CIRCULAR

SUPPLEMENTING THE CIRCULAR NO.09/2007/TT-BKHCN DATED 06/4/2007 OF MINISTRY OF SCIENCE AND TECHNOLOGY GUIDING THE IMPLEMENTATION OF A NUMBER OF ARTICLES OF DECREE NO.89/2006/ND-CP DATED 30/8/2006 OF THE GOVERNMENT ON LABELS

Pursuant to the Decree No.54/2003/ND-CP dated 19/5/2003 of the Government providing for function, duties, authorities and organizational structure of the Ministry of Science and Technology and the Decree No.28/2004/ND-CP dated 16/01/2004 of the Government amending, supplementing a number of Articles of the Decree No.54/2003/ND-CP;

Pursuant to the Decree No.89/2006/ND-CP dated 30/8/2006 of the Government on labels of goods;

Pursuant to the Notice No.137/TB-VPCP dated 04/7/2007 of the Government’s Office communicating the conclusions of the Deputy Prime Minister Nguyen Sinh Hung on the names and addresses of organizations and individuals taking responsibilities for the goods on labels;

The Ministry of Science and Technology guides additionally the Circular No.09/2007/TT-BKHCN dated 06/4/2007 of the Ministry of Science and Technology guiding the implementation of a number of Articles of Decree No.89/2006/ND-CP dated 30/8/2006 of the government on labels as follows:

1. Adding point g at the end of clause 3 of Section II as follows:

"g) For the production of goods, the organizations and individuals being responsible for goods that are legal entities registered for production and trading goods branded, labeled owned by such entities or transferred the use right: are responsible for the quality of such branded, labeled goods;

For organizations and individuals being responsible for the goods having many different production facilities, the goods bearing the same brand produced, traded by these facilities are allowed to name and state addresses of the organizations, individuals being responsible for such goods if these goods are certified by the competent State management agencies the quality in accordance with quality standards of goods announced by organizations and individuals being responsible for the goods".

2. Implementation provisions

This Circular takes effect 15 days after its publication in the Official Gazette.

Pursuant to Decree No.89/2006/ND-CP dated 30/08/2006 of the Government on labels, Circular No.09/2007/TT-BKHCN dated 06/4/2007 of Ministry of Science and Technology guiding the implementation of some Articles of Decree No.89/2006/ND-CP and this Circular, within their assigned management fields, the ministries, ministerial-level agencies shall organize the goods quality certification for the facilities of the organizations and individuals being responsible for goods to manufacture in accordance with goods quality standards announced the application according to law provisions on standards and technical regulations by organizations and individuals being responsible for such goods./.
