Article 1.- To promulgate together with this Decree the lists of narcotic substances and pre-substances as follows:

List I: Extremely toxic narcotic substances, which are absolutely banned from use; the use thereof for analysis, test, scientific research and criminal investigation shall comply with special stipulations of competent agencies;

List II: Toxic narcotic substances, which may be restrictedly used for analysis, test, scientific research or criminal investigation, or in medical field according to treatment requirements;

List III: Toxic narcotic pharmaceuticals, which are permitted for use for analysis, test, scientific research or criminal investigation or in medical field according to treatment requirements;

List IV: Chemicals which are indispensable in the process of drug preparation and production.

Article 2.- When discovering new substances not yet included in the lists of narcotic substances and pre-substances issued together with this Decree, which relate to the production, preparation and use of drug, or when deeming it necessary to change the substances included in the lists according to the announcement of the United Nations Secretary General, the Ministry of Public Security shall have to assume the prime responsibility and coordinate with the Ministry of Health, the Ministry of Industry, the Ministry of Science, Technology and Environment and the concerned agencies in considering and proposing the Government to amend and supplement these lists, then announcing the amended and supplemented ones.

Article 3.- Agencies, organizations and individuals that research into, expertise, produce, transport, preserve, store, sell and buy, distribute, use, process, exchange, import, export and/or transit substances on the lists prescribed in Article 1 of this Decree shall have to abide by the provisions of the legislation on control of lawful drug-related activities.

Article 4.- This Decree takes effect 15 days after its signing.

The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the People’s Committees of the provinces and centrally-run cities shall have to implement this Decree
